<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5d6f58c7-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a"><num value="1921a">§ 1921a.</num><heading> Sole and exclusive authority of Board and Chief to determine rates of pay</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6f58c8-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>The Capitol Police Board and the Chief of the Capitol Police shall have the sole and exclusive authority to determine the rates and amounts for each of the following for members of the Capitol Police:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58c9-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a/1"><num value="1">(1)</num><content> The rate of basic pay (including the rate of basic pay upon appointment), premium pay, specialty assignment and proficiency pay, and merit pay.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58ca-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a/2"><num value="2">(2)</num><content> The rate of cost-of-living adjustments, comparability adjustments, and locality adjustments.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58cb-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a/3"><num value="3">(3)</num><content> The amount for recruitment and relocation bonuses.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58cc-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a/4"><num value="4">(4)</num><content> The amount for retention allowances.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58cd-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/a/5"><num value="5">(5)</num><content> The amount for educational assistance payments.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6f58ce-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/b"><num value="b" class="bold">(b)</num><heading class="bold"> No review or appeal permitted</heading><content><p style="-uslm-lc:I11" class="indent0">The determination of a rate or amount described in subsection (a) may not be subject to review or appeal in any manner.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6f58cf-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Rule of construction</heading><chapeau>Nothing in this section may be construed to affect—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58d0-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/c/1"><num value="1">(1)</num><content> any authority provided under law for a committee of the House of Representatives or Senate, or any other entity of the legislative branch, to review or approve any determination of a rate or amount described in subsection (a);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58d1-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/c/2"><num value="2">(2)</num><content> any rate or amount described in subsection (a) which is established under law; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6f58d2-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/c/3"><num value="3">(3)</num><content> the terms of any collective bargaining agreement.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6f58d3-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1921a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I11" class="indent0">This section shall apply with respect to fiscal year 2005 and each succeeding fiscal year.</p>
