<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1b5e39ea-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92"><num value="92">§ 92.</num><heading> Employees of Members of House of Representatives</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2 bold" id="id1b5e39eb-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a"><num value="a">(a)</num><heading> In general</heading><chapeau>Under the Members’ Representational Allowance, each Member of the House of Representatives may employ not more than 18 permanent employees and a total of not more than 4 additional employees in the following categories:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39ec-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a/1"><num value="1">(1)</num><content> Interns.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39ed-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a/2"><num value="2">(2)</num><content> Part-time employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39ee-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a/3"><num value="3">(3)</num><content> Shared employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39ef-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a/4"><num value="4">(4)</num><content> Temporary employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f0-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/a/5"><num value="5">(5)</num><content> Employees on leave without pay.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2 bold" id="id1b5e39f1-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/b"><num value="b">(b)</num><heading> Benefit exclusion</heading><chapeau>For purposes of this section, interns and temporary employees shall be excluded from the operation of the following provisions of title 5:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f2-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/b/1"><num value="1">(1)</num><content> Chapter 84 (relating to the Federal Employees’ Retirement System).</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f3-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/b/2"><num value="2">(2)</num><content> Chapter 87 (relating to life insurance).</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f4-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/b/3"><num value="3">(3)</num><content> Chapter 89 (relating to health insurance).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2 bold" id="id1b5e39f5-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c"><num value="c">(c)</num><heading> Definitions</heading><chapeau>As used in this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f6-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c/1"><num value="1">(1)</num><content> the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f7-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c/2"><num value="2">(2)</num><content> the term “intern” means, with respect to a Member of the House of Representatives, an individual who serves in the office of the Member for not more than 120 days in a 12-month period and whose service is primarily for the educational experience of the individual;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f8-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c/3"><num value="3">(3)</num><content> the term “part-time employee” means, with respect to a Member of the House of Representatives, an individual who is employed by the Member and whose normally assigned work schedule is not more than the equivalent of 15 full working days per month;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b5e39f9-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c/4"><num value="4">(4)</num><content> the term “temporary employee” means, with respect to a Member of the House of Representatives, an individual who is employed for a specific purpose or task and who is employed for not more than 90 days in a 12-month period, except that the term of such employment may be extended with the written approval of the Committee on House Oversight; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1b6083ea-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/c/5"><num value="5">(5)</num><content> the term “shared employee” means an employee who is paid by more than one employing authority of the House of Representatives.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2 bold" id="id1b6083eb-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s92/d"><num value="d">(d)</num><heading> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">The Committee on House Oversight shall have authority to prescribe regulations to carry out this section.</p>
