need-based assistance students</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may waive the requirements set forth in <ref href=\"/us/usc/t20/s1058/b/1/A\">section 1058(b)(1)(A) of this title</ref> in the case of an institution—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf00-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/1\"><num value=\"1\">(1)</num><content> which is extensively subsidized by the State in which it is located and charges low or no tuition;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf01-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/2\"><num value=\"2\">(2)</num><content> which serves a substantial number of low-income students as a percentage of its total student population;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf02-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/3\"><num value=\"3\">(3)</num><content> which is contributing substantially to increasing higher education opportunities for educationally disadvantaged, underrepresented, or minority students, who are low-income individuals;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf03-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/4\"><num value=\"4\">(4)</num><content> which is substantially increasing higher educational opportunities for individuals in rural or other isolated areas which are unserved by postsecondary institutions;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf04-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/5\"><num value=\"5\">(5)</num><content> located on or near an Indian reservation or a substantial population of Indians, if the Secretary determines that the waiver will substantially increase higher education opportunities appropriate to the needs of American Indians;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf05-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/6\"><num value=\"6\">(6)</num><content> that is a tribally controlled college or university as defined in <ref href=\"/us/usc/t25/s1801\">section 1801 of title 25</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf06-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/a/7\"><num value=\"7\">(7)</num><content> wherever located, if the Secretary determines that the waiver will substantially increase higher education opportunities appropriate to the needs of Black Americans, Hispanic Americans, Native Americans, Asian Americans, or Pacific Islanders, including Native Hawaiians.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id813dbf07-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Waiver determinations; expenditures</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id813dbf08-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b/1\"><num value=\"1\">(1)</num><content> The Secretary may waive the requirements set forth in <ref href=\"/us/usc/t20/s1058/b/1/B\">section 1058(b)(1)(B) of this title</ref> if the Secretary determines, based on persuasive evidence submitted by the institution, that the institution’s failure to meet that criterion is due to factors which, when used in the determination of compliance with such criterion, distort such determination, and that the institution’s designation as an eligible institution under part A is otherwise consistent with the purposes of such parts.<ref class=\"footnoteRef\" idref=\"fn002039\">1</ref><note type=\"footnote\" id=\"fn002039\"><num>1</num> So in original. Probably should be “part.”</note></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id813dbf09-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b/2\"><num value=\"2\">(2)</num><chapeau> The Secretary shall submit to the Congress every other year a report concerning the institutions which, although not satisfying the criterion contained in <ref href=\"/us/usc/t20/s1058/b/1/B\">section 1058(b)(1)(B) of this title</ref>, have been determined to be eligible institutions under part A which enroll significant numbers of Black American, Hispanic, Native American, Asian American, or Native Hawaiian students under part A, as the case may be. Such report shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf0a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b/2/A\"><num value=\"A\">(A)</num><content> identify the factors referred to in paragraph (1) which were considered by the Secretary as factors that distorted the determination of compliance with subparagraphs (A) and (B) of <ref href=\"/us/usc/t20/s1058/b/1\">section 1058(b)(1) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id813dbf0b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b/2/B\"><num value=\"B\">(B)</num><content> contain a list of each institution determined to be an eligible institution under part A including a statement of the reasons for each such determination.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id813dbf0c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/b/3\"><num value=\"3\">(3)</num><content> The Secretary may waive the requirement set forth in section 1058(b)(1)(E) <ref class=\"footnoteRef\" idref=\"fn002040\">2</ref><note type=\"footnote\" id=\"fn002040\"><num>2</num> See References in Text note below.</note> of this title in the case of an institution located on or near an Indian reservation or a substantial population of Indians, if the Secretary determines that the waiver will substantially increase higher education opportunities appropriate to the needs of American Indians.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id813dbf0d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Waiver authority with respect to institutions located in an area affected by a Gulf hurricane disaster</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id813dbf0e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Waiver authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding any other provision of law, unless enacted with specific reference to this section, for any affected institution that was receiving assistance under this subchapter at the time of a Gulf hurricane disaster, the Secretary shall, for each of the fiscal years 2009 through 2011 (and may, for each of the fiscal years 2012 and 2013)—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id813dbf0f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/A\"><num value=\"A\">(A)</num><chapeau> waive—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf10-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/A/i\"><num value=\"i\">(i)</num><content> the eligibility data requirements set forth in <ref href=\"/us/usc/t20/s1068/d\">section 1068(d) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf11-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/A/ii\"><num value=\"ii\">(ii)</num><content> the wait-out period set forth in <ref href=\"/us/usc/t20/s1059/d\">section 1059(d) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf12-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/A/iii\"><num value=\"iii\">(iii)</num><content> the allotment requirements under <ref href=\"/us/usc/t20/s1063\">section 1063 of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf13-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/A/iv\"><num value=\"iv\">(iv)</num><content> the use of the funding formula developed pursuant to <ref href=\"/us/usc/t20/s1063b/f/3\">section 1063b(f)(3) of this title</ref>;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id813dbf14-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/B\"><num value=\"B\">(B)</num><content> waive or modify any statutory or regulatory provision to ensure that affected institutions that were receiving assistance under this subchapter at the time of a Gulf hurricane disaster are not adversely affected by any formula calculation for fiscal year 2009 or for any of the four succeeding fiscal years, as necessary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id813dbf15-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/1/C\"><num value=\"C\">(C)</num><content> make available to each affected institution an amount that is not less than the amount made available to such institution under this subchapter for fiscal year 2006, except that for any fiscal year for which the funds appropriated for payments under this subchapter are less than the appropriated level for fiscal year 2006, the amount made available to such institutions shall be ratably reduced among the institutions receiving funds under this subchapter.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id813dbf16-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In this subsection:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id813dbf17-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Affected institution</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “affected institution” means an institution of higher education that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf18-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/i\"><num value=\"i\">(i)</num><chapeau> is—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id813dbf19-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/i/I\"><num value=\"I\">(I)</num><content> a part A institution (which term shall have the meaning given the term “eligible institution” under <ref href=\"/us/usc/t20/s1058/b\">section 1058(b) of this title</ref>); or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id813dbf1a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/i/II\"><num value=\"II\">(II)</num><content> a part B institution, as such term is defined in <ref href=\"/us/usc/t20/s1061/2\">section 1061(2) of this title</ref>, or as identified in <ref href=\"/us/usc/t20/s1063b/e\">section 1063b(e) of this title</ref>;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf1b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/ii\"><num value=\"ii\">(ii)</num><content> is located in an area affected by a Gulf hurricane disaster; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id813dbf1c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/iii\"><num value=\"iii\">(iii)</num><chapeau> is able to demonstrate that, as a result of the impact of a Gulf hurricane disaster, the institution—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id813dbf1d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/iii/I\"><num value=\"I\">(I)</num><content> incurred physical damage;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id813dbf1e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/iii/II\"><num value=\"II\">(II)</num><content> has pursued collateral source compensation from insurance, the Federal Emergency Management Agency, and the Small Business Administration, as appropriate; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id813dbf1f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/A/iii/III\"><num value=\"III\">(III)</num><content> was not able to fully reopen in existing facilities or to fully reopen to the pre-hurricane enrollment levels during the 30-day period beginning on <date date=\"2005-08-29\">August 29, 2005</date>.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id813dbf20-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1068a/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Area affected by a Gulf hurricane disaster; Gulf hurricane disaster</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The terms “area affected by a Gulf hurricane disaster” and “Gulf hurricane disaster” have the meanings given such terms in section 209 of the Higher Education Hurricane Relief Act of 2005 (<ref href=\"/us/pl/109/148\">Public Law 109–148</ref>, <ref href=\"/us/stat/119/2809\">119 Stat. 2809</ref>).</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id813dbf21-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIII/s392\">Pub.
