<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id32d5df0f-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d"><num value="288d">§ 288d.</num><heading> Enforcement of Senate subpena or order</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df10-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Institution of civil actions</heading><content><p style="-uslm-lc:I11" class="indent0">When directed to do so pursuant to <ref href="/us/usc/t2/s288b/b">section 288b(b) of this title</ref>, the Counsel shall bring a civil action under any statute conferring jurisdiction on any court of the United States (including <ref href="/us/usc/t28/s1365">section 1365 of title 28</ref>), to enforce, to secure a declaratory judgment concerning the validity of, or to prevent a threatened failure or refusal to comply with, any subpena or order issued by the Senate or a committee or a subcommittee of the Senate authorized to issue a subpena or order.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df11-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Actions in name of committees and subcommittees</heading><content><p style="-uslm-lc:I11" class="indent0">Any directive to the Counsel to bring a civil action pursuant to subsection (a) in the name of a committee or subcommittee of the Senate shall, for such committee or subcommittee, constitute authorization to bring such action within the meaning of any statute conferring jurisdiction on any court of the United States.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df12-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Consideration of resolutions authorizing actions</heading><chapeau>It shall not be in order in the Senate to consider a resolution to direct the Counsel to bring a civil action pursuant to subsection (a) in the name of a committee or subcommittee unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df13-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/1"><num value="1">(1)</num><content> such resolution is reported by a majority of the members voting, a majority being present, of such committee or committee of which such subcommittee is a subcommittee, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df14-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/2"><num value="2">(2)</num><chapeau> the report filed by such committee or committee of which such subcommittee is a subcommittee contains a statement of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id32d5df15-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/2/A"><num value="A">(A)</num><content> the procedure followed in issuing such subpena;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id32d5df16-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/2/B"><num value="B">(B)</num><content> the extent to which the party sub­penaed has complied with such subpena;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id32d5df17-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/2/C"><num value="C">(C)</num><content> any objections or privileges raised by the subpenaed party; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id32d5df18-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/c/2/D"><num value="D">(D)</num><content> the comparative effectiveness of bringing a civil action under this section, certification of a criminal action for contempt of Congress, and initiating a contempt proceeding before the Senate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df19-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Rules of Senate</heading><chapeau>The provisions of subsection (c) are enacted—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df1a-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/d/1"><num value="1">(1)</num><content> as an exercise of the rulemaking power of the Senate, and, as such, they shall be considered as part of the rules of the Senate, and such rules shall supersede any other rule of the Senate only to the extent that rule is inconsistent therewith; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df1b-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/d/2"><num value="2">(2)</num><content> with full recognition of the constitutional right of the Senate to change such rules (so far as relating to the procedure in the Senate) at any time, in the same manner, and to the same extent as in the case of any other rule of the Senate.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df1c-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Committee reports</heading><content><p style="-uslm-lc:I11" class="indent0">A report filed pursuant to subsection (c)(2) shall not be receivable in any court of law to the extent such report is in compliance with such subsection.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id32d5df1e-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/g"><num value="g" class="bold">(g)</num><heading class="bold"> Certification of failure to testify; contempt</heading><chapeau>Nothing in this section shall limit the discretion of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df1f-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/g/1"><num value="1">(1)</num><content> the President pro tempore of the Senate in certifying to the United States Attorney for the District of Columbia any matter pursuant to <ref href="/us/usc/t2/s194">section 194 of this title</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id32d5df20-c209-11e6-a672-9c11a185633e" identifier="/us/usc/t2/s288d/g/2"><num value="2">(2)</num><content> the Senate to hold any individual or entity in contempt of the Senate.</content>
