<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1897b043-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d"><num value="437d">§ 437d.</num><heading> Powers of Commission</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1897b044-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Specific authorities</heading><chapeau>The Commission has the power—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1897b045-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/1"><num value="1">(1)</num><content> to require by special or general orders, any person to submit, under oath, such written reports and answers to questions as the Commission may prescribe;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b046-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/2"><num value="2">(2)</num><content> to administer oaths or affirmations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b047-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/3"><num value="3">(3)</num><content> to require by subpena, signed by the chairman or the vice chairman, the attendance and testimony of witnesses and the production of all documentary evidence relating to the execution of its duties;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b048-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/4"><num value="4">(4)</num><content> in any proceeding or investigation, to order testimony to be taken by deposition before any person who is designated by the Commission and has the power to administer oaths and, in such instances, to compel testimony and the production of evidence in the same manner as authorized under paragraph (3);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b049-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/5"><num value="5">(5)</num><content> to pay witnesses the same fees and mileage as are paid in like circumstances in the courts of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b04a-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/6"><num value="6">(6)</num><content> to initiate (through civil actions for injunctive, declaratory, or other appropriate relief), defend (in the case of any civil action brought under <ref href="/us/usc/t2/s437g/a/8">section 437g(a)(8) of this title</ref>) or appeal any civil action in the name of the Commission to enforce the provisions of this Act and chapter 95 and chapter 96 of title 26, through its general counsel;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b04b-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/7"><num value="7">(7)</num><content> to render advisory opinions under <ref href="/us/usc/t2/s437f">section 437f of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b04c-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/8"><num value="8">(8)</num><content> to develop such prescribed forms and to make, amend, and repeal such rules, pursuant to the provisions of chapter 5 of title 5, as are necessary to carry out the provisions of this Act and chapter 95 and chapter 96 of title 26; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1897b04d-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/a/9"><num value="9">(9)</num><content> to conduct investigations and hearings expeditiously, to encourage voluntary compliance, and to report apparent violations to the appropriate law enforcement authorities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1897b04e-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Judicial orders for compliance with subpenas and orders of Commission; contempt of court</heading><content><p style="-uslm-lc:I11" class="indent0">Upon petition by the Commission, any United States district court within the jurisdiction of which any inquiry is being carried on may, in case of refusal to obey a subpena or order of the Commission issued under subsection (a) of this section, issue an order requiring compliance. Any failure to obey the order of the court may be punished by the court as a contempt thereof.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1897b04f-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Civil liability for disclosure of information</heading><content><p style="-uslm-lc:I11" class="indent0">No person shall be subject to civil liability to any person (other than the Commission or the United States) for disclosing information at the request of the Commission.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1897b050-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Concurrent transmissions to Congress or Member of budget estimates, etc.; prior submission of legislative recommendations, testimony, or comments on legislation</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id1897b051-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/d/1"><num value="1">(1)</num><content> Whenever the Commission submits any budget estimate or request to the President or the Office of Management and Budget, it shall concurrently transmit a copy of such estimate or request to the Congress.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id1897b052-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/d/2"><num value="2">(2)</num><content> Whenever the Commission submits any legislative recommendation, or testimony, or comments on legislation, requested by the Congress or by any Member of the Congress, to the President or the Office of Management and Budget, it shall concurrently transmit a copy thereof to the Congress or to the Member requesting the same. No officer or agency of the United States shall have any authority to require the Commission to submit its legislative recommendations, testimony, or comments on legislation, to any office or agency of the United States for approval, comments, or review, prior to the submission of such recommendations, testimony, or comments to the Congress.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1897b053-425e-11e3-8d4d-f11243cf9240" identifier="/us/usc/t2/s437d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Exclusive civil remedy for enforcement</heading><content><p style="-uslm-lc:I11" class="indent0">Except as provided in <ref href="/us/usc/t2/s437g/a/8">section 437g(a)(8) of this title</ref>, the power of the Commission to initiate civil actions under subsection (a)(6) of this section shall be the exclusive civil remedy for the enforcement of the provisions of this Act.</p>
