<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id81283aaf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036"><num value="1036">§ 1036.</num><heading> Graduate fellowships to prepare faculty in high-need areas at colleges of education</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283ab0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall make grants to eligible institutions to enable such institutions to make graduate fellowship awards to qualified individuals in accordance with the provisions of this section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283ab1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible institutions</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “eligible institution” means an institution of higher education, or a consortium of such institutions, that offers a program of postbaccalaureate study leading to a doctoral degree.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283ab2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/c"><num value="c" class="bold">(c)</num><heading class="bold"> Applications</heading><content><p style="-uslm-lc:I11" class="indent0">An eligible institution that desires a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283ab3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d"><num value="d" class="bold">(d)</num><heading class="bold"> Types of fellowships supported</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81283ab4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible institution that receives a grant under this section shall use the grant funds to provide graduate fellowships to individuals who are preparing for the professorate in order to prepare individuals to become elementary school and secondary school mathematics and science teachers, special education teachers, and teachers who provide instruction for limited English proficient students, who meet the applicable State certification and licensure requirements, including any requirements for certification obtained through alternative routes to certification, or, with regard to special education teachers, the qualifications described in <ref href="/us/usc/t20/s1412/a/14/C">section 1412(a)(14)(C) of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81283ab5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Types of study</heading><chapeau style="-uslm-lc:I12" class="indent1">A graduate fellowship provided under this section shall support an individual in pursuing postbaccalaureate study, which leads to a doctoral degree and may include a master’s degree as part of such study, related to teacher preparation and pedagogy in one of the following areas:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id81283ab6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d/2/A"><num value="A">(A)</num><content> Science, technology, engineering, or mathematics, if the individual has completed a master’s degree in mathematics or science and is pursuing a doctoral degree in mathematics, science, or education.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id81283ab7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d/2/B"><num value="B">(B)</num><content> Special education.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id81283ab8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/d/2/C"><num value="C">(C)</num><content> The instruction of limited English proficient students, including postbaccalaureate study in language instruction educational programs.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283ab9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e"><num value="e" class="bold">(e)</num><heading class="bold"> Fellowship terms and conditions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81283aba-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Selection of fellows</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall ensure that an eligible institution that receives a grant under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id81283abb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/1/A"><num value="A">(A)</num><content> shall provide graduate fellowship awards to individuals who plan to pursue a career in instruction at an institution of higher education that has a teacher preparation program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id81283abc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/1/B"><num value="B">(B)</num><chapeau> may not provide a graduate fellowship to an otherwise eligible individual—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id81283abd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/1/B/i"><num value="i">(i)</num><content> during periods in which such individual is enrolled at an institution of higher education unless such individual is maintaining satisfactory academic progress in, and devoting full-time study or research to, the pursuit of the degree for which the fellowship support was provided; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id81283abe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/1/B/ii"><num value="ii">(ii)</num><content> if the individual is engaged in gainful employment, other than part-time employment related to teaching, research, or a similar activity determined by the institution to be consistent with and supportive of the individuals’s <ref class="footnoteRef" idref="fn002029">1</ref><note type="footnote" id="fn002029"><num>1</num> So in original. Probably should be “individual’s”.</note> progress toward the degree for which the fellowship support was provided.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81283abf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Amount of fellowship awards</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">An eligible institution that receives a grant under this section shall award stipends to individuals who are provided graduate fellowships under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Awards based on need</heading><content><p style="-uslm-lc:I13" class="indent2">A stipend provided under this section shall be in an amount equal to the level of support provided by the National Science Foundation graduate fellowships, except that such stipend shall be adjusted as necessary so as not to exceed the fellowship recipient’s demonstrated need, as determined by the institution of higher education where the fellowship recipient is enrolled.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81283ac2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Service requirement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Teaching required</heading><content><p style="-uslm-lc:I13" class="indent2">Each individual who receives a graduate fellowship under this section and earns a doctoral degree shall teach for one year at an institution of higher education that has a teacher preparation program for each year of fellowship support received under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Institutional obligation</heading><content><p style="-uslm-lc:I13" class="indent2">Each eligible institution that receives a grant under this section shall provide an assurance to the Secretary that the institution has inquired of and determined the decision of each individual who has received a graduate fellowship to, within three years of receiving a doctoral degree, begin employment at an institution of higher education that has a teacher preparation program, as required by this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Agreement required</heading><content><p style="-uslm-lc:I13" class="indent2">Prior to receiving an initial graduate fellowship award, and upon the annual renewal of the graduate fellowship award, an individual selected to receive a graduate fellowship under this section shall sign an agreement with the Secretary agreeing to pursue a career in instruction at an institution of higher education that has a teacher preparation program in accordance with subparagraph (A).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Failure to comply</heading><content><p style="-uslm-lc:I13" class="indent2">If an individual who receives a graduate fellowship award under this section fails to comply with the agreement signed pursuant to subparagraph (C), the sum of the amounts of any graduate fellowship award received by such recipient shall, upon a determination of such a failure, be treated as a Federal Direct Unsubsidized Stafford Loan under part D of subchapter IV, and shall be subject to repayment, together with interest thereon accruing from the date of the fellowship award, in accordance with terms and conditions specified by the Secretary in regulations under this subpart.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id81283ac7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Modified service requirement</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary may waive or modify the service requirement of this paragraph in accordance with regulations promulgated by the Secretary with respect to the criteria to determine the circumstances under which compliance with such service requirement is inequitable or represents a substantial hardship. The Secretary may waive the service requirement if compliance by the fellowship recipient is determined to be inequitable or represent a substantial hardship—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id81283ac8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/E/i"><num value="i">(i)</num><content> because the individual is permanently and totally disabled at the time of the waiver request; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id81283ac9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/e/3/E/ii"><num value="ii">(ii)</num><content> based on documentation presented to the Secretary of substantial economic or personal hardship.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283aca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/f"><num value="f" class="bold">(f)</num><heading class="bold"> Institutional support for fellows</heading><content><p style="-uslm-lc:I11" class="indent0">An eligible institution that receives a grant under this section may reserve not more than ten percent of the grant amount for academic and career transition support for graduate fellowship recipients and for meeting the institutional obligation described in subsection (e)(3)(B).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81283acb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1036/g"><num value="g" class="bold">(g)</num><heading class="bold"> Restriction on use of funds</heading><content><p style="-uslm-lc:I11" class="indent0">An eligible institution that receives a grant under this section may not use grant funds for general operational overhead of the institution.</p>
