For the purposes of this section, the term “PBO” includes the Chief Operating Officer of the PBO and any employee of the PBO exercising procurement authority under the preceding sentence.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81152805-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Except as provided in this section, the PBO shall abide by all applicable Federal procurement laws and regulations when procuring property and services. The PBO shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81152806-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b/1\"><num value=\"1\">(1)</num><content> enter into contracts to carry out the functions set forth in <ref href=\"/us/usc/t20/s1018/b/2\">section 1018(b)(2) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81152807-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b/2\"><num value=\"2\">(2)</num><content> obtain the services of experts and consultants without regard to <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref> and set pay in accordance with such section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81152808-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b/3\"><num value=\"3\">(3)</num><chapeau> through the Chief Operating Officer—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81152809-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b/3/A\"><num value=\"A\">(A)</num><content> to the maximum extent practicable, utilize procurement systems that streamline operations, improve internal controls, and enhance management; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8115280a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/b/3/B\"><num value=\"B\">(B)</num><content> assess the efficiency of such systems and assess such systems’ ability to meet PBO requirements.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8115280b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Service contracts</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8115280c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Performance-based servicing contracts</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Chief Operating Officer shall, to the extent practicable, maximize the use of performance-based servicing contracts, consistent with guidelines for such contracts published by the Office of Federal Procurement Policy, to achieve cost savings and improve service.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8115280d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Fee for service arrangements</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Chief Operating Officer shall, when appropriate and consistent with the purposes of the PBO, acquire services related to the functions set forth in <ref href=\"/us/usc/t20/s1018/b/2\">section 1018(b)(2) of this title</ref> from any entity that has the capability and capacity to meet the requirements set by the PBO. The Chief Operating Officer is authorized to pay fees that are equivalent to those paid by other entities to an organization that provides services that meet the requirements of the PBO, as determined by the Chief Operating Officer.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8115280e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Two-phase source-selection procedures</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8115280f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The PBO may use a two-phase process for selecting a source for a procurement of property or services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152810-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> First phase</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The procedures for the first phase of the process for a procurement are as follows:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81152811-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Publication of notice</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The contracting officer for the procurement shall publish a notice of the procurement in accordance with <ref href=\"/us/usc/t41/s1708\">section 1708 of title 41</ref> and subsections (e), (f), and (g) of <ref href=\"/us/usc/t15/s637\">section 637 of title 15</ref>, except that the notice shall include only the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81152812-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/A/i\"><num value=\"i\">(i)</num><content> A general description of the scope or purpose of the procurement that provides sufficient information on the scope or purpose for sources to make informed business decisions regarding whether to participate in the procurement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81152813-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> A description of the basis on which potential sources are to be selected to submit offers in the second phase.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81152814-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/A/iii\"><num value=\"iii\">(iii)</num><content> A description of the information that is to be required under subparagraph (B).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81152815-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/A/iv\"><num value=\"iv\">(iv)</num><content> Any additional information that the contracting officer determines appropriate.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81152816-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Information submitted by offerors</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each offeror for the procurement shall submit basic information, such as information on the offeror’s qualifications, the proposed conceptual approach, costs likely to be associated with the proposed conceptual approach, and past performance of the offeror, together with any additional information that is requested by the contracting officer.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81152817-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Selection for second phase</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The contracting officer shall select the offerors that are to be eligible to participate in the second phase of the process. The contracting officer shall limit the number of the selected offerors to the number of sources that the contracting officer determines is appropriate and in the best interests of the Federal Government.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152818-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Second phase</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81152819-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The contracting officer shall conduct the second phase of the source selection process in accordance with sections 3306(a) to (e) and 3308, chapter 37, and <ref href=\"/us/usc/t41/s4702\">section 4702 of title 41</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8115281a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Eligible participants</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Only the sources selected in the first phase of the process shall be eligible to participate in the second phase.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8115281b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Single or multiple procurements</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The second phase may include a single procurement or multiple procurements within the scope, or for the purpose, described in the notice pursuant to paragraph (2)(A).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8115281c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Procedures considered competitive</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The procedures used for selecting a source for a procurement under this subsection shall be considered competitive procedures for all purposes.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8115281d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Use of simplified procedures for commercial products and commercial services</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the PBO anticipates that commercial products or commercial services will be offered for a procurement, the PBO may use (consistent with the special rules for commercial products and commercial services) the special simplified procedures for the procurement without regard to any dollar limitation otherwise applicable to the use of those procedures.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8115281e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Flexible wait periods and deadlines for submission of offers of noncommercial products and services</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8115281f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out a procurement, the PBO may—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81152820-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f/1/A\"><num value=\"A\">(A)</num><content> apply a shorter waiting period for the issuance of a solicitation after the publication of a notice under <ref href=\"/us/usc/t41/s1708\">section 1708 of title 41</ref> than is required under subsection (a)(3)(A) of such section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81152821-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f/1/B\"><num value=\"B\">(B)</num><content> notwithstanding subsection (a)(3) of such section, establish any deadline for the submission of bids or proposals that affords potential offerors a reasonable opportunity to respond to the solicitation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152822-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Inapplicability to commercial products and services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Paragraph (1) does not apply to a procurement of a commercial product or a commercial service.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152823-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Consistency with applicable international agreements</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If an international agreement is applicable to the procurement, any exercise of authority under paragraph (1) shall be consistent with the international agreement.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81152824-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Modular contracting</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152825-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The PBO may satisfy the requirements of the PBO for a system incrementally by carrying out successive procurements of modules of the system. In doing so, the PBO may use procedures authorized under this subsection to procure any such module after the first module.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81152826-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Utility requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A module may not be procured for a system under this subsection unless the module is useful independently of the other modules or useful in combination with another module previously procured for the system.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179927-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Conditions for use of authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The PBO may use procedures authorized under paragraph (4) for the procurement of an additional module for a system if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81179928-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3/A\"><num value=\"A\">(A)</num><content> competitive procedures were used for awarding the contract for the procurement of the first module for the system; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81179929-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3/B\"><num value=\"B\">(B)</num><chapeau> the solicitation for the first module included—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8117992a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3/B/i\"><num value=\"i\">(i)</num><content> a general description of the entire system that was sufficient to provide potential offerors with reasonable notice of the general scope of future modules;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8117992b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3/B/ii\"><num value=\"ii\">(ii)</num><content> other information sufficient for potential offerors to make informed business judgments regarding whether to submit offers for the contract for the first module; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8117992c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/3/B/iii\"><num value=\"iii\">(iii)</num><content> a statement that procedures authorized under this subsection could be used for awarding subsequent contracts for the procurement of additional modules for the system.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117992d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Procedures</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">If the procurement of the first module for a system meets the requirements set forth in paragraph (3), the PBO may award a contract for the procurement of an additional module for the system using any of the following procedures:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8117992e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Single-source basis</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Award of the contract on a single-source basis to a contractor who was awarded a contract for a module previously procured for the system under competitive procedures or procedures authorized under subparagraph (B).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8117992f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Adequate competition</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Award of the contract on the basis of offers made by—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81179930-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4/B/i\"><num value=\"i\">(i)</num><content> a contractor who was awarded a contract for a module previously procured for the system after having been selected for award of the contract under this subparagraph or other competitive procedures; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81179931-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4/B/ii\"><num value=\"ii\">(ii)</num><content> at least one other offeror that submitted an offer for a module previously procured for the system and is expected, on the basis of the offer for the previously procured module, to submit a competitive offer for the additional module.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81179932-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Other</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Award of the contract under any other procedure authorized by law.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179933-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Notice requirement</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81179934-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Publication</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not less than 30 days before issuing a solicitation for offers for a contract for a module for a system under procedures authorized under subparagraph (A) or (B) of paragraph (4), the PBO shall publish in the Commerce Business Daily a notice of the intent to use such procedures to enter into the contract.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81179935-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Publication of a notice is not required under this paragraph with respect to a use of procedures authorized under paragraph (4) if the contractor referred to in that subparagraph (who is to be solicited to submit an offer) has previously provided a module for the system under a contract that contained cost, schedule, and performance goals and the contractor met those goals.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81179936-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/5/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Content of notice</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A notice published under subparagraph (A) with respect to a use of procedures described in paragraph (4) shall contain the information required under <ref href=\"/us/usc/t41/s1708/c\">section 1708(c) of title 41</ref>, other than paragraph (4) of such section, and shall invite the submission of any assertion that the use of the procedures for the procurement involved is not in the best interest of the Federal Government together with information supporting the assertion.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179937-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Documentation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The basis for an award of a contract under this subsection shall be documented. However, a justification pursuant to <ref href=\"/us/usc/t41/s3304/e\">section 3304(e) of title 41</ref> or <ref href=\"/us/usc/t15/s637/h\">section 637(h) of title 15</ref> is not required.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179938-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/g/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Simplified source-selection procedures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The PBO may award a contract under any other simplified procedures prescribed by the PBO for the selection of sources for the procurement of modules for a system, after the first module, that are not to be procured under a contract awarded on a single-source basis.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81179939-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Use of simplified procedures for small business set-asides for services other than commercial services</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117993a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The PBO may use special simplified procedures for a procurement of services that are not commercial services if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8117993b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/1/A\"><num value=\"A\">(A)</num><content> the procurement is in an amount not greater than $1,000,000;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8117993c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/1/B\"><num value=\"B\">(B)</num><content> the procurement is conducted as a small business set-aside pursuant to <ref href=\"/us/usc/t15/s644/a\">section 644(a) of title 15</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8117993d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/1/C\"><num value=\"C\">(C)</num><content> the price charged for supplies associated with the services procured are items of supply expected to be less than 20 percent of the total contract price.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117993e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Inapplicability to certain procurements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The authority set forth in paragraph (1) may not be used for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8117993f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/2/A\"><num value=\"A\">(A)</num><content> an award of a contract on a single-source basis; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81179940-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/h/2/B\"><num value=\"B\">(B)</num><content> a contract for construction.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81179941-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Guidance for use of authority</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179942-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Issuance by PBO</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Chief Operating Officer of the PBO, in consultation with the Administrator for Federal Procurement Policy, shall issue guidance for the use by PBO personnel of the authority provided in this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179943-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/i/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Guidance from OFPP</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">As part of the consultation required under paragraph (1), the Administrator for Federal Procurement Policy shall provide the PBO with guidance that is designed to ensure, to the maximum extent practicable, that the authority under this section is exercised by the PBO in a manner that is consistent with the exercise of the authority by the heads of the other performance-based organizations.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179944-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/i/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Compliance with OFPP guidance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The head of the PBO shall ensure that the procurements of the PBO under this section are carried out in a manner that is consistent with the guidance provided for the PBO under paragraph (2).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81179945-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Limitation on multiagency contracting</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No department or agency of the Federal Government may purchase property or services under contracts entered into or administered by a PBO under this section unless the purchase is approved in advance by the senior procurement official of that department or agency who is responsible for purchasing by the department or agency.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81179946-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Laws not affected</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to waive laws for the enforcement of civil rights or for the establishment and enforcement of labor standards that are applicable to contracts of the Federal Government.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81179947-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179948-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Commercial product</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “commercial product” has the meaning given the term in <ref href=\"/us/usc/t41/s103\">section 103 of title 41</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81179949-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Commercial service</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “commercial service” has the meaning given the term in <ref href=\"/us/usc/t41/s103a\">section 103a of title 41</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117994a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Competitive procedures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “competitive procedures” has the meaning given the term in <ref href=\"/us/usc/t41/s152\">section 152 of title 41</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117994b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Single-source basis</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “single-source basis”, with respect to an award of a contract, means that the contract is awarded to a source after soliciting an offer or offers from, and negotiating with, only such source (although such source is not the only source in the marketplace capable of meeting the need) because such source is the most advantageous source for purposes of the award.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8117994c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1018a/l/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Special rules for commercial products and commercial services</heading><content><p
