L. 105–244, title III, § 302, Oct. 7, 1998, 112 Stat. 1637.)","seq_in_title":432,"parent_identifier":"/us/usc/t20/ch28/schIII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28","level":"chapter","num":"CHAPTER 28—","heading":"HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"INSTITUTIONAL AID","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id81283adc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051\"><num value=\"1051\">§ 1051.</num><heading> Findings and purpose</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81283add-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Findings</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ade-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/1\"><num value=\"1\">(1)</num><content> there are a significant number of institutions of higher education serving high percentages of minority students and students from low-income backgrounds, that face problems that threaten their ability to survive;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283adf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/2\"><num value=\"2\">(2)</num><content> the problems relate to the management and fiscal operations of certain institutions of higher education, as well as to an inability to engage in long-range planning and development activities, including endowment building;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/3\"><num value=\"3\">(3)</num><content> in order to be competitive and provide a high-quality education for all, institutions of higher education should improve their technological capacity and make effective use of technology;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/4\"><num value=\"4\">(4)</num><content> the subchapter III program prior to 1985 did not always meet the specific development needs of historically Black colleges and universities and other institutions with large concentrations of minority, low-income students;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/5\"><num value=\"5\">(5)</num><content> the solution of the problems of these institutions would enable them to become viable, fiscally stable and independent, thriving institutions of higher education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/6\"><num value=\"6\">(6)</num><content> providing assistance to eligible institutions will enhance the role of such institutions in providing access and quality education to low-income and minority students;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/7\"><num value=\"7\">(7)</num><content> these institutions play an important role in the American system of higher education, and there is a strong national interest in assisting them in solving their problems and in stabilizing their management and fiscal operations, and in becoming financially independent; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81283ae5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/a/8\"><num value=\"8\">(8)</num><content> there is a particular national interest in aiding those institutions of higher education that have historically served students who have been denied access to postsecondary education because of race or national origin and whose participation in the American system of higher education is in the Nation’s interest so that equality of access and quality of postsecondary education opportunities may be enhanced for all students.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81283ae6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1051/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">It is the purpose of this subchapter to assist such institutions in equalizing educational opportunity through a program of Federal assistance.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id81283ae7-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIII/s301\">Pub. class=\"small-caps\">Effective</inline> 60 <inline class=\"small-caps\">days after enactment</inline>.—</heading><content>The amendments made by the following subsections of section 2 of this Act shall be effective on and after 60 days after the date of enactment of this Act [<date date=\"1993-12-20\">Dec. 20, 1993</date>]: (c)(31) and (c)(53) [amending sections 1078–1 and 1083 of this 1994.—</heading><content>The amendments made by section 2(c)(43)(B) of this Act [amending <ref href=\"/us/usc/t20/s1078–8\">section 1078–8 of this title</ref>] shall be effective on and after <date July</inline> 1, 1994.—</heading><content>The amendments made by the following subsection[s] of section 2 of this Act shall be effective on and after <date date=\"1994-07-01\">July 1, 1994</date>: value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Cohort default data examinations</inline>.—</heading><content>The amendment made by section 2(c)(60)(A) [amending <ref href=\"/us/usc/t20/s1085\">section 1085 of this title</ref>] shall be effective on and after <date date=\"1994-10-01\">October 1, 1994</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><heading> <inline class=\"small-caps\">Cohort default rate determinations</inline>.—</heading><content>The amendments made to subsection[s] (a)(3) and (m)(1)(B) of section 435 of this [the] Act [section 1085(a)(3) and (m)(1)(B) of this title] shall apply with respect to the determination (and appeals from determinations) of
