<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idef54a758-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575"><num value="4575">§ 4575.</num><heading> Gross rate of compensation of employees paid by Secretary of Senate</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idef54a759-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/a"><num value="a" class="bold">(a)</num><heading class="bold"> Annual rate; certification</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idef54a75a-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/a/1"><num value="1">(1)</num><content> Whenever the rate of compensation of any employee whose compensation is disbursed by the Secretary of the Senate is fixed or adjusted on or after <date date="1980-10-01">October 1, 1980</date>, such rate as so fixed or adjusted shall be at a single whole dollar per annum gross rate and may not include a fractional part of a dollar.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idef54a75b-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/a/2"><num value="2">(2)</num><content> New or changed rates of compensation (other than changes in rates which are made by law) of any such employee (other than an employee who is an elected officer of the Senate) shall be certified in writing to the Disbursing Office of the Senate (and, for purposes of this paragraph, a new rate of compensation refers to compensation in the case of an appointment, transfer from one Senate appointing authority to another, or promotion by an appointing authority to a position the compensation for which is fixed by law). In the case of an appointment or other new rate of compensation, the certification must be received by such office on or before the day the rate of new compensation is to become effective. In any other case, the changed rate of compensation shall take effect on the first day of the month in which such certification is received (if such certification is received within the first ten days of such month), on the first day of the month after the month in which such certification is received (if the day on which such certification is received is after the twenty-fifth day of the month in which it is received), and on the sixteenth day of the month in which such certification is received (if such certification is received after the tenth day and before the twenty-sixth day of such month). Notwithstanding the preceding sentence, if the certification for a changed rate of compensation for an employee specifies an effective date of such change, such change shall become effective on the date so specified, but only if the date so specified is the first or sixteenth day of a month and is after the effective date prescribed in the preceding sentence; and, notwithstanding such sentence and the preceding provisions of this sentence, any changed rate of compensation for a new employee or an employee transferred from one appointing authority to another shall take effect on the date of such employee’s appointment or transfer (as the case may be) if such date is later than the effective date for such changed rate of compensation as prescribed by such sentence.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idef54cd6c-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/b"><num value="b" class="bold">(b)</num><heading class="bold"> Conversion; increase in compensation</heading><content><p style="-uslm-lc:I11" class="indent0">The rate of compensation of each employee whose compensation is disbursed by the Secretary of the Senate which was fixed before <date date="1967-08-01">August 1, 1967</date>, at a basic rate with respect to which additional compensation is payable by law shall be converted as of such date to the lowest per annum gross rate which is a multiple of $180 and which is not less than the aggregate rate of compensation (basic compensation plus additional compensation provided by law) which such employee was receiving immediately prior to such date. Any increments of longevity compensation to which an employee became entitled prior to <date date="1967-08-01">August 1, 1967</date>, under <ref href="/us/usc/t2/s4507/b">section 4507(b) of this title</ref> shall be excluded in converting such employee’s rate of compensation under this subsection, but such employee’s rate of gross compensation shall be increased by $540 (which shall be considered to be an increase under <ref href="/us/usc/t2/s4507/b">section 4507(b) of this title</ref>) for each such increment.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idef54cd6d-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reference in other provisions to basic rates and additional compensation as reference to per annum gross rate</heading><content><p style="-uslm-lc:I11" class="indent0">In any case in which the rate of compensation of any employee or position, or class of employees or positions, the compensation for which is disbursed by the Secretary of the Senate, or any maximum or minimum rate with respect to any such employee, position, or class, is referred to in or provided by statute or Senate resolution, and the rate so referred to or provided is a basic rate with respect to which additional compensation is provided by law, such statutory provision or resolution shall be deemed to refer, in lieu of such basic rate, to the per annum gross rate which an employee receiving such basic rate immediately prior to <date date="1967-08-01">August 1, 1967</date>, would receive (without regard to such statutory provision or resolution) under subsection (b) on and after such date.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idef54cd6e-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d"><num value="d" class="bold">(d)</num><heading class="bold"> Compensation of employees in office of Senator; limitation; titles of positions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idef54cd6f-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idef54cd70-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/A"><num value="A">(A)</num><chapeau> Except as is otherwise provided in subparagraphs (B) and (C), the aggregate of gross compensation paid employees in the office of a Senator shall not exceed during each fiscal year the following:</chapeau><chapeau style="-uslm-lc:I12" role="listItem" class="indent1">$1,518,333 if the population of the State is less than 5,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" role="listItem" class="indent1">$1,573,297 if such population is 5,000,000 but less than 6,000,000;</chapeau>

<chapeau style="-uslm-lc:I12" class="indent1">$1,738,197 if such population is 8,000,000 but less than 9,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$1,793,161 if such population is 9,000,000 but less than 10,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$1,848,130 if such population is 10,000,000 but less than 11,000,000;</chapeau>

<chapeau style="-uslm-lc:I12" class="indent1">$2,303,224 if such population is 19,000,000 but less than 20,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,338,391 if such population is 20,000,000 but less than 21,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,373,558 if such population is 21,000,000 but less than 22,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,408,725 if such population is 22,000,000 but less than 23,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,443,891 if such population is 23,000,000 but less than 24,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,479,054 if such population is 24,000,000 but less than 25,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,514,218 if such population is 25,000,000 but less than 26,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,549,387 if such population is 26,000,000 but less than 27,000,000;</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,584,552 if such population is 27,000,000 but less than 28,000,000; and</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">$2,619,720 if such population is 28,000,000 or more.</chapeau>
<continuation style="-uslm-lc:I11" class="indent0">For any fiscal year, the population of a State shall be deemed to be whichever of the following is the higher:</continuation>
<subclause style="-uslm-lc:I12" class="indent1" id="idef54f481-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/A/I"><num value="I">(I)</num><content> the population of such State (as determined for purposes of this paragraph) for the preceding fiscal year; or</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="idef54f482-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/A/II"><num value="II">(II)</num><content> the population of such State as of the first day of such fiscal year, as determined by the latest census (provisional or otherwise) conducted prior to such first day by the Bureau of the Census within the Department of Commerce.</content>
</subclause>

<continuation style="-uslm-lc:I11" class="indent0">If the population of any State, as determined under the preceding sentence, is not evenly divisible by 1,000,000, the population of such State shall be deemed to be increased to the next higher multiple of 1,000,000.</continuation>

<continuation style="-uslm-lc:I11" class="indent0">If, for any period after a fiscal year has begun, the census figures of the most recent census conducted prior to the first day of such year have not been officially released, then, for such period, in the administration of this paragraph, it shall be assumed that the population of each State is the same as such State’s population (as determined for purposes of this paragraph) for the preceding fiscal year.</continuation>

<continuation style="-uslm-lc:I11" class="indent0">In the event that the term of office of a Senator begins after the first month of a fiscal year or ends (except by reason of death, resignation, or expulsion) before the last month of a fiscal year, the aggregate amount available for gross compensation of employees in the office of such Senator for such year shall be the applicable amount contained in the preceding table, divided by 12, and multiplied by the number of months in such year which are included in the Senator’s term of office, counting any fraction of a month as a full month.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idef54f483-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/B"><num value="B">(B)</num><chapeau> In the case of gross compensation paid to employees in the office of a Senator for the period commencing <date date="1988-01-01">January 1, 1988</date>, and ending <date date="1988-09-30">September 30, 1988</date>, the total of—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idef54f484-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/B/i"><num value="i">(i)</num><content> the aggregate amount of gross compensation which is paid to employees in the office of such Senator for such period, plus</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idef54f485-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/B/ii"><num value="ii">(ii)</num><content> the expenses paid to or on behalf of such Senator under authority of <ref href="/us/usc/t2/s6314">section 6314 of this title</ref> (as determined after application of subsection (b) of such section, but without regard to paragraph (2)(A)(iv) thereof),</content>
</clause>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall not exceed the aggregate of—</continuation>
<clause style="-uslm-lc:I12" class="indent1" id="idef54f486-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/B/iii"><num value="iii">(iii)</num><content> subject to the next sentence, the amount by which (I) the aggregate of the gross compensation which may be paid to employees in the office of such Senator for the fiscal year ending <date date="1988-09-30">September 30, 1988</date>, as determined under this subsection (but without regard to this subparagraph), exceeds (II) the aggregate amount of gross compensation which is paid to employees in the office of such Senator for that part of such fiscal year which precedes <date date="1988-01-01">January 1, 1988</date>, plus</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idef54f487-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/B/iv"><num value="iv">(iv)</num><content> the amount described in <ref href="/us/usc/t2/s6314/b/2/A/iii">section 6314(b)(2)(A)(iii) of this title</ref>.</content>
</clause>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">In the event that the term of office of a Senator begins after the first month of the period which commences <date date="1988-01-01">January 1, 1988</date>, and ends <date date="1988-09-30">September 30, 1988</date>, or ends (except by reason of death, resignation, or expulsion) before the last month of such period, the amount computed pursuant to clause (iii) of this subparagraph (but before application of this sentence) shall be recalculated as follows: such amount, as so computed, shall be divided by 9, and multiplied by the number of months in such period which are included in the Senator’s term of office, counting any fraction of a month as a full month.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idef551b98-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/C"><num value="C">(C)</num><chapeau> In the case of gross compensation paid to employees in the office of a Senator for the fiscal year beginning <date date="1988-10-01">October 1, 1988</date>, or any fiscal year thereafter, the total of—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idef551b99-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/C/i"><num value="i">(i)</num><content> the aggregate amount of gross compensation which is paid to employees in the office of such Senator for such year, plus</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idef551b9a-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/C/ii"><num value="ii">(ii)</num><content> the expenses paid to or on behalf of such Senator under authority of <ref href="/us/usc/t2/s6314">section 6314 of this title</ref> (as determined after application of subsection (b) of such section, but without regard to paragraph (3)(A)(ii) and (iv) thereof),</content>
</clause>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall not exceed the aggregate of—</continuation>
<clause style="-uslm-lc:I12" class="indent1" id="idef551b9b-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/C/iii"><num value="iii">(iii)</num><content> the amount determined under subparagraph (A) for such year, plus</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idef551b9c-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/1/C/iv"><num value="iv">(iv)</num><content> the amount described in <ref href="/us/usc/t2/s6314/b/3">section 6314(b)(3) of this title</ref> (as determined without regard to subparagraph (A)(ii) and (iv) thereof).</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="idef551b9d-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/d/2"><num value="2">(2)</num><content> Within the limits prescribed by paragraph (1) of this subsection, Senators may fix the number and the rates of compensation of employees in their respective offices. The salary of an employee in a Senator’s office shall not be fixed under this paragraph at a rate less than $2,677 or in excess of $169,459 per annum. A Senator may establish such titles for positions in his office as he may desire to designate, by written notification to the disbursing office of the Senate.</content>
</paragraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="idef551ba0-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idef551ba1-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A"><num value="A">(A)</num><chapeau> In this paragraph—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idef551ba2-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A/i"><num value="i">(i)</num><chapeau> the term “committee of the Senate” means—</chapeau><subclause style="-uslm-lc:I13" class="indent2" id="idef551ba3-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A/i/I"><num value="I">(I)</num><content> any standing committee (including the majority and minority policy committees) of the Senate;</content>

<subclause style="-uslm-lc:I13" class="indent2" id="idef551ba4-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A/i/II"><num value="II">(II)</num><content> any select committee (including the conference majority and conference minority of the Senate); or</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="idef551ba5-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A/i/III"><num value="III">(III)</num><content> any joint committee the expenses of which are paid from the contingent fund of the Senate; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idef551ba6-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/A/ii"><num value="ii">(ii)</num><content> an employee of a subcommittee shall be considered to be an employee of the full committee.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idef551ba7-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/e/3/B"><num value="B">(B)</num><content> Subject to adjustment as provided by law, no employee of a committee of the Senate shall be paid at a per annum gross rate in excess of $171,315.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idef551ba8-4154-11e7-a37d-c12ca70cf29d" identifier="/us/usc/t2/s4575/f"><num value="f" class="bold">(f)</num><heading class="bold"> General limitation</heading><content><p style="-uslm-lc:I11" class="indent0">No officer or employee whose compensation is disbursed by the Secretary of the Senate shall be paid gross compensation at a rate less than $2,677 or in excess of $169,459 unless expressly authorized by law. The limitation on the minimum rate of gross compensation under this subsection shall not apply to any member or civilian employee of the Capitol Police whose compensation is disbursed by the Secretary of the Senate.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>An allowance under this section may not exceed 25 percent of the basic pay of an employee, determined without regard to this section.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Basic Pay Treatment</inline>.—</heading><content>An allowance under this section shall be treated as part of the basic pay of an employee.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> Payment.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Aggregate gross compensation</inline>.—</heading><content>The amount of any allowance under this section shall not be taken into account for determining the amount of aggregate gross compensation in the table under section 105(d)(1)(A) of the Legislative Branch Appropriations [Appropriation] Act, 1968 (<ref href="/us/usc/t2/s61–1/d/1/A">2 U.S.C. 61–1(d)(1)(A)</ref>) [now <ref href="/us/usc/t2/s4575/d/1/A">2 U.S.C. 4575(d)(1)(A)</ref>].</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><content> Notwithstanding the second proviso in the paragraph relating to the authority of Senators to rearrange the basic salaries of employees in their respective offices, which appears in the Legislative Branch Appropriation Act, 1947, as amended (2 U. S. C. 60f) [repealed], but subject to the limitations contained in paragraph (3) of this subsection, during the period beginning on the effective date of this subsection and ending on the last day of the first pay period which begins after the date of enactment of this Act [<date date="1955-06-28">June 28, 1955</date>] (A) the compensation of the administrative assistant in the office of each Senator may be fixed at a basic rate which together with additional compensation authorized by law will not exceed the maximum rate authorized by section 2 (b) of the Act of <date date="1951-10-24">October 24, 1951</date> (Public Law 201, Eighty-second Congress), as amended [former <ref href="/us/usc/t2/s60e–6/b">section 60e–6(b) of this title</ref>], (B) the compensation of one employee other than the administrative assistant in the office of each Senator may be fixed at a basic rate not to exceed $10,260 per annum, and (C) the compensation of any other employee in the office of a Senator may be fixed at a basic rate not to exceed $6,420 per annum.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><content> Notwithstanding the third proviso in such paragraph [this section], any increase in the compensation of an employee in a Senator’s office shall take effect on the effective date of this subsection or on the date such employee became employed, whichever is later, if (A) the certification filed by such Senator under such proviso so provides, (B) such certification is filed in the disbursing office of the Senate not later than fifteen days following the date of enactment of this Act [<date date="1955-06-28">June 28, 1955</date>], and (C) the amount of such increase does not exceed the amount of the increase which would be payable in the case of such employee if he were subject to the provisions of subsection (a) of this section [former <ref href="/us/usc/t2/s60e–7">section 60e–7 of this title</ref>] plus any additional amount which may result from fixing the rate of basic compensation at the lowest multiple of $60 which will result in an increase not less than the amount of such increase which would be payable under subsection (a) [former <ref href="/us/usc/t2/s60e–7/a">section 60e–7(a) of this title</ref>].</content>
