<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5d89976f-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537"><num value="4537">§ 4537.</num><heading> Lump sum payment for accrued annual leave of House employees</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d899770-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a"><num value="a" class="bold">(a)</num><heading class="bold"> Approval; amount; source of payments</heading><chapeau>Upon the approval of the appropriate employing authority, an employee of the House of Representatives may be paid a lump sum for the accrued annual leave of the employee or for any other purpose. The lump sum—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5d899771-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/1"><num value="1">(1)</num><chapeau> shall be paid in an amount not more than the lesser of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5d899772-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/1/A"><num value="A">(A)</num><content> the amount of the monthly pay of the employee, as determined by the Chief Administrative Officer of the House of Representatives; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5d899773-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/1/B"><num value="B">(B)</num><content> in the case of a lump sum payment for the accrued annual leave of the employee, the amount equal to the monthly pay of the employee, as determined by the Chief Administrative Officer of the House of Representatives, divided by 30, and multiplied by the number of days of the accrued annual leave of the employee;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d899774-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/2"><num value="2">(2)</num><chapeau> shall be paid—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5d899775-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/2/A"><num value="A">(A)</num><content> for clerk hire employees, from the clerk hire allowance of the Member;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5d899776-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/2/B"><num value="B">(B)</num><content> for committee employees, from amounts appropriated for committees; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5d899777-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/2/C"><num value="C">(C)</num><content> for other employees, from amounts appropriated to the employing authority; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d899778-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/a/3"><num value="3">(3)</num><content> shall be based on the rate of pay in effect with respect to the employee on the last day of employment of the employee.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d899779-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/b"><num value="b" class="bold">(b)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">The Committee on House Oversight shall have authority to prescribe regulations to carry out this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d89977a-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s4537/c"><num value="c" class="bold">(c)</num><heading class="bold"> “Employee of the House of Representatives” defined</heading><content><p style="-uslm-lc:I11" class="indent0">As used in this section, the term “employee of the House of Representatives” means an employee whose pay is disbursed by the Clerk of the House of Representatives or the Chief Administrative Officer of the House of Representatives, as applicable, except that such term does not include a uniformed or civilian support employee under the Capitol Police Board.</p>
