value=\"10005\">§ 10005.</num><heading> State applications</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83ba5844-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Governor of a State desiring to receive an allocation under <ref href=\"/us/usc/t20/s10001/d\">section 10001(d) of this title</ref> shall submit an application at such time, in such manner, and containing such information as the Secretary may reasonably require.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83ba5845-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Application</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In such application, the Governor shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83ba5846-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/b/1\"><num value=\"1\">(1)</num><content> include the assurances described in subsection (d);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc847-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/b/2\"><num value=\"2\">(2)</num><content> provide baseline data that demonstrates the State’s current status in each of the areas described in such assurances; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc848-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/b/3\"><num value=\"3\">(3)</num><content> describe how the State intends to use its allocation, including whether the State will use such allocation to meet maintenance of effort requirements under the ESEA and IDEA and, in such cases, what amount will be used to meet such requirements.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83bcc849-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Incentive grant application</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Governor of a State seeking a grant under <ref href=\"/us/usc/t20/s10006\">section 10006 of this title</ref> shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc84a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c/1\"><num value=\"1\">(1)</num><content> submit an application for consideration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc84b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c/2\"><num value=\"2\">(2)</num><content> describe the status of the State’s progress in each of the areas described in subsection (d), and the strategies the State is employing to help ensure that students in the subgroups described in section 1111(b)(2)(C)(v)(II) <ref class=\"footnoteRef\" idref=\"fn002244\">1</ref><note type=\"footnote\" id=\"fn002244\"><num>1</num> See References in Text note below.</note> of the ESEA (<ref href=\"/us/usc/t20/s6311/b/2/C/v/II\">20 U.S.C. 6311(b)(2)(C)(v)(II)</ref>) who have not met the State’s proficiency targets continue making progress toward meeting the State’s student academic achievement standards;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc84c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c/3\"><num value=\"3\">(3)</num><content> describe the achievement and graduation rates (as described in section 1111(b)(2)(C)(vi) <sup>1</sup> of the ESEA (<ref href=\"/us/usc/t20/s6311/b/2/C/vi\">20 U.S.C. 6311(b)(2)(C)(vi)</ref>) and as clarified in section 200.19(b)(1) of title 34, Code of Federal Regulations) of public elementary and secondary school students in the State, and the strategies the State is employing to help ensure that all subgroups of students identified in section 1111(b)(2) of the ESEA (<ref href=\"/us/usc/t20/s6311/b/2\">20 U.S.C. 6311(b)(2)</ref>) in the State continue making progress toward meeting the State’s student academic achievement standards;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc84d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c/4\"><num value=\"4\">(4)</num><content> describe how the State would use its grant funding to improve student academic achievement in the State, including how it will allocate the funds to give priority to high-need local educational agencies; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83bcc84e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/c/5\"><num value=\"5\">(5)</num><content> include a plan for evaluating the State’s progress in closing achievement gaps.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83bcc84f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Assurances</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An application under subsection (b) shall include the following assurances:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc850-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Maintenance of effort</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83bcc851-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Elementary and secondary education</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The State will, in each of fiscal years 2009, 2010, and 2011, maintain State support for elementary and secondary education at least at the level of such support in fiscal year 2006.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83bcc852-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Higher education</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The State will, in each of fiscal years 2009, 2010, and 2011, maintain State support for public institutions of higher education (not including support for capital projects or for research and development or tuition and fees paid by students) at least at the level of such support in fiscal year 2006.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc853-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Achieving equity in teacher distribution</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State will take actions to improve teacher effectiveness and comply with section 1111(b)(8)(C) <sup>1</sup> of the ESEA (<ref href=\"/us/usc/t20/s6311/b/8/C\">20 U.S.C. 6311(b)(8)(C)</ref>) in order to address inequities in the distribution of highly qualified teachers between high- and low-poverty schools, and to ensure that low-income and minority children are not taught at higher rates than other children by inexperienced, unqualified, or out-of-field teachers.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc854-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Improving collection and use of data</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State will establish a longitudinal data system that includes the elements described in <ref href=\"/us/usc/t20/s9871/e/2/D\">section 9871(e)(2)(D) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc855-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Standards and assessments</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc856-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/4/A\"><num value=\"A\">(A)</num><content> will enhance the quality of the academic assessments it administers pursuant to section 1111(b)(3) of the ESEA (<ref href=\"/us/usc/t20/s6311/b/3\">20 U.S.C. 6311(b)(3)</ref>) through activities such as those described in section 6112(a) <sup>1</sup> of such Act (<ref href=\"/us/usc/t20/s7301a/a\">20 U.S.C. 7301a(a)</ref>);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc857-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/4/B\"><num value=\"B\">(B)</num><content> will comply with the requirements of paragraphs (3)(C)(ix) and (6) of section 1111(b) <sup>1</sup> of the ESEA (<ref href=\"/us/usc/t20/s6311/b\">20 U.S.C. 6311(b)</ref>) and section 612(a)(16) of the IDEA (<ref href=\"/us/usc/t20/s1412/a/16\">20 U.S.C. 1412(a)(16)</ref>) related to the inclusion of children with disabilities and limited English proficient students in State assessments, the development of valid and reliable assessments for those students, and the provision of accommodations that enable their participation in State assessments; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc858-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/4/C\"><num value=\"C\">(C)</num><content> will take steps to improve State academic content standards and student academic achievement standards consistent with <ref href=\"/us/usc/t20/s9871/e/1/A/ii\">section 9871(e)(1)(A)(ii) of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc859-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Supporting struggling schools</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State will ensure compliance with the requirements of section 1116(b)(7)(C)(iv) <sup>1</sup> and section 1116(b)(8)(B) <sup>1</sup> of the ESEA with respect to schools identified under such sections.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83bcc85a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Improving early childhood care and education</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The State will take actions to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc85b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/6/A\"><num value=\"A\">(A)</num><content> increase the number and percentage of low-income and disadvantaged children in each age group of infants, toddlers, and pre-schoolers who are enrolled in high-quality early learning programs;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc85c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/6/B\"><num value=\"B\">(B)</num><content> design and implement an integrated system of high-quality early learning programs and services; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83bcc85d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s10005/d/6/C\"><num value=\"C\">(C)</num><content> ensure that any use of assessments conforms with the recommendations of the National Research Council’s reports on early childhood.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit
