<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id42eed16c-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b"><num value="288b">§ 288b.</num><heading> Requirements for authorizing representation activity</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id42eed16d-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Direction of Joint Leadership Group or Senate resolution</heading><content><p style="-uslm-lc:I11" class="indent0">The Counsel shall defend the Senate or a committee, subcommittee, Member, officer, or employee of the Senate under <ref href="/us/usc/t2/s288c">section 288c of this title</ref> only when directed to do so by two-thirds of the Members of the Joint Leadership Group or by the adoption of a resolution by the Senate.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id42eed16e-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Civil action to enforce subpena</heading><content><p style="-uslm-lc:I11" class="indent0">The Counsel shall bring a civil action to enforce a subpena of the Senate or a committee or subcommittee of the Senate under <ref href="/us/usc/t2/s288d">section 288d of this title</ref> only when directed to do so by the adoption of a resolution by the Senate.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id42eed16f-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Intervention or appearance</heading><content><p style="-uslm-lc:I11" class="indent0">The Counsel shall intervene or appear as amicus curiae under <ref href="/us/usc/t2/s288e">section 288e of this title</ref> only when directed to do so by a resolution adopted by the Senate when such intervention or appearance is to be made in the name of the Senate or in the name of an officer, committee, subcommittee, or chairman of a committee or subcommittee of the Senate.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id42eed170-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Immunity proceedings</heading><chapeau style="-uslm-lc:I11" class="indent0">The Counsel shall serve as the duly authorized representative in obtaining an order granting immunity under <ref href="/us/usc/t2/s288f">section 288f of this title</ref> of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id42eed171-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/d/1"><num value="1">(1)</num><content> the Senate when directed to do so by an affirmative vote of a majority of the Members present of the Senate; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42eed172-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/d/2"><num value="2">(2)</num><content> a committee or subcommittee of the Senate when directed to do so by an affirmative vote of two-thirds of the members of the full committee.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id42eed173-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s288b/e"><num value="e" class="bold">(e)</num><heading class="bold"> Resolution recommendations</heading><content><p style="-uslm-lc:I11" class="indent0">The Office shall make no recommendation with respect to the consideration of a resolution under this section.</p>
