The Advisory Board shall meet with the Secretary at least twice each year to advise him as to the capital needs of historically Black colleges and universities, how those needs can be met through the program authorized by this part, and what additional steps might be taken to improve the operation and implementation of the construction financing program.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8138dc9b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Board membership</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8138dc9c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Composition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Advisory Board shall be appointed by the Secretary and shall be composed of 11 members as follows:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dc9d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/A\"><num value=\"A\">(A)</num><content> The Secretary or the Secretary’s designee.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dc9e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/B\"><num value=\"B\">(B)</num><content> Three members who are presidents of private historically Black colleges or universities.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dc9f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/C\"><num value=\"C\">(C)</num><content> Three members who are presidents of public historically Black colleges or universities.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/D\"><num value=\"D\">(D)</num><content> The president of the United Negro College Fund, Inc., or the president’s designee.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/E\"><num value=\"E\">(E)</num><content> The president of the National Association for Equal Opportunity in Higher Education, or the designee of the Association.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/F\"><num value=\"F\">(F)</num><content> The executive director of the White House Initiative on historically Black colleges and universities.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/1/G\"><num value=\"G\">(G)</num><content> The president of the Thurgood Marshall College Fund, or the designee of the president.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8138dca4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Terms</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term of office of each member appointed under paragraphs (1)(B) and (1)(C) shall be 3 years, except that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/2/A\"><num value=\"A\">(A)</num><content> of the members first appointed pursuant to paragraphs (1)(B) and (1)(C), 2 shall be appointed for terms of 1 year, and 3 shall be appointed for terms of 2 years;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/2/B\"><num value=\"B\">(B)</num><content> members appointed to fill a vacancy occurring before the expiration of a term of a member shall be appointed to serve the remainder of that term; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dca7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/b/2/C\"><num value=\"C\">(C)</num><content> a member may continue to serve after the expiration of a term until a successor is appointed.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8138dca8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Additional recommendations from Advisory Board</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8138dca9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In addition to the responsibilities of the Advisory Board described in subsection (a), the Advisory Board shall advise the Secretary and the authorizing committees regarding—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dcaa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/1/A\"><num value=\"A\">(A)</num><chapeau> the fiscal status and strategic financial condition of not less than ten historically Black colleges and universities that have—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8138dcab-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/1/A/i\"><num value=\"i\">(i)</num><content> obtained construction financing through the program under this part and seek additional financing or refinancing under such program; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8138dcac-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/1/A/ii\"><num value=\"ii\">(ii)</num><content> applied for construction financing through the program under this part but have not received financing under such program; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8138dcad-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/1/B\"><num value=\"B\">(B)</num><content> the feasibility of reducing borrowing costs associated with the program under this part, including reducing interest rates.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8138dcae-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1066f/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than six months after <date date=\"2008-08-14\">August 14, 2008</date>, the Advisory Board shall prepare and submit a report to the authorizing committees regarding the historically Black colleges and universities described in paragraph (1)(A) that includes administrative and legislative recommendations for addressing the issues related to construction financing facing such historically Black colleges and universities.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8138dcaf-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIII/s347\">Pub.
