<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id812aabf0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057"><num value="1057">§ 1057.</num><heading> Program purpose</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812aabf1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/a"><num value="a" class="bold">(a)</num><heading class="bold"> General authorization</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall carry out a program, in accordance with this part, to improve the academic quality, institutional management, and fiscal stability of eligible institutions, in order to increase their self-sufficiency and strengthen their capacity to make a substantial contribution to the higher education resources of the Nation.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812aabf2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grants awarded; special consideration</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id812aabf3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/1"><num value="1">(1)</num><content> From the sums available for this part under <ref href="/us/usc/t20/s1068h/a/1">section 1068h(a)(1) of this title</ref>, the Secretary may award grants to any eligible institution with an application approved under <ref href="/us/usc/t20/s1068">section 1068 of this title</ref> in order to assist such an institution to plan, develop, or implement activities that promise to strengthen the institution.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id812aabf4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/2"><num value="2">(2)</num><chapeau> Special consideration shall be given to any eligible institution—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabf5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/2/A"><num value="A">(A)</num><content> which has endowment funds (other than any endowment fund built under <ref href="/us/usc/t20/s1065">section 1065 of this title</ref> as in effect on <date date="1986-09-30">September 30, 1986</date>, and under part B) the market value of which, per full-time equivalent student, is less than the average current market value of the endowment funds, per full-time equivalent student (other than any endowment fund built under <ref href="/us/usc/t20/s1065">section 1065 of this title</ref> as in effect on <date date="1986-09-30">September 30, 1986</date>, and under part B) at similar institutions; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabf6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/2/B"><num value="B">(B)</num><content> which has expenditures per full-time equivalent student for library materials which is less than the average of the expenditures for library materials per full-time equivalent student by other similarly situated institutions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id812aabf7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3"><num value="3">(3)</num><chapeau> Special consideration shall be given to applications which propose, pursuant to the institution’s plan, to engage in—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabf8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/A"><num value="A">(A)</num><content> faculty development;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabf9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/B"><num value="B">(B)</num><content> funds and administrative management;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabfa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/C"><num value="C">(C)</num><content> development and improvement of academic programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabfb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/D"><num value="D">(D)</num><content> acquisition of equipment for use in strengthening funds management and academic programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabfc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/E"><num value="E">(E)</num><content> joint use of facilities such as libraries and laboratories; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id812aabfd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/b/3/F"><num value="F">(F)</num><content> student services, including services that will assist in the education of special populations.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812aabfe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c"><num value="c" class="bold">(c)</num><heading class="bold"> Authorized activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Grants awarded under this section shall be used for 1 or more of the following activities:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id812aabff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/1"><num value="1">(1)</num><content> Purchase, rental, or lease of scientific or laboratory equipment for educational purposes, including instructional and research purposes.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac00-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/2"><num value="2">(2)</num><content> Construction, maintenance, renovation, and improvement in classrooms, libraries, laboratories, and other instructional facilities, including the integration of computer technology into institutional facilities to create smart buildings.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac01-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/3"><num value="3">(3)</num><content> Support of faculty exchanges, faculty development, and faculty fellowships to assist in attaining advanced degrees in the field of instruction of the faculty.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac02-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/4"><num value="4">(4)</num><content> Development and improvement of academic programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac03-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/5"><num value="5">(5)</num><content> Purchase of library books, periodicals, and other educational materials, including telecommunications program material.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac04-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/6"><num value="6">(6)</num><content> Tutoring, counseling, and student service programs designed to improve academic success, including innovative, customized, instruction courses designed to help retain students and move the students rapidly into core courses and through program completion, which may include remedial education and English language instruction.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac05-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/7"><num value="7">(7)</num><content> Education or counseling services designed to improve the financial literacy and economic literacy of students or the students’ families.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac06-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/8"><num value="8">(8)</num><content> Funds management, administrative management, and acquisition of equipment for use in strengthening funds management.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac07-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/9"><num value="9">(9)</num><content> Joint use of facilities, such as laboratories and libraries.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac08-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/10"><num value="10">(10)</num><content> Establishing or improving a development office to strengthen or improve contributions from alumni and the private sector.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac09-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/11"><num value="11">(11)</num><content> Establishing or improving an endowment fund.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac0a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/12"><num value="12">(12)</num><content> Creating or improving facilities for Internet or other distance education technologies, including purchase or rental of telecommunications technology equipment or services.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812aac0b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/13"><num value="13">(13)</num><chapeau> Other activities proposed in the application submitted pursuant to subsection (b) and <ref href="/us/usc/t20/s1068">section 1068 of this title</ref> that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id812aac0c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/13/A"><num value="A">(A)</num><content> contribute to carrying out the purposes of the program assisted under this part; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812aac0d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/c/13/B"><num value="B">(B)</num><content> are approved by the Secretary as part of the review and acceptance of such application.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812aac0e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/d"><num value="d" class="bold">(d)</num><heading class="bold"> Endowment fund</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812aac0f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible institution may use not more than 20 percent of the grant funds provided under this part to establish or increase an endowment fund at such institution.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812aac10-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1057/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Matching requirement</heading><content><p style="-uslm-lc:I12" class="indent1">In order to be eligible to use grant funds in accordance with paragraph (1), the eligible institution shall provide matching funds from non-Federal sources, in an amount equal to or greater than the Federal funds used in accordance with paragraph (1), for the establishment or increase of the endowment fund.</p>
