<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id81689fbf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h"><num value="1070h">§ 1070h.</num><heading> Scholarships for veteran’s dependents</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fc0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of eligible veteran’s dependent</heading><chapeau style="-uslm-lc:I11" class="indent0">The term “eligible veteran’s dependent” means a dependent or an independent student—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id81689fc1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/a/1"><num value="1">(1)</num><content> whose parent or guardian was a member of the Armed Forces of the United States and died as a result of performing military service in Iraq or Afghanistan after <date date="2001-09-11">September 11, 2001</date>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id81689fc2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/a/2"><num value="2">(2)</num><chapeau> who, at the time of the parent or guardian’s death, was—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id81689fc3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/a/2/A"><num value="A">(A)</num><content> less than 24 years of age; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id81689fc4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/a/2/B"><num value="B">(B)</num><content> enrolled at an institution of higher education on a part-time or full-time basis.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fc5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81689fc6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall award a grant to each eligible veteran’s dependent to assist in paying the eligible veteran’s dependent’s cost of attendance at an institution of higher education.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id81689fc7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Designation</heading><content><p style="-uslm-lc:I12" class="indent1">Grants made under this section shall be known as “Iraq and Afghanistan Service Grants”.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fc8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Prevention of double benefits</heading><content><p style="-uslm-lc:I11" class="indent0">No eligible veteran’s dependent may receive a grant under both this section and <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fc9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d"><num value="d" class="bold">(d)</num><heading class="bold"> Terms and conditions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall award grants under this section in the same manner, and with the same terms and conditions, including the length of the period of eligibility, as the Secretary awards Federal Pell Grants under <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>, except that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id81689fca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d/1"><num value="1">(1)</num><content> the award rules and determination of need applicable to the calculation of Federal Pell Grants, shall not apply to grants made under this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id81689fcb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d/2"><num value="2">(2)</num><content> the provisions of subsection (a)(3), subsection (b)(1), the matter following subsection (b)(2)(A)(v),<ref class="footnoteRef" idref="fn002043">1</ref><note type="footnote" id="fn002043"><num>1</num> See References in Text note below.</note> subsection (b)(3), and subsection (f), of <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref> shall not apply; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id81689fcc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d/3"><num value="3">(3)</num><chapeau> a grant made under this section to an eligible veteran’s dependent for any award year shall equal the maximum Federal Pell Grant available for that award year, except that such a grant under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id81689fcd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d/3/A"><num value="A">(A)</num><content> shall not exceed the cost of attendance of the eligible veteran’s dependent for that award year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id81689fce-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/d/3/B"><num value="B">(B)</num><content> shall be adjusted to reflect the attendance by the eligible veteran’s dependent on a less than full-time basis in the same manner as such adjustments are made under <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fcf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/e"><num value="e" class="bold">(e)</num><heading class="bold"> Estimated financial assistance</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of determinations of need under part F, a grant awarded under this section shall not be treated as estimated financial assistance as described in sections 1087kk(3) and 1087vv(j) of this title.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81689fd0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1070h/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization and appropriations of funds</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated, and there are appropriated, out of any money in the Treasury not otherwise appropriated, for the Secretary to carry out this section, such sums as may be necessary for fiscal year 2010 and each succeeding fiscal year.</p>
