id=\"id812cf646-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Program authorized</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide grants and related assistance to Tribal Colleges and Universities to enable such institutions to improve and expand their capacity to serve Indian students.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id812cf647-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf648-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Indian</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian” has the meaning given the term in section 2 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 [<ref href=\"/us/usc/t25/s1801\">25 U.S.C. 1801</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf649-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Indian tribe</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian tribe” has the meaning given the term in section 2 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 [<ref href=\"/us/usc/t25/s1801\">25 U.S.C. 1801</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf64a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Tribal College or University</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “Tribal College or University” means an institution that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf64b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/3/A\"><num value=\"A\">(A)</num><content> qualifies for funding under the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<ref href=\"/us/usc/t25/s1801\">25 U.S.C. 1801</ref> et seq.) or the Navajo Community College Act (<ref href=\"/us/usc/t25/s640a\">25 U.S.C. 640a</ref> note); <ref class=\"footnoteRef\" idref=\"fn002031\">1</ref><note type=\"footnote\" id=\"fn002031\"><num>1</num> See References in Text note below.</note> or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf64c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/3/B\"><num value=\"B\">(B)</num><content> is cited in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<ref href=\"/us/usc/t7/s301\">7 U.S.C. 301</ref> note).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf64d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Institution of higher education</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “institution of higher education” means an institution of higher education as defined in <ref href=\"/us/usc/t20/s1001/a\">section 1001(a) of this title</ref>, except that paragraph (2) of such section shall not apply.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id812cf64e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Authorized activities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf64f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Grants awarded under this section shall be used by Tribal Colleges or Universities to assist such institutions to plan, develop, undertake, and carry out activities to improve and expand such institutions’ capacity to serve Indian students.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf650-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Examples of authorized activities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The activities described in paragraph (1) may include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf651-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/A\"><num value=\"A\">(A)</num><content> purchase, rental, or lease of scientific or laboratory equipment for educational purposes, including instructional and research purposes;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf652-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/B\"><num value=\"B\">(B)</num><content> construction, maintenance, renovation, and improvement in classrooms, libraries, laboratories, and other instructional facilities, including purchase or rental of telecommunications technology equipment or services, and the acquisition of real property adjacent to the campus of the institution on which to construct such facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf653-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/C\"><num value=\"C\">(C)</num><content> support of faculty exchanges, faculty development, and faculty fellowships to assist in attaining advanced degrees in the faculty’s field of instruction or in tribal governance or tribal public policy;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf654-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/D\"><num value=\"D\">(D)</num><content> academic instruction in disciplines in which Indians are underrepresented and instruction in tribal governance or tribal public policy;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf655-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/E\"><num value=\"E\">(E)</num><content> purchase of library books, periodicals, and other educational materials, including telecommunications program material;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf656-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/F\"><num value=\"F\">(F)</num><content> tutoring, counseling, and student service programs designed to improve academic success;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf657-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/G\"><num value=\"G\">(G)</num><content> education or counseling services designed to improve the financial literacy and economic literacy of students or the students’ families;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf658-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/H\"><num value=\"H\">(H)</num><content> funds management, administrative management, and acquisition of equipment for use in strengthening funds management;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf659-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/I\"><num value=\"I\">(I)</num><content> joint use of facilities, such as laboratories and libraries;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf65a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/J\"><num value=\"J\">(J)</num><content> establishing or improving a development office to strengthen or improve contributions from alumni and the private sector;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf65b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/K\"><num value=\"K\">(K)</num><content> establishing or enhancing a program of teacher education designed to qualify students to teach in elementary schools or secondary schools, with a particular emphasis on teaching Indian children and youth, that shall include, as part of such program, preparation for teacher certification;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf65c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/L\"><num value=\"L\">(L)</num><content> establishing community outreach programs that encourage Indian elementary school and secondary school students to develop the academic skills and the interest to pursue postsecondary education;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf65d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/M\"><num value=\"M\">(M)</num><content> developing or improving facilities for Internet use or other distance education technologies; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id812cf65e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/N\"><num value=\"N\">(N)</num><chapeau> other activities proposed in the application submitted pursuant to subsection (d) that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id812cf65f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/N/i\"><num value=\"i\">(i)</num><content> contribute to carrying out the activities described in subparagraphs (A) through (M); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id812cf660-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/2/N/ii\"><num value=\"ii\">(ii)</num><content> are approved by the Secretary as part of the review and acceptance of such application.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf661-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Endowment fund</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf662-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A Tribal College or University may use not more than 20 percent of the grant funds provided under this section to establish or increase an endowment fund at the institution.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf663-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Matching requirement</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In order to be eligible to use grant funds in accordance with subparagraph (A), the Tribal College or University shall provide matching funds, in an amount equal to the Federal funds used in accordance with subparagraph (A), for the establishment or increase of the endowment fund.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf664-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/c/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Comparability</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The provisions of part C regarding the establishment or increase of an endowment fund, that the Secretary determines are not inconsistent with this paragraph, shall apply to funds used under subparagraph (A).</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id812cf665-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application, plan, and allocation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf666-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Institutional eligibility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To be eligible to receive assistance under this section, a Tribal College or University shall be an eligible institution under <ref href=\"/us/usc/t20/s1058/b\">section 1058(b) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf667-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Application</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf668-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A Tribal College or University desiring to receive assistance under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf669-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Streamlined process</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall establish application requirements in such a manner as to simplify and streamline the process for applying for grants under this section.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id812cf66a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Awards and allocations to institutions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf66b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Construction grants</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id812cf66c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Of the amount appropriated to carry out this section for any fiscal year, the Secretary may reserve 30 percent for the purpose of awarding one-year grants of not less than $1,000,000 to address construction, maintenance, and renovation needs at eligible institutions.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id812cf66d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Preference</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In providing grants under clause (i) for any fiscal year, the Secretary shall give preference to eligible institutions that have not received an award under this section for a previous fiscal year.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id812cf66e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Allotment of remaining funds</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id812cf66f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in clause (ii), the Secretary shall distribute the remaining funds appropriated for any fiscal year to each eligible institution as follows:</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id812cf670-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1059c/d/3/B/i/I\"><num value=\"I\">(I)</num><content> 60 percent of the remaining appropriated funds shall be distributed among the eligible Tribal Colleges and Universities on a pro rata basis, based on the respective Indian student counts (as defined in section 2(a) of the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<ref href=\"/us/usc/t25/s1801/a\">25 U.S.C. 1801(a)</ref>) <ref class=\"footnoteRef\" idref=\"fn002032\">2</ref><note type=\"footnote\" id=\"fn002032\"><num>2</num> So in
