<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id812cf67f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d"><num value="1059d">§ 1059d.</num><heading> Alaska Native and Native Hawaiian-serving institutions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812cf680-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program authorized</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall provide grants and related assistance to Alaska Native-serving institutions and Native Hawaiian-serving institutions to enable such institutions to improve and expand their capacity to serve Alaska Natives and Native Hawaiians.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812cf681-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For the purpose of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id812cf682-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/1"><num value="1">(1)</num><content> the term “Alaska Native” has the meaning given the term in <ref href="/us/usc/t20/s7546">section 7546 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812cf683-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/2"><num value="2">(2)</num><chapeau> the term “Alaska Native-serving institution” means an institution of higher education that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf684-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/2/A"><num value="A">(A)</num><content> is an eligible institution under <ref href="/us/usc/t20/s1058/b">section 1058(b) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf685-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/2/B"><num value="B">(B)</num><content> at the time of application, has an enrollment of undergraduate students that is at least 20 percent Alaska Native students;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812cf686-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/3"><num value="3">(3)</num><content> the term “Native Hawaiian” has the meaning given the term in <ref href="/us/usc/t20/s7517">section 7517 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id812cf687-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/4"><num value="4">(4)</num><chapeau> the term “Native Hawaiian-serving institution” means an institution of higher education which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf688-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/4/A"><num value="A">(A)</num><content> is an eligible institution under <ref href="/us/usc/t20/s1058/b">section 1058(b) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf689-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/b/4/B"><num value="B">(B)</num><content> at the time of application, has an enrollment of undergraduate students that is at least 10 percent Native Hawaiian students.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812cf68a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Authorized activities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812cf68b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Types of activities authorized</heading><content><p style="-uslm-lc:I12" class="indent1">Grants awarded under this section shall be used by Alaska Native-serving institutions and Native Hawaiian-serving institutions to assist such institutions to plan, develop, undertake, and carry out activities to improve and expand such institutions’ capacity to serve Alaska Natives or Native Hawaiians.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812cf68c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Examples of authorized activities</heading><chapeau style="-uslm-lc:I12" class="indent1">Such programs may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf68d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/A"><num value="A">(A)</num><content> purchase, rental, or lease of scientific or laboratory equipment for educational purposes, including instructional and research purposes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf68e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/B"><num value="B">(B)</num><content> renovation and improvement in classroom, library, laboratory, and other instructional facilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf68f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/C"><num value="C">(C)</num><content> support of faculty exchanges, and faculty development and faculty fellowships to assist in attaining advanced degrees in the faculty’s field of instruction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf690-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/D"><num value="D">(D)</num><content> curriculum development and academic instruction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf691-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/E"><num value="E">(E)</num><content> purchase of library books, periodicals, microfilm, and other educational materials;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf692-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/F"><num value="F">(F)</num><content> funds and administrative management, and acquisition of equipment for use in strengthening funds management;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf693-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/G"><num value="G">(G)</num><content> joint use of facilities such as laboratories and libraries;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf694-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/H"><num value="H">(H)</num><content> academic tutoring and counseling programs and student support services; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf695-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/c/2/I"><num value="I">(I)</num><content> education or counseling services designed to improve the financial literacy and economic literacy of students or the students’ families.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id812cf696-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Application process</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812cf697-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Institutional eligibility</heading><content><p style="-uslm-lc:I12" class="indent1">Each Alaska Native-serving institution and Native Hawaiian-serving institution desiring to receive assistance under this section shall submit to the Secretary such enrollment data as may be necessary to demonstrate that the institution is an Alaska Native-serving institution or a Native Hawaiian-serving institution as defined in subsection (b), along with such other information and data as the Secretary may by regulation require.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812cf698-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Applications</heading><chapeau style="-uslm-lc:I12" class="indent1">Any institution which is determined by the Secretary to be an Alaska Native-serving institution or a Native Hawaiian-serving institution may submit an application for assistance under this section to the Secretary. The Secretary shall, to the extent possible, prescribe a simplified and streamlined format for such applications that takes into account the limited number of institutions that are eligible for assistance under this section. Such application shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf699-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/2/A"><num value="A">(A)</num><content> a 5-year plan for improving the assistance provided by the Alaska Native-serving institution or the Native Hawaiian-serving institution to Alaska Native or Native Hawaiian students; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id812cf69a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/2/B"><num value="B">(B)</num><content> such other information and assurance as the Secretary may require.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id812cf69b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Special rules</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id812cf69c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligibility</heading><content><p style="-uslm-lc:I13" class="indent2">No Alaskan Native-serving institution or Native Hawaiian-serving institution that receives funds under this section shall concurrently receive funds under other provisions of this part or part B.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id812cf69d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exemption</heading><content><p style="-uslm-lc:I13" class="indent2"><ref href="/us/usc/t20/s1059/d">Section 1059(d) of this title</ref> shall not apply to institutions that are eligible to receive funds under this section.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id812cf69e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1059d/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Distribution</heading><content><p style="-uslm-lc:I13" class="indent2">In awarding grants under this section, the Secretary shall, to the extent possible and consistent with the competitive process under which such grants are awarded, ensure maximum and equitable distribution among all eligible institutions.</p>
