<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id70f59214-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602"><num value="1602">§ 1602.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f59215-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/1"><num value="1" class="bold">(1)</num><heading class="bold"> Agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “agency” has the meaning given that term in <ref href="/us/usc/t5/s551/1">section 551(1) of title 5</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f59216-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/2"><num value="2" class="bold">(2)</num><heading class="bold"> Client</heading><content><p style="-uslm-lc:I12" class="indent1">The term “client” means any person or entity that employs or retains another person for financial or other compensation to conduct lobbying activities on behalf of that person or entity. A person or entity whose employees act as lobbyists on its own behalf is both a client and an employer of such employees. In the case of a coalition or association that employs or retains other persons to conduct lobbying activities, the client is the coalition or association and not its individual members.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f59217-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3"><num value="3" class="bold">(3)</num><heading class="bold"> Covered executive branch official</heading><chapeau>The term “covered executive branch official” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59218-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/A"><num value="A">(A)</num><content> the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59219-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/B"><num value="B">(B)</num><content> the Vice President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5921a-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/C"><num value="C">(C)</num><content> any officer or employee, or any other individual functioning in the capacity of such an officer or employee, in the Executive Office of the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5921b-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/D"><num value="D">(D)</num><content> any officer or employee serving in a position in level I, II, III, IV, or V of the Executive Schedule, as designated by statute or Executive order;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5921c-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/E"><num value="E">(E)</num><content> any member of the uniformed services whose pay grade is at or above O–7 under <ref href="/us/usc/t37/s201">section 201 of title 37</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5921d-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/3/F"><num value="F">(F)</num><content> any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy-advocating character described in <ref href="/us/usc/t5/s7511/b/2/B">section 7511(b)(2)(B) of title 5</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f5921e-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4"><num value="4" class="bold">(4)</num><heading class="bold"> Covered legislative branch official</heading><chapeau>The term “covered legislative branch official” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5921f-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/A"><num value="A">(A)</num><content> a Member of Congress;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59220-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/B"><num value="B">(B)</num><content> an elected officer of either House of Congress;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59221-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C"><num value="C">(C)</num><chapeau> any employee of, or any other individual functioning in the capacity of an employee of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id70f59222-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C/i"><num value="i">(i)</num><content> a Member of Congress;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59223-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C/ii"><num value="ii">(ii)</num><content> a committee of either House of Congress;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59224-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C/iii"><num value="iii">(iii)</num><content> the leadership staff of the House of Representatives or the leadership staff of the Senate;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59225-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C/iv"><num value="iv">(iv)</num><content> a joint committee of Congress; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59226-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/C/v"><num value="v">(v)</num><content> a working group or caucus organized to provide legislative services or other assistance to Members of Congress; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59227-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/4/D"><num value="D">(D)</num><content> any other legislative branch employee serving in a position described under section 109(13) of the Ethics in Government Act of 1978 (5 U.S.C. App.).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f59228-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/5"><num value="5" class="bold">(5)</num><heading class="bold"> Employee</heading><chapeau>The term “employee” means any individual who is an officer, employee, partner, director, or proprietor of a person or entity, but does not include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id70f59229-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/5/A"><num value="A">(A)</num><content> independent contractors; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id70f5922a-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/5/B"><num value="B">(B)</num><content> volunteers who receive no financial or other compensation from the person or entity for their services.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f5922b-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/6"><num value="6" class="bold">(6)</num><heading class="bold"> Foreign entity</heading><content><p style="-uslm-lc:I12" class="indent1">The term “foreign entity” means a foreign principal (as defined in section 1(b) of the Foreign Agents Registration Act of 1938 (<ref href="/us/usc/t22/s611/b">22 U.S.C. 611(b)</ref>).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f5922c-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/7"><num value="7" class="bold">(7)</num><heading class="bold"> Lobbying activities</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lobbying activities” means lobbying contacts and efforts in support of such contacts, including preparation and planning activities, research and other background work that is intended, at the time it is performed, for use in contacts, and coordination with the lobbying activities of others.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f5922d-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8"><num value="8" class="bold">(8)</num><heading class="bold"> Lobbying contact</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id70f5922e-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definition</heading><chapeau>The term “lobbying contact” means any oral or written communication (including an electronic communication) to a covered executive branch official or a covered legislative branch official that is made on behalf of a client with regard to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id70f5922f-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/A/i"><num value="i">(i)</num><content> the formulation, modification, or adoption of Federal legislation (including legislative proposals);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59230-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/A/ii"><num value="ii">(ii)</num><content> the formulation, modification, or adoption of a Federal rule, regulation, Executive order, or any other program, policy, or position of the United States Government;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59231-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/A/iii"><num value="iii">(iii)</num><content> the administration or execution of a Federal program or policy (including the negotiation, award, or administration of a Federal contract, grant, loan, permit, or license); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59232-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/A/iv"><num value="iv">(iv)</num><content> the nomination or confirmation of a person for a position subject to confirmation by the Senate.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id70f59233-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exceptions</heading><chapeau>The term “lobbying contact” does not include a communication that is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id70f59234-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/i"><num value="i">(i)</num><content> made by a public official acting in the public official’s official capacity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59235-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/ii"><num value="ii">(ii)</num><content> made by a representative of a media organization if the purpose of the communication is gathering and disseminating news and information to the public;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59236-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/iii"><num value="iii">(iii)</num><content> made in a speech, article, publication or other material that is distributed and made available to the public, or through radio, television, cable television, or other medium of mass communication;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59237-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/iv"><num value="iv">(iv)</num><content> made on behalf of a government of a foreign country or a foreign political party and disclosed under the Foreign Agents Registration Act of 1938 (<ref href="/us/usc/t22/s611">22 U.S.C. 611</ref> et seq.);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59238-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/v"><num value="v">(v)</num><content> a request for a meeting, a request for the status of an action, or any other similar administrative request, if the request does not include an attempt to influence a covered executive branch official or a covered legislative branch official;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59239-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/vi"><num value="vi">(vi)</num><content> made in the course of participation in an advisory committee subject to the Federal Advisory Committee Act;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923a-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/vii"><num value="vii">(vii)</num><content> testimony given before a committee, subcommittee, or task force of the Congress, or submitted for inclusion in the public record of a hearing conducted by such committee, subcommittee, or task force;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923b-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/viii"><num value="viii">(viii)</num><content> information provided in writing in response to an oral or written request by a covered executive branch official or a covered legislative branch official for specific information;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923c-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/ix"><num value="ix">(ix)</num><content> required by subpoena, civil investigative demand, or otherwise compelled by statute, regulation, or other action of the Congress or an agency, including any communication compelled by a Federal contract, grant, loan, permit, or license;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923d-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/x"><num value="x">(x)</num><content> made in response to a notice in the Federal Register, Commerce Business Daily, or other similar publication soliciting communications from the public and directed to the agency official specifically designated in the notice to receive such communications;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923e-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xi"><num value="xi">(xi)</num><content> not possible to report without disclosing information, the unauthorized disclosure of which is prohibited by law;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5923f-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xii"><num value="xii">(xii)</num><chapeau> made to an official in an agency with regard to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id70f59240-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xii/I"><num value="I">(I)</num><content> a judicial proceeding or a criminal or civil law enforcement inquiry, investigation, or proceeding; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id70f59241-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xii/II"><num value="II">(II)</num><content> a filing or proceeding that the Government is specifically required by statute or regulation to maintain or conduct on a confidential basis,</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> if that agency is charged with responsibility for such proceeding, inquiry, investigation, or filing;</continuation>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59242-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xiii"><num value="xiii">(xiii)</num><content> made in compliance with written agency procedures regarding an adjudication conducted by the agency under <ref href="/us/usc/t5/s554">section 554 of title 5</ref> or substantially similar provisions;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59243-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xiv"><num value="xiv">(xiv)</num><content> a written comment filed in the course of a public proceeding or any other communication that is made on the record in a public proceeding;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59244-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xv"><num value="xv">(xv)</num><content> a petition for agency action made in writing and required to be a matter of public record pursuant to established agency procedures;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59245-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xvi"><num value="xvi">(xvi)</num><chapeau> made on behalf of an individual with regard to that individual’s benefits, employment, or other personal matters involving only that individual, except that this clause does not apply to any communication with—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id70f59246-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xvi/I"><num value="I">(I)</num><content> a covered executive branch official, or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id70f59247-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xvi/II"><num value="II">(II)</num><content> a covered legislative branch official (other than the individual’s elected Members of Congress or employees who work under such Members’ direct supervision),</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> with respect to the formulation, modification, or adoption of private legislation for the relief of that individual;</continuation>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59248-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xvii"><num value="xvii">(xvii)</num><content> a disclosure by an individual that is protected under the amendments made by the Whistleblower Protection Act of 1989, under the Inspector General Act of 1978, or under another provision of law;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f59249-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xviii"><num value="xviii">(xviii)</num><chapeau> made by—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id70f5924a-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xviii/I"><num value="I">(I)</num><content> a church, its integrated auxiliary, or a convention or association of churches that is exempt from filing a Federal income tax return under paragraph 2(A)(i) of <ref href="/us/usc/t26/s6033/a">section 6033(a) of title 26</ref>, or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id70f5924b-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xviii/II"><num value="II">(II)</num><content> a religious order that is exempt from filing a Federal income tax return under paragraph (2)(A)(iii) of such section 6033(a); and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f5924c-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xix"><num value="xix">(xix)</num><chapeau> between—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id70f5924d-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xix/I"><num value="I">(I)</num><content> officials of a self-regulatory organization (as defined in section 3(a)(26) of the Securities Exchange Act [<ref href="/us/usc/t15/s78c/a/26">15 U.S.C. 78c(a)(26)</ref>]) that is registered with or established by the Securities and Exchange Commission as required by that Act [<ref href="/us/usc/t15/s78a">15 U.S.C. 78a</ref> et seq.] or a similar organization that is designated by or registered with the Commodities Future Trading Commission as provided under the Commodity Exchange Act [<ref href="/us/usc/t7/s1">7 U.S.C. 1</ref> et seq.]; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id70f5924e-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/8/B/xix/II"><num value="II">(II)</num><content> the Securities and Exchange Commission or the Commodities Future Trading Commission, respectively;</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> relating to the regulatory responsibilities of such organization under that Act.</continuation>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f8024f-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/9"><num value="9" class="bold">(9)</num><heading class="bold"> Lobbying firm</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lobbying firm” means a person or entity that has 1 or more employees who are lobbyists on behalf of a client other than that person or entity. The term also includes a self-employed individual who is a lobbyist.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f80250-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/10"><num value="10" class="bold">(10)</num><heading class="bold"> Lobbyist</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lobbyist” means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact, other than an individual whose lobbying activities constitute less than 20 percent of the time engaged in the services provided by such individual to that client over a 3-month period.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f80251-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/11"><num value="11" class="bold">(11)</num><heading class="bold"> Media organization</heading><content><p style="-uslm-lc:I12" class="indent1">The term “media organization” means a person or entity engaged in disseminating information to the general public through a newspaper, magazine, other publication, radio, television, cable television, or other medium of mass communication.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f80252-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/12"><num value="12" class="bold">(12)</num><heading class="bold"> Member of Congress</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Member of Congress” means a Senator or a Representative in, or Delegate or Resident Commissioner to, the Congress.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id70f80253-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/13"><num value="13" class="bold">(13)</num><heading class="bold"> Organization</heading><content><p style="-uslm-lc:I12" class="indent1">The term “organization” means a person or entity other than an individual.</p>

</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id70f80258-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/15/A/ii"><num value="ii">(ii)</num><content> a government-sponsored enterprise (as defined in <ref href="/us/usc/t2/s622/8">section 622(8) of this title</ref>);</content>

<clause style="-uslm-lc:I14" class="indent3" id="id70f8025b-88fa-11e3-9b98-afd9f114c249" identifier="/us/usc/t2/s1602/15/A/v"><num value="v">(v)</num><content> an agency of any State functioning as a student loan secondary market pursuant to <ref href="/us/usc/t20/s1085/d/1/F">section 1085(d)(1)(F) of title 20</ref>;</content>
