<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1b9c0609-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199"><num value="199">§ 199.</num><heading> Member of commission, board, etc., appointed by President pro tempore of Senate; recommendation process; applicability</heading><subsection style="-uslm-lc:I11" class="indent0" id="id1b9c060a-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199/a"><num value="a">(a)</num><chapeau> Any provision of law which provides that any member of a commission, board, committee, advisory group, or similar body is to be appointed by the President pro tempore of the Senate shall be construed to require that the appointment be made—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1b9c060b-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199/a/1"><num value="1">(1)</num><content> upon recommendation of the Majority Leader of the Senate, if such provision of law specifies that the appointment is to be made on the basis of the appointee’s affiliation with the majority political party,</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id1b9c060c-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199/a/2"><num value="2">(2)</num><content> upon the recommendation of the Minority Leader of the Senate, if such provision of law specifies that the appointment is to be made on the basis of the appointee’s affiliation with the minority party, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b9c060d-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199/a/3"><num value="3">(3)</num><content> upon the joint recommendation of the Majority Leader of the Senate and the Minority Leader of the Senate, if such provision of law does not specify that the appointment is to be made on the appointee’s affiliation with the majority or minority political party.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1b9c060e-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s199/b"><num value="b">(b)</num><content> The provisions of subsection (a) of this section shall be applicable in the case of appointments made after <date date="1980-12-22">December 22, 1980</date>, pursuant to provisions of law enacted on, before, and after, <date date="1980-12-22">December 22, 1980</date>.</content>
