<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83bcc86e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007"><num value="10007">§ 10007.</num><heading> Innovation Fund</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83bcc86f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83bcc870-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligible entities</heading><chapeau style="-uslm-lc:I12" class="indent1">For the purposes of this section, the term “eligible entity” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83bcc871-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/1/A"><num value="A">(A)</num><content> a local educational agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83bcc872-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/1/B"><num value="B">(B)</num><chapeau> a partnership between a nonprofit organization and—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83bcc873-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/1/B/i"><num value="i">(i)</num><content> one or more local educational agencies; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83bcc874-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/1/B/ii"><num value="ii">(ii)</num><content> a consortium of schools.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83bcc875-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Program established</heading><content><p style="-uslm-lc:I12" class="indent1">From the total amount reserved under <ref href="/us/usc/t20/s10001/c">section 10001(c) of this title</ref>, the Secretary may reserve up to $650,000,000 to establish an Innovation Fund, which shall consist of academic achievement awards that recognize eligible entities that meet the requirements described in subsection (b).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83bcc876-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Purpose of awards</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall make awards to eligible entities in order to identify, document, and bring to scale innovative best practices based on demonstrated success, to allow such eligible entities to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83bcc877-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/3/A"><num value="A">(A)</num><content> expand their work and serve as models for best practices; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83bcc878-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/a/3/B"><num value="B">(B)</num><content> work in partnership with the private sector and the philanthropic community.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83bcc879-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligibility</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible for such an award, an eligible entity shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83bcc87a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id83bcc87b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b/1/A"><num value="A">(A)</num><content> have significantly closed the achievement gaps between groups of students described in section 6311(b)(2) <ref class="footnoteRef" idref="fn002246">1</ref><note type="footnote" id="fn002246"><num>1</num> See References in Text note below.</note> of this title; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id83bcc87c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b/1/B"><num value="B">(B)</num><content> have demonstrated success in significantly increasing student academic achievement for all groups of students described in such section;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83bcc87d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b/2"><num value="2">(2)</num><content> have made significant improvement in other areas, such as graduation rates or increased recruitment and placement of high-quality teachers and school leaders, as demonstrated with meaningful data; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83bcc87e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/b/3"><num value="3">(3)</num><content> demonstrate that it has established one or more partnerships with the private sector, which may include philanthropic organizations, and that the private sector will provide matching funds in order to help bring results to scale.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83bcc87f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s10007/c"><num value="c" class="bold">(c)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I11" class="indent0">In the case of an eligible entity that includes a nonprofit organization, the eligible entity shall be considered to have met the eligibility requirements of paragraphs (1)(A) or (1)(B) and (2) of subsection (b) if the nonprofit organization has a record of significantly improving student achievement, attainment, or retention and shall be considered to have met the requirements of subsection (b)(3) if it demonstrates that it will meet the requirement relating to private-sector matching.</p>
