L. 100–119, title II, § 206(a), Sept. 29, 1987, 101 Stat. 785.)","seq_in_title":857,"parent_identifier":"/us/usc/t2/ch17B/schII","ancestors":[{"identifier":"/us/usc/t2","level":"title","num":"Title 2—","heading":"THE CONGRESS","status":null,"is_section":false},{"identifier":"/us/usc/t2/ch17B","level":"chapter","num":"CHAPTER 17B—","heading":"IMPOUNDMENT CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t2/ch17B/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"CONGRESSIONAL CONSIDERATION OF PROPOSED RESCISSIONS, RESERVATIONS, AND DEFERRALS OF BUDGET AUTHORITY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id4314f78a-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684\"><num value=\"684\">§ 684.</num><heading> Proposed deferrals of budget authority</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4314f78b-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Transmittal of special message</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the President, the Director of the Office of Management and Budget, the head of any department or agency of the United States, or any officer or employee of the United States proposes to defer any budget authority provided for a specific purpose or project, the President shall transmit to the House of Representatives and the Senate a special message specifying—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f78c-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/1\"><num value=\"1\">(1)</num><content> the amount of the budget authority proposed to be deferred;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f78d-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/2\"><num value=\"2\">(2)</num><content> any account, department, or establishment of the Government to which such budget authority is available for obligation, and the specific projects or governmental functions involved;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f78e-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/3\"><num value=\"3\">(3)</num><content> the period of time during which the budget authority is proposed to be deferred;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f78f-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/4\"><num value=\"4\">(4)</num><content> the reasons for the proposed deferral, including any legal authority invoked to justify the proposed deferral;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f790-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/5\"><num value=\"5\">(5)</num><content> to the maximum extent practicable, the estimated fiscal, economic, and budgetary effect of the proposed deferral; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f791-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/a/6\"><num value=\"6\">(6)</num><content> all facts, circumstances, and considerations relating to or bearing upon the proposed deferral and the decision to effect the proposed deferral, including an analysis of such facts, circumstances, and considerations in terms of their application to any legal authority, including specific elements of legal authority, invoked to justify such proposed deferral, and to the maximum extent practicable, the estimated effect of the proposed deferral upon the objects, purposes, and programs for which the budget authority is provided.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">A special message may include one or more proposed deferrals of budget authority. A deferral may not be proposed for any period of time extending beyond the end of the fiscal year in which the special message proposing the deferral is transmitted to the House and the Senate.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4314f792-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Consistency with legislative policy</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Deferrals shall be permissible only—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f793-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/b/1\"><num value=\"1\">(1)</num><content> to provide for contingencies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f794-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/b/2\"><num value=\"2\">(2)</num><content> to achieve savings made possible by or through changes in requirements or greater efficiency of operations; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4314f795-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/b/3\"><num value=\"3\">(3)</num><content> as specifically provided by law.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">No officer or employee of the United States may defer any budget authority for any other purpose.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4314f796-3b28-11eb-b57d-ac6ded64e2e5\" identifier=\"/us/usc/t2/s684/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The provisions of this section do not apply to any budget authority proposed to be rescinded or that is to be reserved as set forth in a special message required to be transmitted under <ref href=\"/us/usc/t2/s683\">section 683 of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id4314f797-3b28-11eb-b57d-ac6ded64e2e5\">(<ref href=\"/us/pl/93/344/tX/s1013\">Pub.
