L. 114–95, title IX, § 9215(oo)(1), Dec. 10, 2015, 129 Stat. 2177.)","seq_in_title":381,"parent_identifier":"/us/usc/t20/ch28/schI/ptA","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28","level":"chapter","num":"CHAPTER 28—","heading":"HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schI/ptA","level":"part","num":"Part A—","heading":"Definitions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id80f62e4f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003\"><num value=\"1003\">§ 1003.</num><heading> Additional definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this chapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e50-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authorizing committees</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “authorizing committees” means the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e51-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Combination of institutions of higher education</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “combination of institutions of higher education” means a group of institutions of higher education that have entered into a cooperative arrangement for the purpose of carrying out a common objective, or a public or private nonprofit agency, organization, or institution designated or created by a group of institutions of higher education for the purpose of carrying out a common objective on the group’s behalf.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e52-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Critical foreign language</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as otherwise provided, the term “critical foreign language” means each of the languages contained in the list of critical languages designated by the Secretary in the Federal Register on <date date=\"1985-08-02\">August 2, 1985</date> (50 Fed. Reg. 31412; promulgated under the authority of section 212(d) of the Education for Economic Security Act (repealed by section 2303 of the Augustus F. Hawkins-Robert T. Stafford Elementary and Secondary School Improvement Amendments of 1988)), as updated by the Secretary from time to time and published in the Federal Register, except that in the implementation of this definition with respect to a specific title, the Secretary may set priorities according to the purposes of such title and the national security, economic competitiveness, and educational needs of the United States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e53-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Department</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Department” means the Department of Education.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e54-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Diploma mill</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “diploma mill” means an entity that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e55-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e56-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/A/i\"><num value=\"i\">(i)</num><content> offers, for a fee, degrees, diplomas, or certificates, that may be used to represent to the general public that the individual possessing such a degree, diploma, or certificate has completed a program of postsecondary education or training; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e57-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/A/ii\"><num value=\"ii\">(ii)</num><content> requires such individual to complete little or no education or coursework to obtain such degree, diploma, or certificate; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e58-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/B\"><num value=\"B\">(B)</num><chapeau> lacks accreditation by an accrediting agency or association that is recognized as an accrediting agency or association of institutions of higher education (as such term is defined in <ref href=\"/us/usc/t20/s1002\">section 1002 of this title</ref>) by—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e59-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/B/i\"><num value=\"i\">(i)</num><content> the Secretary pursuant to subpart 2 of part H of subchapter IV; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e5a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/5/B/ii\"><num value=\"ii\">(ii)</num><content> a Federal agency, State government, or other organization or association that recognizes accrediting agencies or associations.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e5b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Disability</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “disability” has the same meaning given that term under <ref href=\"/us/usc/t42/s12102/2\">section 12102(2) of title 42</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e5c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Distance education</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id80f62e5d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Except as otherwise provided, the term “distance education” means education that uses one or more of the technologies described in subparagraph (B)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e5e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/A/i\"><num value=\"i\">(i)</num><content> to deliver instruction to students who are separated from the instructor; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e5f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/A/ii\"><num value=\"ii\">(ii)</num><content> to support regular and substantive interaction between the students and the instructor, synchronously or asynchronously.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id80f62e60-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Inclusions</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">For the purposes of subparagraph (A), the technologies used may include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e61-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/B/i\"><num value=\"i\">(i)</num><content> the Internet;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e62-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/B/ii\"><num value=\"ii\">(ii)</num><content> one-way and two-way transmissions through open broadcast, closed circuit, cable, microwave, broadband lines, fiber optics, satellite, or wireless communications devices;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e63-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/B/iii\"><num value=\"iii\">(iii)</num><content> audio conferencing; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e64-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/7/B/iv\"><num value=\"iv\">(iv)</num><content> video cassettes, DVDs, and CD–ROMs, if the cassettes, DVDs, or CD–ROMs are used in a course in conjunction with any of the technologies listed in clauses (i) through (iii).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e65-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Early childhood education program</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “early childhood education program” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e66-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/A\"><num value=\"A\">(A)</num><content> a Head Start program or an Early Head Start program carried out under the Head Start Act (<ref href=\"/us/usc/t42/s9831\">42 U.S.C. 9831</ref> et seq.), including a migrant or seasonal Head Start program, an Indian Head Start program, or a Head Start program or an Early Head Start program that also receives State funding;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e67-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/B\"><num value=\"B\">(B)</num><content> a State licensed or regulated child care program; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e68-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C\"><num value=\"C\">(C)</num><chapeau> a program that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e69-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C/i\"><num value=\"i\">(i)</num><content> serves children from birth through age six that addresses the children’s cognitive (including language, early literacy, and early mathematics), social, emotional, and physical development; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id80f62e6a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C/ii\"><num value=\"ii\">(ii)</num><chapeau> is—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id80f62e6b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C/ii/I\"><num value=\"I\">(I)</num><content> a State prekindergarten program;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id80f62e6c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C/ii/II\"><num value=\"II\">(II)</num><content> a program authorized under section 619 [<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>] or part C of the Individuals with Disabilities Education Act [<ref href=\"/us/usc/t20/s1431\">20 U.S.C. 1431</ref> et seq.]; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id80f62e6d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/8/C/ii/III\"><num value=\"III\">(III)</num><content> a program operated by a local educational agency.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e6e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Elementary school</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “elementary school” has the same meaning given that term under <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e6f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Gifted and talented</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “gifted and talented” has the same meaning given that term under <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e70-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Local educational agency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “local educational agency” has the same meaning given that term under <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e71-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> New borrower</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “new borrower” when used with respect to any date means an individual who on that date has no outstanding balance of principal or interest owing on any loan made, insured, or guaranteed under subchapter IV.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e72-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Nonprofit</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “nonprofit” as applied to a school, agency, organization, or institution means a school, agency, organization, or institution owned and operated by one or more nonprofit corporations or associations, no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e73-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Poverty line</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “poverty line” means the poverty line (as defined in <ref href=\"/us/usc/t42/s9902/2\">section 9902(2) of title 42</ref>) applicable to a family of the size involved.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e74-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> School or department of divinity</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “school or department of divinity” means an institution, or a department or a branch of an institution, the program of instruction of which is designed for the education of students—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e75-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/15/A\"><num value=\"A\">(A)</num><content> to prepare the students to become ministers of religion or to enter upon some other religious vocation (or to provide continuing training for any such vocation); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id80f62e76-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/15/B\"><num value=\"B\">(B)</num><content> to prepare the students to teach theological subjects.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e77-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Secondary school</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “secondary school” has the same meaning given that term under <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e78-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/17\"><num value=\"17\" class=\"bold\">(17)</num><heading class=\"bold\"> Secretary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Secretary” means the Secretary of Education.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e79-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/18\"><num value=\"18\" class=\"bold\">(18)</num><heading class=\"bold\"> Service-learning</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “service-learning” has the same meaning given that term under section 12511(23) <ref class=\"footnoteRef\" idref=\"fn002024\">1</ref><note type=\"footnote\" id=\"fn002024\"><num>1</num> See References in Text note below.</note> of title 42.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e7a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/19\"><num value=\"19\" class=\"bold\">(19)</num><heading class=\"bold\"> Special education teacher</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “special education teacher” means teachers who teach children with disabilities as defined in section 602 of the Individuals with Disabilities Education Act.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e7b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/20\"><num value=\"20\" class=\"bold\">(20)</num><heading class=\"bold\"> State educational agency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State educational agency” has the same meaning given that term under <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id80f62e7c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1003/21\"><num value=\"21\" class=\"bold\">(21)</num><heading class=\"bold\"> State;
