<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id43b97504-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580"><num value="4580">§ 4580.</num><heading> Lump sum payment for accrued annual leave of Senate employees</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43b97505-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authorization</heading><chapeau style="-uslm-lc:I11" class="indent0">The head of the employing office of an employee of the Senate may, upon termination of employment of the employee, authorize payment of a lump sum for the accrued annual leave of that employee if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id43b97506-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/a/1"><num value="1">(1)</num><chapeau> the head of the employing office—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id43b97507-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/a/1/A"><num value="A">(A)</num><content> has approved a written leave policy authorizing employees to accrue leave and establishing the conditions upon which accrued leave may be paid; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id43b97508-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/a/1/B"><num value="B">(B)</num><content> submits written certification to the Financial Clerk of the Senate of the number of days of annual leave accrued by the employee for which payment is to be made under the written leave policy of the employing office; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id43b97509-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/a/2"><num value="2">(2)</num><content> there are sufficient funds to cover the lump sum payment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43b9750a-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/b"><num value="b" class="bold">(b)</num><heading class="bold"> Rates</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id43b9750b-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/b/1"><num value="1">(1)</num><chapeau> A lump sum payment under this section shall not exceed the lesser of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id43b9750c-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/b/1/A"><num value="A">(A)</num><content> twice the monthly rate of pay of the employee; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id43b9750d-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/b/1/B"><num value="B">(B)</num><content> the product of the daily rate of pay of the employee and the number of days of accrued annual leave of the employee.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id43b9750e-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/b/2"><num value="2">(2)</num><content> The Secretary of the Senate shall determine the rates of pay of an employee under paragraph (1)(A) and (B) on the basis of the annual rate of pay of the employee in effect on the date of termination of employment.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43b9750f-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/c"><num value="c" class="bold">(c)</num><heading class="bold"> Source of payment</heading><content><p style="-uslm-lc:I11" class="indent0">Any payment under this section shall be paid from the appropriation account or fund used to pay the employee.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43b97510-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/d"><num value="d" class="bold">(d)</num><heading class="bold"> Reemployment refund</heading><content><p style="-uslm-lc:I11" class="indent0">If an individual who received a lump sum payment under this section is reemployed as an employee of the Senate before the end of the period covered by the lump sum payment, the individual shall refund an amount equal to the applicable pay covering the period between the date of reemployment and the expiration of the lump sum period. Such amount shall be deposited to the appropriation account or fund used to pay the lump sum payment.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43bbe511-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/e"><num value="e" class="bold">(e)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">The Committee on Rules and Administration of the Senate may prescribe regulations to carry out this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id43bbe512-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/f"><num value="f" class="bold">(f)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section, the term—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id43bbe513-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/f/1"><num value="1">(1)</num><content> “employee of the Senate” means any employee whose pay is disbursed by the Secretary of the Senate, except that the term does not include a member of the Capitol Police or a civilian employee of the Capitol Police; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id43bbe514-3b28-11eb-b57d-ac6ded64e2e5" identifier="/us/usc/t2/s4580/f/2"><num value="2">(2)</num><content> “head of the employing office” means any person with the final authority to appoint, hire, discharge, and set the terms, conditions, or privileges of the employment of an individual whose pay is disbursed by the Secretary of the Senate.</content>
