<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id43803c70-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168"><num value="2168">§ 2168.</num><heading> Memorandum of understanding for provision of services of the United States Capitol telephone exchange for the House</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c71-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Chief Administrative Officer of the House of Representatives and the Sergeant at Arms and Doorkeeper of the Senate may enter into a memorandum of understanding under which the Sergeant at Arms and Doorkeeper shall provide all services of the United States Capitol telephone exchange for the House of Representatives, in accordance with such terms and conditions as may be provided in the memorandum of understanding.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c72-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/b"><num value="b" class="bold">(b)</num><heading class="bold"> Transfer of positions and personnel</heading><chapeau style="-uslm-lc:I11" class="indent0">For any period during which a memorandum of understanding is in effect pursuant to this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id43803c73-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/b/1"><num value="1">(1)</num><content> all positions in the United States Capitol telephone exchange for which the employing authority is the Chief Administrative Officer shall be transferred to the Sergeant at Arms and Doorkeeper;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id43803c74-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/b/2"><num value="2">(2)</num><content> all employees in the United States Capitol telephone exchange for whom the employing authority is the Chief Administrative Officer shall be transferred to, and appointed by, the Sergeant at Arms and Doorkeeper; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id43803c75-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/b/3"><num value="3">(3)</num><content> the Sergeant at Arms and Doorkeeper shall serve as the employing authority for all personnel of the United States Capitol telephone exchange.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c76-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/c"><num value="c" class="bold">(c)</num><heading class="bold"> Pay and leave accrual</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out a memorandum of understanding pursuant to this section, the Sergeant at Arms and Doorkeeper shall ensure that, with respect to any employee of the United States Capitol telephone exchange whose employing authority prior to the effective date of the memorandum was the Chief Administrative Officer—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id43803c77-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/c/1"><num value="1">(1)</num><chapeau> the rate of pay and leave accrual for the employee shall not be less than the employee’s rate of pay and leave accrual for the most recent pay period prior to such date, unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id43803c78-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/c/1/A"><num value="A">(A)</num><content> the employee does not remain in the same position with the exchange; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id43803c79-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/c/1/B"><num value="B">(B)</num><content> the rate of pay or leave accrual is reduced for cause; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id43803c7a-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/c/2"><num value="2">(2)</num><content> any leave accrued by the employee that remains unused as of such date shall be transferred to the employee and made available for the employee to use under the same terms and conditions that applied to the use of the leave prior to such date.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c7b-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/d"><num value="d" class="bold">(d)</num><heading class="bold"> Omitted</heading><content/>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c7c-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e"><num value="e" class="bold">(e)</num><heading class="bold"> Reimbursement of expenses by House</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id43803c7d-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e/1"><num value="1">(1)</num><content> A memorandum of understanding under this section may include a provision requiring the reimbursement by the House of Representatives during a fiscal year (paid out of the applicable accounts of the House) of the expenses incurred by the Sergeant at Arms and Doorkeeper during the fiscal year in carrying out the memorandum with respect to the employees of the United States Capitol telephone exchange whose employing authority prior to the effective date of the memorandum was the Chief Administrative Officer.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id43803c7e-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e/2"><num value="2">(2)</num><chapeau> Any reimbursement made pursuant to this subsection—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id43803c7f-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e/2/A"><num value="A">(A)</num><content> in the case of a reimbursement for salaries or agency contributions and related expenses, shall be deposited in the account under the heading “<inline class="small-caps">Office of the sergeant at arms and doorkeeper</inline>” or “<inline class="small-caps">agency contributions and related expenses</inline>”, under the heading “<inline class="small-caps">Salaries, Officers and Employees</inline>”; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id43803c80-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e/2/B"><num value="B">(B)</num><content> in the case of a reimbursement for expenses, shall be deposited in the account under the heading “<inline class="small-caps">sergeant at arms and doorkeeper of the senate</inline>” under the heading “<inline class="small-caps">Contingent Expenses of the Senate</inline>”.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id43803c81-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/e/3"><num value="3">(3)</num><content> Any funds deposited under paragraph (2) shall be available in like manner and for the same purposes as are other funds in the account to which the funds were deposited.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43803c82-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s2168/f"><num value="f" class="bold">(f)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I11" class="indent0">This section and the amendment made by this section shall apply with respect to fiscal year 2005 and each succeeding fiscal year.</p>
