value=\"29d\">§ 29d.</num><heading> Committee on Standards of Official Conduct of House of Representatives</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c44e-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Omitted</heading><content/>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c44f-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Committee composition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The respective party caucus or conference of the House of Representatives shall each nominate to the House of Representatives at the beginning of each Congress 7 members to serve on the Committee on Standards of Official Conduct.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c450-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Investigative subcommittees</heading><chapeau>The Committee on Standards of Official Conduct shall adopt rules providing—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c451-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/c/1\"><num value=\"1\">(1)</num><content> for the establishment of a 4 or 6-member investigative subcommittee (with equal representation from the majority and minority parties) whenever the committee votes to undertake any investigation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c452-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/c/2\"><num value=\"2\">(2)</num><content> that the senior majority and minority members on an investigative subcommittee shall serve as the chairman and ranking minority member of the subcommittee; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c453-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/c/3\"><num value=\"3\">(3)</num><content> that the chairman and ranking minority member of the full committee may only serve as non-voting, ex officio members on an investigative subcommittee.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Clause 5(d) of rule XI <ref class=\"footnoteRef\" idref=\"fn002002\">1</ref><note type=\"footnote\" id=\"fn002002\"><num>1</num> See References in Text note below.</note> of the Rules of the House of Representatives shall not apply to any investigative subcommittee.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c454-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Adjudicatory subcommittees</heading><chapeau>The Committee on Standards of Official Conduct shall adopt rules providing—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c455-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d/1\"><num value=\"1\">(1)</num><content> that upon the completion of an investigation, an investigative subcommittee shall report its findings and recommendations to the committee;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c456-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d/2\"><num value=\"2\">(2)</num><content> that, if an investigative subcommittee by majority vote of its membership adopts a statement of alleged violation, the remaining members of the committee shall comprise an adjudicatory subcommittee to hold a disciplinary hearing on the violation alleged in the statement;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c457-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d/3\"><num value=\"3\">(3)</num><content> that any statement of alleged violation and any written response thereto shall be made public at the first meeting or hearing on the matter which is open to the public after the respondent has been given full opportunity to respond to the statement in accordance with committee rules, but, if no public hearing or meeting is held on the matter, the statement of alleged violation and any written response thereto shall be included in the committee’s final report to the House of Representatives as required by clause 4(e)(1)(B) of rule X <sup>1</sup> of the Rules of the House of Representatives;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c458-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d/4\"><num value=\"4\">(4)</num><content> that a quorum for an adjudicatory subcommittee for the purpose of taking testimony and conducting any business shall consist of a majority of the membership of the subcommittee plus one; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c459-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/d/5\"><num value=\"5\">(5)</num><content> that an adjudicatory subcommittee shall determine, after receiving evidence, whether the counts in the statement have been proved and shall report its findings to the committee.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Clause 5(d) of rule XI <sup>1</sup> of the Rules of the House of Representatives shall not apply to any adjudicatory subcommittee.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c45a-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> to (h) Omitted</heading><content/>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c45b-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Advice and education</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id17a4c45c-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/1\"><num value=\"1\">(1)</num><content> The Committee on Standards of Official Conduct shall establish within the committee an Office on Advice and Education (hereinafter in this subsection referred to as the “Office”) under the supervision of the chairman.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id17a4c45d-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/2\"><num value=\"2\">(2)</num><content> The Office shall be headed by a director who shall be appointed by the chairman, in consultation with the ranking minority member, and shall be comprised of such staff as the chairman determines is necessary to carry out the responsibilities of the Office.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id17a4c45e-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/3\"><num value=\"3\">(3)</num><chapeau> The primary responsibilities of the Office shall include:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c45f-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/3/A\"><num value=\"A\">(A)</num><content> Providing information and guidance to Members, officers and employees of the House regarding any laws, rules, regulations, and other standards of conduct applicable to such individuals in their official capacities, and any interpretations and advisory opinions of the committee.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c460-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/3/B\"><num value=\"B\">(B)</num><content> Submitting to the chairman and ranking minority member of the committee any written request from any such Member, officer or employee for an interpretation of applicable laws, rules, regulations, or other standards of conduct, together with any recommendations thereon.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c461-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/3/C\"><num value=\"C\">(C)</num><content> Recommending to the committee for its consideration formal advisory opinions of general applicability.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id17a4c462-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/3/D\"><num value=\"D\">(D)</num><content> Developing and carrying out, subject to the approval of the chairman, periodic educational briefings for Members, officers and employees of the House on those laws, rules, regulations, or other standards of conduct applicable to them.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id17a4c463-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/i/4\"><num value=\"4\">(4)</num><content> No information provided to the Committee on Standards of Official Conduct by a Member, officer or employee of the House of Representatives when seeking advice regarding prospective conduct of such Member, officer or employee may be used as the basis for initiating an investigation under clause 4(e)(1)(B) of rule X <sup>1</sup> of the Rules of the House of Representatives, if such Member, officer or employee acts in accordance with the written advice of the committee.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id17a4c464-425e-11e3-8d4d-f11243cf9240\" identifier=\"/us/usc/t2/s29d/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Effective date</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This section shall take effect immediately before noon <date date=\"1991-01-03\">January 3, 1991</date>, except that subsections (g), (h), and (i) shall take effect on <date date=\"1990-01-01\">January 1,
