<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id80f3bdf5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002"><num value="1002">§ 1002.</num><heading> Definition of institution of higher education for purposes of student assistance programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id80f3bdf6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of institution of higher education for purposes of student assistance programs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3bdf7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Inclusion of additional institutions</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraphs (2) through (4) of this subsection, the term “institution of higher education” for purposes of subchapter IV includes, in addition to the institutions covered by the definition in <ref href="/us/usc/t20/s1001">section 1001 of this title</ref>—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3bdf8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/1/A"><num value="A">(A)</num><content> a proprietary institution of higher education (as defined in subsection (b) of this section);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3bdf9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/1/B"><num value="B">(B)</num><content> a postsecondary vocational institution (as defined in subsection (c) of this section); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3bdfa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/1/C"><num value="C">(C)</num><content> only for the purposes of part D of subchapter IV, an institution outside the United States that is comparable to an institution of higher education as defined in <ref href="/us/usc/t20/s1001">section 1001 of this title</ref> and that has been approved by the Secretary for the purpose of part D of subchapter IV, consistent with the requirements of <ref href="/us/usc/t20/s1087b/d">section 1087b(d) of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3bdfb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Institutions outside the United States</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id80f3bdfc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">For the purpose of qualifying as an institution under paragraph (1)(C), the Secretary shall establish criteria by regulation for the approval of institutions outside the United States and for the determination that such institutions are comparable to an institution of higher education as defined in <ref href="/us/usc/t20/s1001">section 1001 of this title</ref> (except that a graduate medical school, nursing school, or a veterinary school, located outside the United States shall not be required to meet the requirements of <ref href="/us/usc/t20/s1001/a/4">section 1001(a)(4) of this title</ref>). Such criteria shall include a requirement that a student attending such school outside the United States is ineligible for loans made under part D of subchapter IV unless—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id80f3bdfd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i"><num value="i">(i)</num><chapeau> except as provided in subparagraph (B)(iii)(IV), in the case of a graduate medical school located outside the United States—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id80f3bdfe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/I"><num value="I">(I)</num><item style="-uslm-lc:I16" class="indent4" id="id80f3bdff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/I/aa"><num value="aa">(aa)</num><content> at least 60 percent of those enrolled in, and at least 60 percent of the graduates of, the graduate medical school outside the United States were not persons described in <ref href="/us/usc/t20/s1091/a/5">section 1091(a)(5) of this title</ref> in the year preceding the year for which a student is seeking a loan under part D of subchapter IV; and</content>
</item>
<item style="-uslm-lc:I16" class="indent4" id="id80f3be00-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/I/bb"><num value="bb">(bb)</num><content> at least 75 percent of the individuals who were students or graduates of the graduate medical school outside the United States or Canada (both nationals of the United States and others) taking the examinations administered by the Educational Commission for Foreign Medical Graduates received a passing score in the year preceding the year for which a student is seeking a loan under part D of subchapter IV; or</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be01-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/II"><num value="II">(II)</num><chapeau> the institution—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id80f3be02-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/II/aa"><num value="aa">(aa)</num><content> has or had a clinical training program that was approved by a State as of <date date="1992-01-01">January 1, 1992</date>; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be03-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/i/II/bb"><num value="bb">(bb)</num><content> continues to operate a clinical training program in at least one State that is approved by that State;</content>
</item>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id80f3be04-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/ii"><num value="ii">(ii)</num><content> in the case of a veterinary school located outside the United States that does not meet the requirements of <ref href="/us/usc/t20/s1001/a/4">section 1001(a)(4) of this title</ref>, the institution’s students complete their clinical training at an approved veterinary school located in the United States; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id80f3be05-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii"><num value="iii">(iii)</num><chapeau> in the case of a nursing school located outside of the United States—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id80f3be06-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii/I"><num value="I">(I)</num><content> the nursing school has an agreement with a hospital, or accredited school of nursing (as such terms are defined in <ref href="/us/usc/t42/s296">section 296 of title 42</ref>), located in the United States that requires the students of the nursing school to complete the students’ clinical training at such hospital or accredited school of nursing;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be07-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii/II"><num value="II">(II)</num><content> the nursing school has an agreement with an accredited school of nursing located in the United States providing that the students graduating from the nursing school located outside of the United States also receive a degree from the accredited school of nursing located in the United States;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be08-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii/III"><num value="III">(III)</num><content> the nursing school certifies only Federal Direct Stafford Loans under <ref href="/us/usc/t20/s1087e/a/2/A">section 1087e(a)(2)(A) of this title</ref>, Federal Direct Unsubsidized Stafford Loans under <ref href="/us/usc/t20/s1087e/a/2/D">section 1087e(a)(2)(D) of this title</ref>, or Federal Direct PLUS Loans under <ref href="/us/usc/t20/s1087e/a/2/B">section 1087e(a)(2)(B) of this title</ref> for students attending the institution;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be09-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii/IV"><num value="IV">(IV)</num><content> the nursing school reimburses the Secretary for the cost of any loan defaults for current and former students included in the calculation of the institution’s cohort default rate during the previous fiscal year; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be0a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/A/iii/V"><num value="V">(V)</num><content> not less than 75 percent of the individuals who were students or graduates of the nursing school, and who took the National Council Licensure Examination for Registered Nurses in the year preceding the year for which the institution is certifying a Federal Direct Stafford Loan under <ref href="/us/usc/t20/s1087e/a/2/A">section 1087e(a)(2)(A) of this title</ref>, a Federal Direct Unsubsidized Stafford Loan under <ref href="/us/usc/t20/s1087e/a/2/D">section 1087e(a)(2)(D) of this title</ref>, or a Federal Direct PLUS Loan under <ref href="/us/usc/t20/s1087e/a/2/B">section 1087e(a)(2)(B) of this title</ref>, received a passing score on such examination.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id80f3be0b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Advisory panel</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id80f3be0c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">For the purpose of qualifying as an institution under paragraph (1)(C) of this subsection, the Secretary shall establish an advisory panel of medical experts that shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id80f3be0d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/i/I"><num value="I">(I)</num><content> evaluate the standards of accreditation applied to applicant foreign medical schools; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id80f3be0e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/i/II"><num value="II">(II)</num><content> determine the comparability of those standards to standards for accreditation applied to United States medical schools.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id80f3be0f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I14" class="indent3">If the accreditation standards described in clause (i) are determined not to be comparable, the foreign medical school shall be required to meet the requirements of <ref href="/us/usc/t20/s1001">section 1001 of this title</ref>.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id80f3be10-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Report</heading><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id80f3be11-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I16" class="indent4">Not later than 1 year after <date date="2008-08-14">August 14, 2008</date>, the advisory panel described in clause (i) shall submit a report to the Secretary and to the authorizing committees recommending eligibility criteria for participation in the loan programs under part D of subchapter IV for graduate medical schools that—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id80f3be12-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/I/aa"><num value="aa">(aa)</num><content> are located outside of the United States;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be13-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/I/bb"><num value="bb">(bb)</num><content> do not meet the requirements of subparagraph (A)(i); and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be14-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/I/cc"><num value="cc">(cc)</num><content> have a clinical training program approved by a State prior to <date date="2008-01-01">January 1, 2008</date>.</content>
</item>
</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id80f3be15-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II"><num value="II" class="bold">(II)</num><heading class="bold"> Recommendations</heading><chapeau style="-uslm-lc:I16" class="indent4">In the report described in subclause (I), the advisory panel’s eligibility criteria shall include recommendations regarding the appropriate levels of performance for graduate medical schools described in such subclause in the following areas:</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id80f3be16-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/aa"><num value="aa">(aa)</num><content> Entrance requirements.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be17-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/bb"><num value="bb">(bb)</num><content> Retention and graduation rates.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be18-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/cc"><num value="cc">(cc)</num><content> Successful placement of students in United States medical residency programs.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be19-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/dd"><num value="dd">(dd)</num><content> Passage rate of students on the United States Medical Licensing Examination.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be1a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/ee"><num value="ee">(ee)</num><content> The extent to which State medical boards have assessed the quality of such school’s program of instruction, including through on-site reviews.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be1b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/ff"><num value="ff">(ff)</num><content> The extent to which graduates of such schools would be unable to practice medicine in 1 or more States, based on the judgment of a State medical board.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be1c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/gg"><num value="gg">(gg)</num><content> Any areas recommended by the Comptroller General of the United States under section 1101 of the Higher Education Opportunity Act.</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be1d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/II/hh"><num value="hh">(hh)</num><content> Any additional areas the Secretary may require.</content>
</item>
</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id80f3be1e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/III"><num value="III" class="bold">(III)</num><heading class="bold"> Minimum eligibility requirement</heading><content><p style="-uslm-lc:I16" class="indent4">In the recommendations described in subclause (II), the criteria described in subparagraph (A)(i)(I)(bb) shall be a minimum eligibility requirement for a graduate medical school described in subclause (I) to participate in the loan programs under part D of subchapter IV.</p>
</content>
</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id80f3be1f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/IV"><num value="IV" class="bold">(IV)</num><heading class="bold"> Authority</heading><chapeau style="-uslm-lc:I16" class="indent4">The Secretary may—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id80f3be20-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/IV/aa"><num value="aa">(aa)</num><content> not earlier than 180 days after the submission of the report described in subclause (I), issue proposed regulations establishing criteria for the eligibility of graduate medical schools described in such subclause to participate in the loan programs under part D of subchapter IV based on the recommendations of such report; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id80f3be21-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/B/iii/IV/bb"><num value="bb">(bb)</num><content> not earlier than one year after the issuance of proposed regulations under item (aa), issue final regulations establishing such criteria for eligibility.</content>
</item>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id80f3be22-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Failure to release information</heading><content><p style="-uslm-lc:I13" class="indent2">The failure of an institution outside the United States to provide, release, or authorize release to the Secretary of such information as may be required by subparagraph (A) shall render such institution ineligible for the purpose of part D of subchapter IV.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id80f3be23-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I13" class="indent2">If, pursuant to this paragraph, an institution loses eligibility to participate in the programs under subchapter IV, then a student enrolled at such institution may, notwithstanding such loss of eligibility, continue to be eligible to receive a loan under part D of subchapter IV while attending such institution for the academic year succeeding the academic year in which such loss of eligibility occurred.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3be24-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitations based on course of study or enrollment</heading><chapeau style="-uslm-lc:I12" class="indent1">An institution shall not be considered to meet the definition of an institution of higher education in paragraph (1) if such institution—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be25-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/3/A"><num value="A">(A)</num><content> offers more than 50 percent of such institution’s courses by correspondence (excluding courses offered by telecommunications as defined in section 1091(<i>l</i>)(4) <ref class="footnoteRef" idref="fn002023">1</ref><note type="footnote" id="fn002023"><num>1</num> See References in Text note below.</note> of this title), unless the institution is an institution that meets the definition in <ref href="/us/usc/t20/s2302/3/C">section 2302(3)(C) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be26-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/3/B"><num value="B">(B)</num><content> enrolls 50 percent or more of the institution’s students in correspondence courses (excluding courses offered by telecommunications as defined in section 1091(<i>l</i>)(4) <sup>1</sup> of this title), unless the institution is an institution that meets the definition in such section, except that the Secretary, at the request of such institution, may waive the applicability of this subparagraph to such institution for good cause, as determined by the Secretary in the case of an institution of higher education that provides a 2- or 4-year program of instruction (or both) for which the institution awards an associate or baccalaureate degree, respectively;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be27-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/3/C"><num value="C">(C)</num><content> has a student enrollment in which more than 25 percent of the students are incarcerated, except that the Secretary may waive the limitation contained in this subparagraph for a nonprofit institution that provides a 2- or 4-year program of instruction (or both) for which the institution awards a bachelor’s degree, or an associate’s degree or a postsecondary diploma, respectively; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be28-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/3/D"><num value="D">(D)</num><content> has a student enrollment in which more than 50 percent of the students do not have a secondary school diploma or its recognized equivalent, and does not provide a 2- or 4-year program of instruction (or both) for which the institution awards a bachelor’s degree or an associate’s degree, respectively, except that the Secretary may waive the limitation contained in this subparagraph if a nonprofit institution demonstrates to the satisfaction of the Secretary that the institution exceeds such limitation because the institution serves, through contracts with Federal, State, or local government agencies, significant numbers of students who do not have a secondary school diploma or its recognized equivalent.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3be29-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Limitations based on management</heading><chapeau style="-uslm-lc:I12" class="indent1">An institution shall not be considered to meet the definition of an institution of higher education in paragraph (1) if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be2a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/4/A"><num value="A">(A)</num><content> the institution, or an affiliate of the institution that has the power, by contract or ownership interest, to direct or cause the direction of the management or policies of the institution, has filed for bankruptcy, except that this paragraph shall not apply to a nonprofit institution, the primary function of which is to provide health care educational services (or an affiliate of such an institution that has the power, by contract or ownership interest, to direct or cause the direction of the institution’s management or policies) that files for bankruptcy under chapter 11 of title 11 between <date date="1998-07-01">July 1, 1998</date>, and <date date="1998-12-01">December 1, 1998</date>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be2b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/4/B"><num value="B">(B)</num><content> the institution, the institution’s owner, or the institution’s chief executive officer has been convicted of, or has pled nolo contendere or guilty to, a crime involving the acquisition, use, or expenditure of funds under subchapter IV, or has been judicially determined to have committed fraud involving funds under subchapter IV.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3be2c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Certification</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall certify an institution’s qualification as an institution of higher education in accordance with the requirements of subpart 3 of part H of subchapter IV.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3be2d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Loss of eligibility</heading><content><p style="-uslm-lc:I12" class="indent1">An institution of higher education shall not be considered to meet the definition of an institution of higher education in paragraph (1) if such institution is removed from eligibility for funds under subchapter IV as a result of an action pursuant to part H of subchapter IV.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id80f3be2e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b"><num value="b" class="bold">(b)</num><heading class="bold"> Proprietary institution of higher education</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80f3be2f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Principal criteria</heading><chapeau style="-uslm-lc:I12" class="indent1">For the purpose of this section, the term “proprietary institution of higher education” means a school that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be30-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="id80f3be31-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/A/i"><num value="i">(i)</num><content> provides an eligible program of training to prepare students for gainful employment in a recognized occupation; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id80f3be32-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/A/ii"><num value="ii">(ii)</num><subclause style="-uslm-lc:I13" class="indent2" id="id80f3be33-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/A/ii/I"><num value="I">(I)</num><content> provides a program leading to a baccalaureate degree in liberal arts, and has provided such a program since <date date="2009-01-01">January 1, 2009</date>; and</content>
</subclause>
<subclause style="-uslm-lc:I13" class="indent2" id="id80f3be34-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/A/ii/II"><num value="II">(II)</num><content> is accredited by a recognized regional accrediting agency or association, and has continuously held such accreditation since <date date="2007-10-01">October 1, 2007</date>, or earlier;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be35-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/B"><num value="B">(B)</num><content> meets the requirements of paragraphs (1) and (2) of <ref href="/us/usc/t20/s1001/a">section 1001(a) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be36-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/C"><num value="C">(C)</num><content> does not meet the requirement of paragraph (4) of <ref href="/us/usc/t20/s1001/a">section 1001(a) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be37-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/D"><num value="D">(D)</num><content> is accredited by a nationally recognized accrediting agency or association recognized by the Secretary pursuant to part H of subchapter IV; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80f3be38-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1002/b/1/E"><num value="E">(E)</num><content> has been in existence for at least 2 years.</content>
