<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this part:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf328d70d-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/1"><num value="1" class="bold">(1)</num><heading class="bold"> Agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “agency” has the same meaning as defined in <ref href="/us/usc/t5/s551/1">section 551(1) of title 5</ref>, but does not include independent regulatory agencies.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf328d70e-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/2"><num value="2" class="bold">(2)</num><heading class="bold"> Amount</heading><content><p style="-uslm-lc:I12" class="indent1">The term “amount”, with respect to an authorization of appropriations for Federal financial assistance, means the amount of budget authority for any Federal grant assistance program or any Federal program providing loan guarantees or direct loans.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf328d70f-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3"><num value="3" class="bold">(3)</num><heading class="bold"> Direct costs</heading><chapeau>The term “direct costs”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d710-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idf328d711-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/A/i"><num value="i">(i)</num><content> in the case of a Federal intergovernmental mandate, means the aggregate estimated amounts that all State, local, and tribal governments would be required to spend or would be prohibited from raising in revenues in order to comply with the Federal intergovernmental mandate; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idf328d712-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/A/ii"><num value="ii">(ii)</num><content> in the case of a provision referred to in paragraph (5)(A)(ii), means the amount of Federal financial assistance eliminated or reduced;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d713-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/B"><num value="B">(B)</num><content> in the case of a Federal private sector mandate, means the aggregate estimated amounts that the private sector will be required to spend in order to comply with the Federal private sector mandate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d714-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/C"><num value="C">(C)</num><chapeau> shall be determined on the assumption that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf328d715-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/C/i"><num value="i">(i)</num><content> State, local, and tribal governments, and the private sector will take all reasonable steps necessary to mitigate the costs resulting from the Federal mandate, and will comply with applicable standards of practice and conduct established by recognized professional or trade associations; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf328d716-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/C/ii"><num value="ii">(ii)</num><content> reasonable steps to mitigate the costs shall not include increases in State, local, or tribal taxes or fees; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d717-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D"><num value="D">(D)</num><chapeau> shall not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf328d718-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/i"><num value="i">(i)</num><chapeau> estimated amounts that the State, local, and tribal governments (in the case of a Federal intergovernmental mandate) or the private sector (in the case of a Federal private sector mandate) would spend—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf328d719-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/i/I"><num value="I">(I)</num><content> to comply with or carry out all applicable Federal, State, local, and tribal laws and regulations in effect at the time of the adoption of the Federal mandate for the same activity as is affected by that Federal mandate; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf328d71a-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/i/II"><num value="II">(II)</num><content> to comply with or carry out State, local, and tribal governmental programs, or private-sector business or other activities in effect at the time of the adoption of the Federal mandate for the same activity as is affected by that mandate; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf328d71b-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/ii"><num value="ii">(ii)</num><chapeau> expenditures to the extent that such expenditures will be offset by any direct savings to the State, local, and tribal governments, or by the private sector, as a result of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf328d71c-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/ii/I"><num value="I">(I)</num><content> compliance with the Federal mandate; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf328d71d-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/3/D/ii/II"><num value="II">(II)</num><content> other changes in Federal law or regulation that are enacted or adopted in the same bill or joint resolution or proposed or final Federal regulation and that govern the same activity as is affected by the Federal mandate.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf328d71e-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/4"><num value="4" class="bold">(4)</num><heading class="bold"> Direct savings</heading><chapeau>The term “direct savings”, when used with respect to the result of compliance with the Federal mandate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d71f-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/4/A"><num value="A">(A)</num><content> in the case of a Federal intergovernmental mandate, means the aggregate estimated reduction in costs to any State, local, or tribal government as a result of compliance with the Federal intergovernmental mandate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d720-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/4/B"><num value="B">(B)</num><content> in the case of a Federal private sector mandate, means the aggregate estimated reduction in costs to the private sector as a result of compliance with the Federal private sector mandate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf328d721-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5"><num value="5" class="bold">(5)</num><heading class="bold"> Federal intergovernmental mandate</heading><chapeau>The term “Federal intergovernmental mandate” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf328d722-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A"><num value="A">(A)</num><chapeau> any provision in legislation, statute, or regulation that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf328d723-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/i"><num value="i">(i)</num><chapeau> would impose an enforceable duty upon State, local, or tribal governments, except—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf328d724-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/i/I"><num value="I">(I)</num><content> a condition of Federal assistance; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf328d725-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/i/II"><num value="II">(II)</num><content> a duty arising from participation in a voluntary Federal program, except as provided in subparagraph (B); or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf328d726-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/ii"><num value="ii">(ii)</num><chapeau> would reduce or eliminate the amount of authorization of appropriations for—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf328d727-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/ii/I"><num value="I">(I)</num><content> Federal financial assistance that would be provided to State, local, or tribal governments for the purpose of complying with any such previously imposed duty unless such duty is reduced or eliminated by a corresponding amount; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf328d728-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/A/ii/II"><num value="II">(II)</num><content> the control of borders by the Federal Government; or reimbursement to State, local, or tribal governments for the net cost associated with illegal, deportable, and excludable aliens, including court-mandated expenses related to emergency health care, education or criminal justice; when such a reduction or elimination would result in increased net costs to State, local, or tribal governments in providing education or emergency health care to, or incarceration of, illegal aliens; except that this subclause shall not be in effect with respect to a State, local, or tribal government, to the extent that such government has not fully cooperated in the efforts of the Federal Government to locate, apprehend, and deport illegal aliens;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf32b2019-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/B"><num value="B">(B)</num><chapeau> any provision in legislation, statute, or regulation that relates to a then-existing Federal program under which $500,000,000 or more is provided annually to State, local, and tribal governments under entitlement authority, if the provision—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf32b201a-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/B/i"><num value="i">(i)</num><subclause style="-uslm-lc:I14" class="indent3" id="idf32b201b-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/B/i/I"><num value="I">(I)</num><content> would increase the stringency of conditions of assistance to State, local, or tribal governments under the program; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idf32b201c-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/B/i/II"><num value="II">(II)</num><content> would place caps upon, or otherwise decrease, the Federal Government’s responsibility to provide funding to State, local, or tribal governments under the program; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf32b201d-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/5/B/ii"><num value="ii">(ii)</num><content> the State, local, or tribal governments that participate in the Federal program lack authority under that program to amend their financial or programmatic responsibilities to continue providing required services that are affected by the legislation, statute, or regulation.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b201e-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/6"><num value="6" class="bold">(6)</num><heading class="bold"> Federal mandate</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Federal mandate” means a Federal intergovernmental mandate or a Federal private sector mandate, as defined in paragraphs (5) and (7).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b201f-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/7"><num value="7" class="bold">(7)</num><heading class="bold"> Federal private sector mandate</heading><chapeau>The term “Federal private sector mandate” means any provision in legislation, statute, or regulation that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf32b2020-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/7/A"><num value="A">(A)</num><chapeau> would impose an enforceable duty upon the private sector except—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf32b2021-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/7/A/i"><num value="i">(i)</num><content> a condition of Federal assistance; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf32b2022-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/7/A/ii"><num value="ii">(ii)</num><content> a duty arising from participation in a voluntary Federal program; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf32b2023-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/7/B"><num value="B">(B)</num><content> would reduce or eliminate the amount of authorization of appropriations for Federal financial assistance that will be provided to the private sector for the purposes of ensuring compliance with such duty.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b2024-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/8"><num value="8" class="bold">(8)</num><heading class="bold"> Local government</heading><content><p style="-uslm-lc:I12" class="indent1">The term “local government” has the same meaning as defined in <ref href="/us/usc/t31/s6501/6">section 6501(6) of title 31</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b2025-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/9"><num value="9" class="bold">(9)</num><heading class="bold"> Private sector</heading><content><p style="-uslm-lc:I12" class="indent1">The term “private sector” means all persons or entities in the United States, including individuals, partnerships, associations, corporations, and educational and nonprofit institutions, but shall not include State, local, or tribal governments.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b2026-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/10"><num value="10" class="bold">(10)</num><heading class="bold"> Regulation; rule</heading><content><p style="-uslm-lc:I12" class="indent1">The term “regulation” or “rule” (except with respect to a rule of either House of the Congress) has the meaning of “rule” as defined in <ref href="/us/usc/t5/s601/2">section 601(2) of title 5</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf32b2027-1de7-11e7-95e2-916b588ecdc3" identifier="/us/usc/t2/s658/11"><num value="11" class="bold">(11)</num><heading class="bold"> Small government</heading><content><p style="-uslm-lc:I12" class="indent1">The term “small government” means any small governmental jurisdictions defined in <ref href="/us/usc/t5/s601/5">section 601(5) of title 5</ref> and any tribal government.</p>
