F, title III, § 309(c)(3), Dec. 23, 2011, 125 Stat. 1101.)","seq_in_title":379,"parent_identifier":"/us/usc/t20/ch28/schI/ptA","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28","level":"chapter","num":"CHAPTER 28—","heading":"HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schI/ptA","level":"part","num":"Part A—","heading":"Definitions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idcfcf075f-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001\"><num value=\"1001\">§ 1001.</num><heading> General definition of institution of higher education</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idcfcf0760-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Institution of higher education</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter, other than subchapter IV, the term “institution of higher education” means an educational institution in any State that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0761-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a/1\"><num value=\"1\">(1)</num><content> admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate, or persons who meet the requirements of <ref href=\"/us/usc/t20/s1091/d\">section 1091(d) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0762-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a/2\"><num value=\"2\">(2)</num><content> is legally authorized within such State to provide a program of education beyond secondary education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0763-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a/3\"><num value=\"3\">(3)</num><content> provides an educational program for which the institution awards a bachelor’s degree or provides not less than a 2-year program that is acceptable for full credit toward such a degree, or awards a degree that is acceptable for admission to a graduate or professional degree program, subject to review and approval by the Secretary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0764-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a/4\"><num value=\"4\">(4)</num><content> is a public or other nonprofit institution; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0765-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/a/5\"><num value=\"5\">(5)</num><content> is accredited by a nationally recognized accrediting agency or association, or if not so accredited, is an institution that has been granted preaccreditation status by such an agency or association that has been recognized by the Secretary for the granting of preaccreditation status, and the Secretary has determined that there is satisfactory assurance that the institution will meet the accreditation standards of such an agency or association within a reasonable time.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idcfcf0766-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Additional institutions included</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter, other than subchapter IV, the term “institution of higher education” also includes—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0767-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/b/1\"><num value=\"1\">(1)</num><content> any school that provides not less than a 1-year program of training to prepare students for gainful employment in a recognized occupation and that meets the provision of paragraphs (1), (2), (4), and (5) of subsection (a); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idcfcf0768-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/b/2\"><num value=\"2\">(2)</num><chapeau> a public or nonprofit private educational institution in any State that, in lieu of the requirement in subsection (a)(1), admits as regular students individuals—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idcfcf0769-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/b/2/A\"><num value=\"A\">(A)</num><content> who are beyond the age of compulsory school attendance in the State in which the institution is located; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idcfcf076a-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/b/2/B\"><num value=\"B\">(B)</num><content> who will be dually or concurrently enrolled in the institution and a secondary school.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idcfcf076b-4aa6-11eb-afbc-da62fdf49fd5\" identifier=\"/us/usc/t20/s1001/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> List of accrediting agencies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section and <ref href=\"/us/usc/t20/s1002\">section 1002 of this title</ref>, the Secretary shall publish a list of nationally recognized accrediting agencies or associations that the Secretary determines, pursuant to subpart 2 of part H of subchapter IV, to be reliable authority as to the quality of the education or training offered.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idcfcf076c-4aa6-11eb-afbc-da62fdf49fd5\">(<ref href=\"/us/pl/89/329/tI/s101\">Pub. class=\"small-caps\">Secretary</inline>.—</heading><content>The term ‘Secretary’ means the Secretary of Education.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3503\">“SEC. 3503.</num><heading> CAMPUS-BASED AID WAIVERS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Waiver of Non-federal Share Requirement</inline>.—</heading><content>Notwithstanding sections 413C(a)(2) and 443(b)(5) of the Higher Education Act of 1965 (<ref requirement that a participating institution of higher education provide a non-Federal share to match Federal funds provided to the institution for the programs authorized pursuant to subpart 3 of part A and part C of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070b\">20 U.S.C. 1070b</ref> et seq. and 1087–51 et seq.) for all awards made under such programs during such award years, except nothing in this subsection shall affect the non-Federal share requirement under section 443(c)(3) that applies to private for-profit organizations.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Authority to Reallocate</inline>.—</heading><content>Notwithstanding sections 413D, 442, and 488 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070b–3\">20 U.S.C. 1070b–3</ref>, 1087–52, and 1095), during a period of a qualifying emergency, an institution may transfer up to 100 percent of the institution’s unexpended allotment under section 442 of such Act to the institution’s allotment under section 413D of such Act, but may not transfer any funds from the institution’s unexpended allotment under section 413D of such Act to the institution’s allotment under section 442 of such Act.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3504\">“SEC. 3504.</num><heading> USE OF SUPPLEMENTAL EDUCATIONAL OPPORTUNITY GRANTS FOR EMERGENCY AID.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Notwithstanding section 413B of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070b–1\">20 U.S.C. 1070b–1</ref>), an institution of higher education may reserve any amount of an institution’s allocation under subpart 3 of part A of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070b\">20 U.S.C. 1070b</ref> et seq.) for a fiscal year to award, in such fiscal year, emergency financial aid grants to assist undergraduate or graduate students for unexpected expenses and unmet financial need as the result of a qualifying emergency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Determinations</inline>.—</heading><chapeau>In determining eligibility for and awarding emergency financial aid grants under this section, an institution of higher education may—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> waive the amount of need calculation under section 471 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087kk\">20 U.S.C. 1087kk</ref>);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> allow for a student affected by a qualifying emergency to receive funds in an amount that is not more than the maximum Federal Pell Grant for the applicable award year; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> utilize a contract with a scholarship-granting organization designated for the sole purpose of accepting applications from or disbursing funds to students enrolled in the institution of higher education, if such scholarship-granting organization disburses the full allocated amount provided to the institution of higher education to the recipients.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Special Rule</inline>.—</heading><content>Any emergency financial aid grants to students under this section shall not be treated as other financial assistance for the purposes of section 471 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087kk\">20 U.S.C. 1087kk</ref>).</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3505\">“SEC. 3505.</num><heading> FEDERAL WORK-STUDY DURING A QUALIFYING EMERGENCY.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>In the event of a qualifying emergency, an institution of higher education participating in the program under part C of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087–51\">20 U.S.C. 1087–51</ref> et seq.) may make payments under such part to affected work-study students, for the period of time (not to exceed one academic year) in which affected students were unable to fulfill the students’ work-study obligation for all or part of such academic year due to such qualifying emergency, as follows:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> Payments may be made under such part to affected work-study students in an amount equal to or less than the amount of wages such students would have been paid under such part had the students been able to complete the work obligation necessary to receive work study funds, as a one time grant or as multiple payments.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> Payments shall not be made to any student who was not eligible for work study or was not completing the work obligation necessary to receive work study funds under such part prior to the occurrence of the qualifying emergency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> Any payments made to affected work-study students under this subsection shall meet the matching requirements of section 443 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087–53\">20 U.S.C. 1087–53</ref>), unless such matching requirements are waived by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Definition of Affected Work-study Student</inline>.—</heading><chapeau>In this section, the term ‘affected work-study student’ means a student enrolled at an eligible institution participating in the program under part C of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087–51\">20 U.S.C. 1087–51</ref> et seq.) who—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> received a work-study award under section 443 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087–53\">20 U.S.C. 1087–53</ref>) for the academic year during which a qualifying emergency occurred;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> earned Federal work-study wages from such eligible institution for such academic year; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> was prevented from fulfilling the student’s work-study obligation for all or part of such academic year due to such qualifying emergency.</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3506\">“SEC. 3506.</num><heading> ADJUSTMENT OF SUBSIDIZED LOAN USAGE LIMITS.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“Notwithstanding section 455(q)(3) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087e/q/3\">20 U.S.C. 1087e(q)(3)</ref>), the Secretary shall exclude from a student’s period of enrollment for purposes of loans made under part D of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.) any semester (or the equivalent) that the student does not complete due to a qualifying emergency, if the Secretary is able to administer such policy in a manner that limits complexity and the burden on the student.</p>\n</content>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3507\">“SEC. 3507.</num><heading> EXCLUSION FROM FEDERAL PELL GRANT DURATION LIMIT.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“The Secretary shall exclude from a student’s Federal Pell Grant duration limit under section 401(c)(5) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t2/s1070a/c/5\">2 U.S.C. 1070a(c)(5)</ref>) [probably means 20 U.S.C.1070a(c)(5)] any semester (or the equivalent) that the student does not complete due to a qualifying emergency if the Secretary is able to administer such policy in a manner that limits complexity and the burden on the student.</p>\n</content>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3508\">“SEC. 3508.</num><heading> INSTITUTIONAL REFUNDS AND FEDERAL STUDENT LOAN FLEXIBILITY.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Institutional Waiver.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary shall waive the institutional requirement under section 484B of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1091b\">20 U.S.C. 1091b</ref>) with respect to the amount of grant or loan assistance (other than assistance received under part C of title IV of such Act [<ref href=\"/us/usc/t20/s1087–51\">20 U.S.C. 1087–51</ref> et seq.]) to be returned under such section if a recipient of assistance under title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070\">20 U.S.C. 1070</ref> et seq.) withdraws from the institution of higher education during the payment period or period of enrollment as a result of a qualifying emergency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Waivers</inline>.—</heading><content>The Secretary shall require each institution using a waiver relating to the withdrawal of recipients under this subsection to report the number of such recipients, the amount of grant or loan assistance (other than assistance received under part C of title IV of such Act) associated with each such recipient, and the total amount of grant or loan assistance (other than assistance received under part C of title IV of such Act) for which each institution has not returned assistance under title IV to the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Student Waiver</inline>.—</heading><content>The Secretary shall waive the amounts that students are required to return under section 484B of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1091b\">20 U.S.C. 1091b</ref>) with respect to Federal Pell Grants or other grant assistance if the withdrawals on which the returns are based, are withdrawals by students who withdrew from the institution of higher education as a result of a qualifying emergency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Canceling Loan Obligation</inline>.—</heading><content>Notwithstanding any other provision of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), the Secretary shall cancel the borrower’s obligation to repay the entire portion of a loan made under part D of title IV of such Act (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.) associated with a payment period for a recipient of such loan who withdraws from the institution of higher education during the payment period as a result of a qualifying emergency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Approved Leave of Absence</inline>.—</heading><content>Notwithstanding any other provision of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), for purposes of receiving assistance under title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070\">20 U.S.C. 1070</ref> et seq.), an institution of higher education may, as a result of a qualifying emergency, provide a student with an approved leave of absence that does not require the student to return at the same point in the academic program that the student began the leave of absence if the student returns within the same semester (or the equivalent).</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3509\">“SEC. 3509.</num><heading> SATISFACTORY ACADEMIC PROGRESS.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“Notwithstanding section 484 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1091\">20 U.S.C. 1091</ref>), in determining whether a student is maintaining satisfactory academic progress for purposes of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070\">20 U.S.C. 1070</ref> et seq.), an institution of higher education may, as a result of a qualifying emergency, exclude from the quantitative component of the calculation any attempted credits that were not completed by such student without requiring an appeal by such student.</p>\n</content>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3510\">“SEC. 3510.</num><heading> CONTINUING EDUCATION AT AFFECTED FOREIGN INSTITUTIONS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Notwithstanding section 481(b) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1088/b\">20 U.S.C. 1088(b)</ref>), with respect to a foreign institution, in the case of a public health emergency, major disaster or emergency, or national emergency declared by the applicable government authorities in the country in which the foreign institution is located, the Secretary may permit any part of an otherwise eligible program to be offered via distance education for the duration of such emergency or disaster and the following payment period for purposes of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070\">20 U.S.C. 1070</ref> et seq.).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Eligibility</inline>.—</heading><chapeau>An otherwise eligible program that is offered in whole or in part through distance education by a foreign institution between <date date=\"2020-03-01\">March 1, 2020</date>, and the date of enactment of this Act [<date date=\"2020-03-27\">Mar. 27, 2020</date>] shall be deemed eligible for the purposes of part D of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.) for the duration of the qualifying emergency and the following payment period for purposes of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070\">20 U.S.C. 1070</ref> et seq.). An institution of higher education that uses the authority provided in the previous sentence shall report such use to the Secretary—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> for the 2019–2020 award year, not later than <date date=\"2020-06-30\">June 30, 2020</date>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> for an award year subsequent to the 2019–2020 award year, not later than 30 days after such use.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, and every 180 days thereafter for the duration of the qualifying emergency and the following payment period, the Secretary shall submit to the authorizing committees (as defined in section 103 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1003\">20 U.S.C. 1003</ref>)) a report that identifies each foreign institution that carried out a distance education program authorized under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Written Arrangements.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Notwithstanding section 102 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1002\">20 U.S.C. 1002</ref>), for the duration of a qualifying emergency and the following payment period, the Secretary may allow a foreign institution to enter into a written arrangement with an institution of higher education located in the United States that participates in the Federal Direct Loan Program under part D of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.) for the purpose of allowing a student of the foreign institution who is a borrower of a loan made under such part to take courses from the institution of higher education located in the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Form of arrangements.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Public or other nonprofit institutions</inline>.—</heading><content>A foreign institution that is a public or other nonprofit institution may enter into a written arrangement under subsection (a) only with an institution of higher education described in section 101 of such Act (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref>).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Other institutions</inline>.—</heading><content>A foreign institution that is a graduate medical school, nursing school, or a veterinary school and that is not a public or other nonprofit institution may enter into a written arrangement under subsection (a) with an institution of higher education described in section 101 or section 102 of such Act (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> and 1002).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Report on use</inline>.—</heading><chapeau>An institution of higher education that uses the authority described in paragraph (2) shall report such use to the Secretary—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> for the 2019–2020 award year, not later than <date date=\"2020-06-30\">June 30, 2020</date>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> for an award year subsequent to the 2019–2020 award year, not later than 30 days after such use.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Report from the secretary</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, and every 180 days thereafter for the duration of the qualifying emergency and the following payment period, the Secretary shall submit to the authorizing committees (as defined in section 103 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1003\">20 U.S.C. 1003</ref>)) a report that identifies each foreign institution that entered into a written arrangement authorized under subsection (a).</content>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3512\">“SEC. 3512.</num><heading> HBCU CAPITAL FINANCING.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Deferment Period.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Notwithstanding any provision of title III of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1051\">20 U.S.C. 1051</ref> et seq.), or any regulation promulgated under such title, the Secretary may grant a deferment, for the duration of a qualifying emergency, to an institution that has received a loan under part D of title III of such Act (<ref href=\"/us/usc/t20/s1066\">20 U.S.C. 1066</ref> et seq.).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Terms</inline>.—</heading><chapeau>During the deferment period granted under this subsection—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the institution shall not be required to pay any periodic installment of principal or interest required under the loan agreement for such loan; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the Secretary shall make principal and interest payments otherwise due under the loan agreement.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Closing</inline>.—</heading><content>At the closing of a loan deferred under this subsection, terms shall be set under which the institution shall be required to repay the Secretary for the payments of principal and interest made by the Secretary during the deferment, on a schedule that begins upon repayment to the lender in full on the loan agreement, except in no case shall repayment be required to begin before the date that is 1 full fiscal year after the date that is the end of the qualifying emergency.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Termination Date.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The authority provided under this section to grant a loan deferment under subsection (a) shall terminate on the date on which the qualifying emergency is no longer in effect.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Duration</inline>.—</heading><content>Any provision of a loan agreement or insurance agreement modified by the authority under this section shall remain so modified for the duration of the period covered by the loan agreement or insurance agreement.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date=\"2020-03-27\">Mar. 27, 2020</date>], and every 180 days thereafter during the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency, the Secretary shall submit to the authorizing committees (as defined in section 103 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1003\">20 U.S.C. 1003</ref>)) a report that identifies each institution that received assistance under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Funding</inline>.—</heading><content>There is hereby appropriated, out of any money in the Treasury not otherwise appropriated, $62,000,000 to carry out this section.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3513\">“SEC. 3513.</num><heading> TEMPORARY RELIEF FOR FEDERAL STUDENT LOAN BORROWERS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>The Secretary shall suspend all payments due for loans made under part D and part B (that are held by the Department of Education) of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.; 1071 et seq.) through <date date=\"2020-09-30\">September 30, 2020</date>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">No Accrual of Interest</inline>.—</heading><content>Notwithstanding any other provision of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), interest shall not accrue on a loan described under subsection (a) for which payment was suspended for the period of the suspension.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Consideration of Payments</inline>.—</heading><content>Notwithstanding any other provision of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), the Secretary shall deem each month for which a loan payment was suspended under this section as if the borrower of the loan had made a payment for the purpose of any loan forgiveness program or loan rehabilitation program authorized under part D or B of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq.; 1071 et seq.) for which the borrower would have otherwise qualified.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Reporting to Consumer Reporting Agencies</inline>.—</heading><content>During the period in which the Secretary suspends payments on a loan under subsection (a), the Secretary shall ensure that, for the purpose of reporting information about the loan to a consumer reporting agency, any payment that has been suspended is treated as if it were a regularly scheduled payment made by a borrower.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Suspending Involuntary Collection</inline>.—</heading><chapeau>During the period in which the Secretary suspends payments on a loan under subsection (a), the Secretary shall suspend all involuntary collection related to the loan, including—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> a wage garnishment authorized under section 488A of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1095a\">20 U.S.C. 1095a</ref>) or <ref href=\"/us/usc/t31/s3720D\">section 3720D of title 31</ref>, United States Code;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> a reduction of tax refund by amount of debt authorized under <ref href=\"/us/usc/t31/s3720A\">section 3720A of title 31</ref>, United States Code, or section 6402(d) of the Internal Revenue Code of 1986;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> a reduction of any other Federal benefit payment by administrative offset authorized under <ref href=\"/us/usc/t31/s3716\">section 3716 of title 31</ref>, United States Code (including a benefit payment due to an individual under the Social Security Act [<ref href=\"/us/usc/t42/s301\">42 U.S.C. 301</ref> et seq.] or any other provision described in subsection (c)(3)(A)(i) of such section); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> any other involuntary collection activity by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Waivers</inline>.—</heading><chapeau>In carrying out this section, the Secretary may waive the application of—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> subchapter I of chapter 35 of title 44, United States Code (commonly known as the ‘Paperwork Reduction Act’);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the master calendar requirements under section 482 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1089\">20 U.S.C. 1089</ref>);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> negotiated rulemaking under section 492 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1098a\">20 U.S.C. 1098a</ref>); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> the requirement to publish the notices related to the system of records of the agency before implementation required under paragraphs (4) and (11) of <ref href=\"/us/usc/t5/s552a/e\">section 552a(e) of title 5</ref>, United States Code (commonly known as the ‘Privacy Act of 1974’), except that the notices shall be published not later than 180 days after the date of enactment of this Act [<date date=\"2020-03-27\">Mar. 27, 2020</date>].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Notice to Borrowers and Transition Period</inline>.—</heading><chapeau>To inform borrowers of the actions taken in accordance with this section and ensure an effective transition, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> not later than 15 days after the date of enactment of this Act, notify borrowers—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> of the actions taken in accordance with subsections (a) and (b) for whom payments have been suspended and interest waived;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> of the actions taken in accordance with subsection (e) for whom collections have been suspended;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> of the option to continue making payments toward principal; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> that the program under this section is a temporary program.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> beginning on <date date=\"2020-08-01\">August 1, 2020</date>, carry out a program to provide not less than 6 notices by postal mail, telephone, or electronic communication to borrowers indicating—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> when the borrower’s normal payment obligations will resume; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> that the borrower has the option to enroll in income-driven repayment, including a brief description of such options.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3517\">“SEC. 3517.</num><heading> WAIVER AUTHORITY AND REPORTING REQUIREMENT FOR INSTITUTIONAL AID.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Waiver Authority</inline>.—</heading><chapeau>Notwithstanding any other provision of the Higher Education Act of 1965 ([20] U.S.C. 1001 et seq.), unless enacted with specific reference to this section, for any institution of higher education that was receiving assistance under title III, title V, or subpart 4 of part A of title VII of such Act (<ref href=\"/us/usc/t20/s1051\">20 U.S.C. 1051</ref> et seq.; 1101 et seq.; 1136a et seq.) at the time of a qualifying emergency, the Secretary may, for the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> waive—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the eligibility data requirements set forth in section 391(d) and 521(e) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1068/d\">20 U.S.C. 1068(d)</ref>; 1103(e));</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the wait-out period set forth in section 313(d) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1059/d\">20 U.S.C. 1059(d)</ref>);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> the allotment requirements under paragraphs (2) and (3) of subsection [sic] 318(e) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1059e/e\">20 U.S.C. 1059e(e)</ref>), and the reference to ‘the academic year preceding the beginning of that fiscal year’ under such section 318(e)(1);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> the allotment requirements under subsections (b), (c), and (g) of section 324 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1063\">20 U.S.C. 1063</ref>), the reference to ‘the end of the school year preceding the beginning of that fiscal year’ under such section 324(a), and the reference to ‘the academic year preceding such fiscal year’ under such section 324(h);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> subparagraphs (A), (C), (D), and (E) of section 326(f)(3) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1063b/f/3\">20 U.S.C. 1063b(f)(3)</ref>), and references to ‘previous year’ under such section 326(f)(3)(B);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> subparagraphs (A), (C), (D), and (E) of section 723(f)(3) and subparagraphs (A), (C), (D), and (E) of section 724(f)(3) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1136a/f/3\">20 U.S.C. 1136a(f)(3)</ref>; 1136b(f)(3)), and references to ‘previous academic year’ under subparagraph (B) of such sections 723(f)(3) and 724(f)(3); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"G\">“(G)</num><content> the allotment restriction set forth in section 318(d)(4) and section 323(c)(2) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1059e/d/4\">20 U.S.C. 1059e(d)(4)</ref>; 1062(c)(2)); and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> waive or modify any statutory or regulatory provision to ensure that institutions that were receiving assistance under title III, title V, or subpart 4 of part A of title VII of such Act (<ref href=\"/us/usc/t20/s1051\">20 U.S.C. 1051</ref> et seq.; 1101 et seq.; 1136a et seq.) at the time of a qualifying emergency are not adversely affected by any formula calculation for fiscal year 2020 and for the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency, as necessary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Use of Unexpended Funds</inline>.—</heading><content>Any funds paid to an institution under title III, title V, or subpart 4 of part A of title VII of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1051\">20 U.S.C. 1051</ref> et seq.; 1101 et seq.; 1136a et seq.) and not expended or used for the purposes for which the funds were paid to the institution during the 5-year period following the date on which the funds were first paid to the institution, may be carried over and expended during the succeeding 5-year period.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date=\"2020-03-27\">Mar. 27, 2020</date>], and every 180 days thereafter for the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency, the Secretary shall submit to the authorizing committees (as defined in section 103 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1003\">20 U.S.C. 1003</ref>)) a report that identifies each institution that received a waiver or modification under this section.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3518\">“SEC. 3518.</num><heading> AUTHORIZED USES AND OTHER MODIFICATIONS FOR GRANTS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>The Secretary is authorized to modify the required and allowable uses of funds for grants awarded under part A or B of title III, chapter I or II of subpart 2 of part A of title IV, title V, or subpart 4 of part A of title VII of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1057\">20 U.S.C. 1057</ref> et seq.; 1060 et seq.; 1070a–11 et seq.; 1070a–21 et seq.; 1101 et seq.; 1136a et seq.) to an institution of higher education or other grant recipient (not including individual recipients of Federal student financial assistance), at the request of an institution of higher education or other recipient of a grant (not including individual recipients of Federal student financial assistance) as a result of a qualifying emergency, for the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Matching Requirement Modifications</inline>.—</heading><content>Notwithstanding any other provision of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), the Secretary is authorized to modify any Federal share or other financial matching requirement for a grant awarded on a competitive basis or a grant awarded under part A or B of title III or subpart 4 of part A of title VII of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1057\">20 U.S.C. 1057</ref> et seq.; 1060 et seq.; 1136a et seq.) at the request of an institution of higher education or other grant recipient as a result of a qualifying emergency, for the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Reports</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date=\"2020-03-27\">Mar. 27, 2020</date>], and every 180 days thereafter for the duration of the period beginning on the first day of the qualifying emergency and ending on September 30 of the fiscal year following the end of the qualifying emergency, the Secretary shall submit to the authorizing committees (as defined in section 103 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1003\">20 U.S.C. 1003</ref>)) a report that identifies each institution of higher education or other grant recipient that received a modification under this section.</content>\n</subsection>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"3519\">“SEC. 3519.</num><heading> SERVICE OBLIGATIONS FOR TEACHERS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Teach Grants</inline>.—</heading><chapeau>For the purpose of section 420N of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070g–2\">20 U.S.C. 1070g–2</ref>), during a qualifying emergency, the Secretary—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> may modify the categories of extenuating circumstances under which a recipient of a grant under subpart 9 of part A of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1070g\">20 U.S.C. 1070g</ref> et seq.) who is unable to fulfill all or part of the recipient’s service obligation may be excused from fulfilling that portion of the service obligation; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> shall consider teaching service that, as a result of a qualifying emergency, is part-time or temporarily interrupted, to be full-time service and to fulfill the service obligations under such section 420N.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Teacher Loan Forgiveness</inline>.—</heading><chapeau>Notwithstanding section 428J or 460 of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1078–10\">20 U.S.C. 1078–10</ref>; 1087j), the Secretary shall waive the requirements under such sections that years of teaching service shall be consecutive if—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the teaching service of a borrower is temporarily interrupted due to a qualifying emergency; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> after the temporary interruption due to a qualifying emergency, the borrower resumes teaching service and completes a total of 5 years of qualifying teaching service under such sections, including qualifying teaching service performed before, during, and after such qualifying emergency.”</content>\n</paragraph>\n</subsection>\n</section>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idcfd1c5bb-4aa6-11eb-afbc-da62fdf49fd5\"><heading class=\"centered smallCaps\">Higher Education Extension</heading><p><ref href=\"/us/pl/109/81\">Pub. L. 110–300, § 1(a)</ref>, <date date=\"2008-07-31\">July 31, 2008</date>, <ref href=\"/us/stat/122/2998\">122 Stat. 2998</ref>, provided that:<quotedContent origin=\"/us/pl/110/300/s1/a\">\n<section style=\"-uslm-lc:I580467\"><num value=\"1\">“SECTION 1.</num><heading> SHORT TITLE.</heading><content><p style=\"-uslm-lc:I21\" class=\"indent0\">“This Act may be cited as the ‘Higher Education Extension Act of 2005’.</p>\n</content>\n</section>\n<section style=\"-uslm-lc:I580467\"><num value=\"2\">“SEC. 2.</num><heading> EXTENSION OF PROGRAMS.</heading><subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Extension of Duration</inline>.—</heading><content>The authorization of appropriations for, and the duration of, each program authorized under the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.) shall be extended through <date date=\"2008-08-15\">August 15, 2008</date>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Performance of Required and Authorized Functions</inline>.—</heading><chapeau>If the Secretary of Education, a State, an institution of higher education, a guaranty agency, a lender, or another person or entity—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> is required, in or for fiscal year 2004, to carry out certain acts or make certain determinations or payments under a program under the Higher Education Act of 1965, such acts, determinations, or payments shall be required to be carried out, made, or continued during the period of the extension under this section; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> is permitted or authorized, in or for fiscal year 2004, to carry out certain acts or make certain determinations or payments under a program under the Higher Education Act of 1965, such acts, determinations, or payments are permitted or authorized to be carried out, made, or continued during the period of the extension under this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Extension at Current Levels</inline>.—</heading><content>The amount authorized to be appropriated for a program described in subsection (a) during the period of extension under this section shall be the amount authorized to be appropriated for such program for fiscal year 2004, or the amount appropriated for such program for such fiscal year, whichever is greater. Except as provided in any amendment to the Higher Education Act of 1965 enacted during fiscal year 2005 or 2006, the amount of any payment required or authorized under subsection (b) in or for the period of the extension under this section shall be determined in the same manner as the amount of the corresponding payment required or authorized in or for fiscal year 2004.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Advisory Committees and Other Entities Continued</inline>.—</heading><content>Any advisory committee, interagency organization, or other entity that was, during fiscal year 2004, authorized or required to perform any function under the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.), or in relation to programs under that Act, shall continue to exist and is authorized or required, respectively, to perform such function for the period of the extension under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Additional Extension not Permitted</inline>.—</heading><content>Section 422 of the General Education Provisions Act (<ref href=\"/us/usc/t20/s1226a\">20 U.S.C. 1226a</ref>) shall not apply to further extend the authorization of appropriations for any program described in subsection (a) on the basis of the extension of such program under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Exception</inline>.—</heading><content>The programs described in subsection (a) for which the authorization of appropriations, or the duration of which, is extended by this section include provisions applicable to institutions in, and students in or from, the Freely Associated States, except that those provisions shall be applicable with respect to institutions in, and students in or from, the Federated States of Micronesia and the Republic of the Marshall Islands only to the extent specified in <ref href=\"/us/pl/108/188\">Public Law 108–188</ref> [<ref href=\"/us/usc/t48/s1921\">48 U.S.C. 1921</ref> et seq.].”</content>\n</subsection>\n</section>\n</quotedContent>\n</p>\n<p>[<ref href=\"/us/pl/110/300/s1/c\">Pub. We must encourage institutions to appropriately account for this bedrock principle in their administration of student life and to avoid creating environments that stifle competing perspectives, thereby potentially impeding beneficial research and undermining learning.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">The financial burden of higher education on students and their families is also a national problem that needs immediate attention. Over the past 30 years, college tuition and fees have grown at more than twice the rate of the Consumer Price Index. Rising student loan debt, coupled with low repayment rates, threatens the financial health of both individuals and families as well as of Federal student loan programs. In addition, too many programs of study fail to prepare students for success in today’s job market.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">The Federal Government can take meaningful steps to address these problems. Selecting an institution and course of study are important decisions for prospective students and significantly affect long-term earnings. Institutions should be transparent about the average earnings and loan repayment rates of former students who received Federal student aid. Additionally, the Federal Government should make this information readily accessible to the public and to prospective students and their families, in particular.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">This order will promote greater access to critical information regarding the prices and outcomes of postsecondary education, thereby furthering the goals of the National Council for the American Worker established by Executive Order 13845 of <date date=\"2018-07-19\">July 19, 2018</date> (Establishing the President’s National Council for the American Worker) [<ref href=\"/us/usc/t29/s3101\">29 U.S.C. 3101</ref> note]. Increased information disclosure will help ensure that individuals make educational choices suited to their needs, interests, and circumstances. Access to this information will also increase institutional accountability and encourage institutions to take into account likely future earnings when establishing the cost of their educational programs.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 2. <i>Policy</i>. It is the policy of the Federal Government to:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(a) encourage institutions to foster environments that promote open, intellectually engaging, and diverse debate, including through compliance with the First Amendment for public institutions and compliance with stated institutional policies regarding freedom of speech for private institutions;</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) help students (including workers seeking additional training) and their families understand, through better data and career counseling, that not all institutions, degrees, or fields of study provide similar returns on their investment, and consider that their educational decisions should account for the opportunity cost of enrolling in a program;</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(c) align the incentives of institutions with those of students and taxpayers to ensure that institutions share the financial risk associated with Federal student loan programs;</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(d) help borrowers avoid defaulting on their Federal student loans by educating them about risks, repayment obligations, and repayment options; and</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(e) supplement efforts by States and institutions by disseminating information to assist students in completing their degrees faster and at lower cost.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 3. <i>Improving Free Inquiry on Campus</i>. (a) To advance the policy described in subsection 2(a) of this order, the heads of covered agencies shall, in coordination with the Director of the Office of Management and Budget, take appropriate steps, in a manner consistent with applicable law, including the First Amendment, to ensure institutions that receive Federal research or education grants promote free inquiry, including through compliance with all applicable Federal laws, regulations, and policies.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) “Covered agencies” for purposes of this section are the Departments of Defense, the Interior, Agriculture, Commerce, Labor, Health and Human Services, Transportation, Energy, and Education; the Environmental Protection Agency; the National Science Foundation; and the National Aeronautics and Space Administration.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(c) “Federal research or education grants” for purposes of this section include all funding provided by a covered agency directly to an institution but do not include funding associated with Federal student aid programs that cover tuition, fees, or stipends.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 4. <i>Improving Transparency and Accountability on Campus</i>. (a) To advance the policy described in subsections 2(b)–(e) of this order, the Secretary of Education (Secretary) shall, to the extent consistent with applicable law:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(i) make available, by <date date=\"2020-01-01\">January 1, 2020</date>, through the Office of Federal Student Aid, a secure and confidential website and mobile application that informs Federal student loan borrowers of how much they owe, how much their monthly payment will be when they enter repayment, available repayment options, how long each repayment option will take, and how to enroll in the repayment option that best serves their needs;</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(ii) expand and update annually the College Scorecard, or any successor, with the following program-level data for each certificate, degree, graduate, and professional program, for former students who received Federal student aid:</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(A) estimated median earnings;</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(B) median Stafford loan debt;</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(C) median Graduate PLUS loan debt (if applicable);</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(D) median Parent PLUS loan debt; and</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(E) student loan default rate and repayment rate; and</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(iii) expand and update annually the College Scorecard, or any successor, with the following institution-level data, providing the aggregate for all certificate, degree, graduate, and professional programs, for former students who received Federal student aid:</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(A) student loan default rate and repayment rate;</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(B) Graduate PLUS default rate and repayment rate; and</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">(C) Parent PLUS default rate and repayment rate.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) For the purpose of implementing subsection (a)(ii) of this section, the Secretary of the Treasury shall, upon the request of the Secretary, provide in a timely manner appropriate statistical studies and compilations regarding program-level earnings, consistent with <ref href=\"/us/usc/t26/s6108/b\">section 6108(b) of title 26</ref>, United States Code, other applicable laws, and available data regarding programs attended by former students who received Federal student aid.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 5. <i>Reporting Requirements</i>. (a) By <date date=\"2020-01-01\">January 1, 2020</date>, the Secretary, in consultation with the Secretary of the Treasury, the Director of the Office of Management and Budget, and the Chairman of the Council of Economic Advisers, shall submit to the President, through the Assistant to the President for Domestic Policy and the Assistant to the President for Economic Policy, a report identifying and analyzing policy options for sharing the risk associated with Federal student loan debt among the Federal Government, institutions, and other entities.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) By <date date=\"2020-01-01\">January 1, 2020</date>, the Secretary, in consultation with the Secretary of the Treasury, shall submit to the President, through the Assistant to the President for Domestic Policy and the Assistant to the President for Economic Policy, policy recommendations for reforming the collections process for Federal student loans in default.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(c) Beginning <date date=\"2019-07-01\">July 1, 2019</date>, the Secretary shall provide an annual update on the Secretary’s progress in implementing the policies set forth in subsections 2(b)–(e) of this order to the National Council for the American Worker at meetings of the Council.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(d) Within 1 year of the date of this order [<date date=\"2019-03-21\">Mar. 21, 2019</date>], the Secretary shall compile information about successful State and institutional efforts to promote students’ timely and affordable completion of a postsecondary program of study. Based on that information, the Secretary shall publish a compilation of research results that addresses:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(i) how some States and institutions have better facilitated successful transfer of credits and degree completion by transfer students;</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(ii) how States and institutions can increase access to dual enrollment programs; and</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(iii) other strategies for increasing student success, especially among students at high risk of not completing a postsecondary program of study.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 6. <i>General Provisions</i>. (a) Nothing in this order shall be construed to impair or otherwise affect:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(i) the authority granted by law to an executive department or agency, or the head thereof; or</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</p>\n<signature>\n<name>Donald J.
