<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id55e27146-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579"><num value="4579">§ 4579.</num><heading> Student loan repayment program for Senate employees</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e27147-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27148-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligible employee</heading><chapeau>The term “eligible employee” means an individual, except as provided under subsection (b)(3)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27149-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/1/A"><num value="A">(A)</num><content> who is an employee of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2714a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/1/B"><num value="B">(B)</num><content> whose rate of pay as an employee of the Senate, on the date on which such eligibility is determined, does not exceed the rate of basic pay for an employee for a position at ES–1 of the Senior Executive Schedule as provided for in subchapter VIII of chapter 53 of title 5 (including any locality pay adjustment applicable to the Washington, D.C.-Baltimore Maryland consolidated metropolitan statistical area).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2714b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Employee of the Senate</heading><chapeau>The term “employee of the Senate”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2714c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/2/A"><num value="A">(A)</num><content> has the meaning given the term under <ref href="/us/usc/t2/s1301">section 1301 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2714d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/2/B"><num value="B">(B)</num><content> includes any employee of the Office of Congressional Accessibility Services whose pay is disbursed by the Secretary of the Senate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2714e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Employing office</heading><chapeau>The term “employing office”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2714f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/3/A"><num value="A">(A)</num><content> means the employing office, as defined under <ref href="/us/usc/t2/s1301">section 1301 of this title</ref>, of an employee of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27150-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/3/B"><num value="B">(B)</num><content> includes the Office of Congressional Accessibility Services with respect to employees of that office whose pay is disbursed by the Secretary of the Senate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27151-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of the Senate.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27152-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Student loan</heading><chapeau>The term “student loan” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27153-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/5/A"><num value="A">(A)</num><content> a loan made, insured, or guaranteed under part B, D, or E of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1071">20 U.S.C. 1071</ref> et seq., 1087a et seq., or 1087aa et seq.); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27154-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/a/5/B"><num value="B">(B)</num><content> a health education assistance loan made or insured under part A of title VII of the Public Health Service Act (<ref href="/us/usc/t42/s292">42 U.S.C. 292</ref> et seq.), or under part E of title VIII of such Act (<ref href="/us/usc/t42/s297a">42 U.S.C. 297a</ref> et seq.).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e27155-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b"><num value="b" class="bold">(b)</num><heading class="bold"> Senate student loan repayment program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27156-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Service agreements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e27157-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The head of an employing office and an eligible employee may enter into a written service agreement under which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id55e27158-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/A/i"><num value="i">(i)</num><content> the employing office shall agree to repay, by direct payments on behalf of the eligible employee, any student loan indebtedness of the eligible employee that is outstanding at the time the eligible employee and the employing office enter into the agreement, subject to this section; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id55e27159-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/A/ii"><num value="ii">(ii)</num><content> the eligible employee shall agree to complete the 1-year required period of employment described in subsection (c)(1) with the employing office in exchange for the student loan payments.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e2715a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents of service agreements</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id55e2715b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Contents</heading><chapeau>A service agreement under this paragraph shall contain—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id55e2715c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/I"><num value="I">(I)</num><content> the start and end dates of the required period of employment covered by the agreement;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id55e2715d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/II"><num value="II">(II)</num><content> the monthly amount of the student loan payments to be provided by the employing office;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id55e2715e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/III"><num value="III">(III)</num><content> the employee’s agreement to reimburse the Senate under the conditions set forth in subsection (d)(1);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id55e2715f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/IV"><num value="IV">(IV)</num><content> disclosure of the program limitations provided for in subsection (d)(4) and paragraphs (2), (3), (6), and (7) of subsection (f);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id55e27160-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/V"><num value="V">(V)</num><content> other terms to which the employing office and employee agree (such as terms relating to job responsibilities or job performance expectations); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id55e27161-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/i/VI"><num value="VI">(VI)</num><content> any other terms prescribed by the Secretary.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id55e27162-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/1/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Standard service agreements</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall establish standard service agreements for employing offices to use in carrying out this section.</p>
</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27163-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Submission of agreements</heading><content><p style="-uslm-lc:I12" class="indent1">On entering into a service agreement under this section, the employing office shall submit a copy of the service agreement to the Secretary.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27164-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Exclusion from participation in dual programs</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding <ref href="/us/usc/t5/s5379">section 5379 of title 5</ref>, an employee of the Office of Congressional Accessibility Services may not participate in the student loan repayment program through an agreement under that section and participate in the student loan repayment program through a service agreement under this section at the same time.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e27165-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c"><num value="c" class="bold">(c)</num><heading class="bold"> Program conditions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27166-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Period of employment</heading><content><p style="-uslm-lc:I12" class="indent1">The term of the required period of employment under a service agreement under this section shall be 1 year. On completion of the required period of employment under such a service agreement, the eligible employee and the employing office may enter into additional service agreements for successive 1-year periods of employment.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27167-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Amount of payments</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e27168-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The amount of student loan payments made under service agreements under this section on behalf of an eligible employee may not exceed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id55e27169-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/2/A/i"><num value="i">(i)</num><content> $500 in any month; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id55e2716a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/2/A/ii"><num value="ii">(ii)</num><content> a total of $40,000.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e2716b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Payments included in gross compensation limitations</heading><content><p style="-uslm-lc:I13" class="indent2">Any student loan payment made under this section in any month may not result in the sum of the payment and the compensation of an employee for that month exceeding <sup>1</sup>⁄<sub>12</sub>th of the applicable annual maximum gross compensation limitation under section 4575(d)(2), (e), or (f) of this title.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2716c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Timing of payments</heading><content><p style="-uslm-lc:I12" class="indent1">Student loan payments made under this section under a service agreement shall begin the first day of the pay period after the date on which the agreement is signed and received by the Secretary, and shall be made on a monthly basis.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e2716d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d"><num value="d" class="bold">(d)</num><heading class="bold"> Loss of eligibility for student loan payments and obligation to reimburse</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2716e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>An employee shall not be eligible for continued student loan payments under a service agreement under this section and (except in a case in which an employee’s duty is terminated under paragraph (2) or an employing office assumes responsibilities under paragraph (3)) shall reimburse the Senate for the amount of all student loan payments made on behalf of the employee under the agreement, if, before the employee completes the required period of employment specified in the agreement—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2716f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/1/A"><num value="A">(A)</num><content> the employee voluntarily separates from service with the employing office;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27170-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/1/B"><num value="B">(B)</num><content> the employee engages in misconduct or does not maintain an acceptable level of performance, as determined by the head of the employing office; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27171-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/1/C"><num value="C">(C)</num><content> the employee violates any condition of the agreement.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27172-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Termination of agreement</heading><chapeau>The duty of an eligible employee to fulfill the required period of employment under the service agreement shall be terminated if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27173-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/2/A"><num value="A">(A)</num><content> funds are not made available to cover the cost of the student loan repayment program carried out under this section; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27174-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/2/B"><num value="B">(B)</num><content> the employee and the head of the employing office involved mutually agree to terminate the service agreement under subsection (f)(7).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27175-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Another employing office</heading><content><p style="-uslm-lc:I12" class="indent1">An employing office who hires an eligible employee during a required period of employment under such a service agreement may assume the remaining obligations (as of the date of the hiring) of the employee’s prior employing office under the agreement.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27176-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Failure of employee to reimburse</heading><chapeau>If an eligible employee fails to reimburse the Senate for the amount owed under paragraph (1), such amount shall be collected—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27177-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/4/A"><num value="A">(A)</num><content> under <ref href="/us/usc/t2/s6568/c">section 6568(c) of this title</ref> or <ref href="/us/usc/t5/s5514">section 5514 of title 5</ref> if the eligible employee is employed by any other office of the Senate or agency of the Federal Government; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27178-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/4/B"><num value="B">(B)</num><content> under other applicable provisions of law if the eligible employee is not employed by any other office of the Senate or agency of the Federal Government.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27179-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Crediting of amounts</heading><content><p style="-uslm-lc:I12" class="indent1">Any amount repaid by, or recovered from, an eligible employee under this section shall be credited to the subaccount for the employing office from which the amount involved was originally paid. Any amount so credited shall be merged with other sums in such subaccount for the employing office and shall be available for the same purposes, and subject to the same limitations (if any), as the sums with which such amount is merged.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e2717a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e"><num value="e" class="bold">(e)</num><heading class="bold"> Records and reports</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2717b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>Not later than <date date="2003-01-01">January 1, 2003</date>, and each January 1 thereafter, the Secretary shall prepare and submit to the Committee on Rules and Administration of the Senate and the Committee on Appropriations of the Senate, a report for the fiscal year preceding the fiscal year in which the report is submitted, that contains information specifying—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2717c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1/A"><num value="A">(A)</num><content> the number of eligible employees that received student loan payments under this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2717d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1/B"><num value="B">(B)</num><chapeau> the costs of such payments, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id55e2717e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1/B/i"><num value="i">(i)</num><content> the amount of such payments made for each eligible employee;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id55e2717f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1/B/ii"><num value="ii">(ii)</num><content> the amount of any reimbursement amounts for early separation from service or whether any waivers were provided with respect to such reimbursements; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id55e27180-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/1/B/iii"><num value="iii">(iii)</num><content> any other information determined to be relevant by the Committee on Rules and Administration of the Senate or the Committee on Appropriations of the Senate.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27181-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Confidentiality</heading><content><p style="-uslm-lc:I12" class="indent1">Such report shall not include any information which is considered confidential or could disclose the identity of individual employees or employing offices. Information required to be contained in the report of the Secretary under <ref href="/us/usc/t2/s4108">section 4108 of this title</ref> shall not be considered to be personal information for purposes of this paragraph.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e27182-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f"><num value="f" class="bold">(f)</num><heading class="bold"> Other administrative matters</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27183-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Account</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e27184-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall establish and maintain a central account from which student loan payments available under this section shall be paid on behalf of eligible employees.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e27185-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Office subaccounts</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall ensure that, within the account established under subparagraph (A), a separate subaccount is established for each employing office to be used by each such office to make student loan payments under this section. Such student loan payments shall be made from any funds available to the employing office for student loan payments that are contained in the subaccount for the office.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id55e27186-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">Amounts in each subaccount established under this paragraph shall not be made available for any purpose other than to make student loan payments under this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27187-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Beginning of payments</heading><chapeau>Student loan payments may begin under this section with respect to an eligible employee upon—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27188-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/2/A"><num value="A">(A)</num><content> the receipt by the Secretary of a signed service agreement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27189-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/2/B"><num value="B">(B)</num><content> verification by the Secretary with the holder of the loan that the eligible employee has an outstanding student loan balance that qualifies for payment under this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">Student loan payments may be made under this section only with respect to the amount of student loan indebtedness of the eligible employee that is outstanding on the date on which the employee and the employing office enter into a service agreement under this section. Such payments may not be made under this section on a student loan that is in default or arrears.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Payment on multiple loans</heading><content><p style="-uslm-lc:I12" class="indent1">Student loan payments may be made under this section with respect to more than 1 student loan of an eligible employee at the same time or separately, if the total payments on behalf of such employee do not exceed the limits under subsection (c)(2)(A).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Treatment of payments</heading><content><p style="-uslm-lc:I12" class="indent1">Student loan payments made on behalf of an eligible employee under this section shall be in addition to any basic pay and other forms of compensation otherwise payable to the eligible employee, and shall be subject to withholding for income and employment tax obligations as provided for by law.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/6"><num value="6" class="bold">(6)</num><heading class="bold"> No relief from liability</heading><content><p style="-uslm-lc:I12" class="indent1">An agreement to make student loan payments under this section shall not exempt an eligible employee from the responsibility or liability of the employee with respect to the loan involved and the eligible employee shall continue to be responsible for making student loan payments on the portion of any loan that is not covered under the terms of the service agreement.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/7"><num value="7" class="bold">(7)</num><heading class="bold"> Reduction in payments</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding the terms of a service agreement under this section, the head of an employing office may reduce the amount of student loan payments made under the agreement if adequate funds are not available to such office. If the head of the employing office decides to reduce the amount of student loan payments for an eligible employee, the head of the office and the employee may mutually agree to terminate the service agreement.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2718f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/8"><num value="8" class="bold">(8)</num><heading class="bold"> No right to continued employment</heading><content><p style="-uslm-lc:I12" class="indent1">A service agreement under this section shall not be construed to create a right to, promise of, or entitlement to the continued employment of the eligible employee.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27190-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/9"><num value="9" class="bold">(9)</num><heading class="bold"> No entitlement</heading><content><p style="-uslm-lc:I12" class="indent1">A student loan payment under this section shall not be construed to be an entitlement for any eligible employee.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27191-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/10"><num value="10" class="bold">(10)</num><heading class="bold"> Treatment of payments</heading><chapeau>A student loan payment under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27192-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/10/A"><num value="A">(A)</num><content> shall not be basic pay of an employee for purposes of chapters 83 and 84 of title 5 (relating to retirement) and chapter 87 of such title (relating to life insurance coverage); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27193-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/f/10/B"><num value="B">(B)</num><content> shall not be included in Federal wages for purposes of chapter 85 of such title (relating to unemployment compensation).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e27194-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g"><num value="g" class="bold">(g)</num><heading class="bold"> Allocation of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27195-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Maximum amount</heading><chapeau>In this subsection, the term “maximum amount”, used with respect to a fiscal year, means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27196-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/1/A"><num value="A">(A)</num><content> in the case of an employing office described in subsection (h)(1)(A), the amount described in that subsection for that fiscal year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27197-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/1/B"><num value="B">(B)</num><content> in the case of an employing office described in subsection (h)(1)(B), the amount described in that subsection for that fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e27198-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Allocation</heading><chapeau>From the total amount made available to carry out this section for a fiscal year, there shall be allocated to each employing office for that fiscal year—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e27199-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/2/A"><num value="A">(A)</num><content> the maximum amount for that employing office for that fiscal year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2719a-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/2/B"><num value="B">(B)</num><content> if the total amount is not sufficient to provide the maximum amount to each employing office, an amount that bears the same relationship to the total amount as the maximum amount for that employing office for that fiscal year bears to the total of the maximum amounts for all employing offices for that fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2719b-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Apportionment</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of an employing office that is a Committee of the Senate, the funds allocated under this subsection shall be apportioned between the majority and minority staff of the committee in the same manner as amounts are apportioned between the staffs for salaries.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id55e2719c-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/h"><num value="h" class="bold">(h)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e2719d-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>There are authorized to be appropriated (or otherwise made available from appropriations) to carry out this section the following amounts for each fiscal year:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2719e-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/h/1/A"><num value="A">(A)</num><content> For each employing office that is the personal office of a Senator, an amount equal to 2 percent of the total sums appropriated for the fiscal year involved for administrative and clerical salaries for such office.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id55e2719f-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/h/1/B"><num value="B">(B)</num><content> For each other employing office, an amount equal to 2 percent of the total sums appropriated for the fiscal year involved for salaries for such office.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id55e271a0-9c7c-11e6-93fe-946bd3f61746" identifier="/us/usc/t2/s4579/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">Amounts provided under this section shall be subject to annual appropriations.</p>
