<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6bd5c0d1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d"><num value="1066d">§ 1066d.</num><heading> Authority of Secretary</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In the performance of, and with respect to, the functions vested in the Secretary by this part, the Secretary—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5c0d2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/1"><num value="1">(1)</num><chapeau> shall, within 120 days of <date date="2008-08-14">August 14, 2008</date>, publish in the Federal Register a notice and request for proposals for any private for-profit organization or entity wishing to serve as the designated bonding authority under this part, which notice shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5c0d3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/1/A"><num value="A">(A)</num><content> specify the time and manner for submission of proposals; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5c0d4-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/1/B"><num value="B">(B)</num><content> specify any information, qualifications, criteria, or standards the Secretary determines to be necessary to evaluate the financial capacity and administrative capability of any applicant to carry out the responsibilities of the designated bonding authority under this part;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5c0d5-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/2"><num value="2">(2)</num><chapeau> shall ensure that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5c0d6-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/2/A"><num value="A">(A)</num><content> the selection process for the designated bonding authority is conducted on a competitive basis; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5c0d7-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/2/B"><num value="B">(B)</num><content> the evaluation and selection process is transparent;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5c0d8-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/3"><num value="3">(3)</num><chapeau> shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5c0d9-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/3/A"><num value="A">(A)</num><content> review the performance of the designated bonding authority after the third year of the insurance agreement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6bd5e7ea-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/3/B"><num value="B">(B)</num><content> following the review described in subparagraph (A), implement a revised competitive selection process, if determined necessary by the Secretary in consultation with the Advisory Board established pursuant to <ref href="/us/usc/t20/s1066f">section 1066f of this title</ref>;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7eb-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/4"><num value="4">(4)</num><content> shall require that the first loans for capital projects authorized under <ref href="/us/usc/t20/s1066b">section 1066b of this title</ref> be made no later than <date date="1994-03-31">March 31, 1994</date>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7ec-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/5"><num value="5">(5)</num><content> may sue and be sued in any court of record of a State having general jurisdiction or in any district court of the United States, and such district courts shall have jurisdiction of civil actions arising under this part without regard to the amount in controversy, and any action instituted under this part without regard to the amount in controversy, and any action instituted under this section by or against the Secretary shall survive notwithstanding any change in the person occupying the office of the Secretary or any vacancy in such office;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7ed-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/6"><num value="6">(6)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7ee-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/6/A"><num value="A">(A)</num><content> may foreclose on any property and bid for and purchase at any foreclosure, or any other sale, any property in connection with which the Secretary has been assigned a loan pursuant to this part; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7ef-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/6/B"><num value="B">(B)</num><chapeau> in the event of such an acquisition, notwithstanding any other provisions of law relating to the acquisition, handling, or disposal of real property by the United States, complete, administer, remodel and convert, dispose of, lease, and otherwise deal with, such property, except that—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id6bd5e7f0-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/6/B/i"><num value="i">(i)</num><content> such action shall not preclude any other action by the Secretary to recover any deficiency in the amount of a loan assigned to the Secretary; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id6bd5e7f1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/6/B/ii"><num value="ii">(ii)</num><content> any such acquisition of real property shall not deprive any State or political subdivision thereof of its civil or criminal jurisdiction in and over such property or impair the civil rights under the State or local laws of the inhabitants on such property;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7f2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/7"><num value="7">(7)</num><content> may sell, exchange, or lease real or personal property and securities or obligations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7f3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/8"><num value="8">(8)</num><content> may include in any contract such other covenants, conditions, or provisions necessary to ensure that the purposes of this part will be achieved;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7f4-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/9"><num value="9">(9)</num><content> may, directly or by grant or contract, provide technical assistance to eligible institutions to prepare the institutions to qualify, apply for, and maintain a capital improvement loan, including a loan under this part; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6bd5e7f5-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1066d/10"><num value="10">(10)</num><content> not later than 120 days after <date date="2008-08-14">August 14, 2008</date>, shall submit to the authorizing committees a report on the progress of the Department in implementing the recommendations made by the Government Accountability Office in October 2006 for improving the Historically Black College and Universities Capital Financing Program.</content>
