<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id816b10d8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071"><num value="1071">§ 1071.</num><heading> Statement of purpose; nondiscrimination; and appropriations authorized</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id816b10d9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a"><num value="a" class="bold">(a)</num><heading class="bold"> Purpose; discrimination prohibited</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id816b10da-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Purpose</heading><chapeau style="-uslm-lc:I12" class="indent1">The purpose of this part is to enable the Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id816b10db-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/1/A"><num value="A">(A)</num><content> to encourage States and nonprofit private institutions and organizations to establish adequate loan insurance programs for students in eligible institutions (as defined in <ref href="/us/usc/t20/s1085">section 1085 of this title</ref>),</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id816b10dc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/1/B"><num value="B">(B)</num><content> to provide a Federal program of student loan insurance for students or lenders who do not have reasonable access to a State or private nonprofit program of student loan insurance covered by an agreement under <ref href="/us/usc/t20/s1078/b">section 1078(b) of this title</ref>,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id816b10dd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/1/C"><num value="C">(C)</num><content> to pay a portion of the interest on loans to qualified students which are insured under this part, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id816b10de-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/1/D"><num value="D">(D)</num><content> to guarantee a portion of each loan insured under a program of a State or of a nonprofit private institution or organization which meets the requirements of <ref href="/us/usc/t20/s1078/a/1/B">section 1078(a)(1)(B) of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id816b10df-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Discrimination by creditors prohibited</heading><content><p style="-uslm-lc:I12" class="indent1">No agency, organization, institution, bank, credit union, corporation, or other lender who regularly extends, renews, or continues credit or provides insurance under this part shall exclude from receipt or deny the benefits of, or discriminate against any borrower or applicant in obtaining, such credit or insurance on the basis of race, national origin, religion, sex, marital status, age, or handicapped status.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id816b10e0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b"><num value="b" class="bold">(b)</num><heading class="bold"> Authorization of appropriations</heading><chapeau style="-uslm-lc:I11" class="indent0">For the purpose of carrying out this part—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/1"><num value="1">(1)</num><content> there are authorized to be appropriated to the student loan insurance fund (established by <ref href="/us/usc/t20/s1081">section 1081 of this title</ref>) (A) the sum of $1,000,000, and (B) such further sums, if any, as may become necessary for the adequacy of the student loan insurance fund,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/2"><num value="2">(2)</num><content> there are authorized to be appropriated, for payments under <ref href="/us/usc/t20/s1078">section 1078 of this title</ref> with respect to interest on student loans and for payments under <ref href="/us/usc/t20/s1087">section 1087 of this title</ref>, such sums for the fiscal year ending <date date="1966-06-30">June 30, 1966</date>, and succeeding fiscal years, as may be required therefor,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/3"><num value="3">(3)</num><content> there is authorized to be appropriated the sum of $17,500,000 for making advances pursuant to <ref href="/us/usc/t20/s1072">section 1072 of this title</ref> for the reserve funds of State and nonprofit private student loan insurance programs,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/4"><num value="4">(4)</num><content> there are authorized to be appropriated (A) the sum of $12,500,000 for making advances after <date date="1968-06-30">June 30, 1968</date>, pursuant to sections 1072(a) and (b) of this title, and (B) such sums as may be necessary for making advances pursuant to <ref href="/us/usc/t20/s1072/c">section 1072(c) of this title</ref>, for the reserve funds of State and nonprofit private student loan insurance programs,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/5"><num value="5">(5)</num><content> there are authorized to be appropriated such sums as may be necessary for the purpose of paying a loan processing and issuance fee in accordance with <ref href="/us/usc/t20/s1078/f">section 1078(f) of this title</ref> to guaranty agencies, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/b/6"><num value="6">(6)</num><content> there is authorized to be appropriated, and there are appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary for the purpose of carrying out <ref href="/us/usc/t20/s1072/c/7">section 1072(c)(7) of this title</ref>.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Sums appropriated under paragraphs (1), (2), (4), and (5) of this subsection shall remain available until expended, except that no sums may be expended after <date date="2010-06-30">June 30, 2010</date>, with respect to loans under this part for which the first disbursement is after such date. No additional sums are authorized to be appropriated under paragraph (3) or (4) of this subsection by reason of the reenactment of such paragraphs by the Higher Education Amendments of 1986.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id816b10e7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/c"><num value="c" class="bold">(c)</num><heading class="bold"> Designation</heading><content><p style="-uslm-lc:I11" class="indent0">The program established under this part shall be referred to as the “Robert T. Stafford Federal Student Loan Program”. Loans made pursuant to sections 1077 and 1078 of this title shall be known as “Federal Stafford Loans”.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id816b10e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/d"><num value="d" class="bold">(d)</num><heading class="bold"> Termination of authority to make or insure new loans</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding paragraphs (1) through (6) of subsection (b) or any other provision of law—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id816b10e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/d/1"><num value="1">(1)</num><content> no new loans (including consolidation loans) may be made or insured under this part after <date date="2010-06-30">June 30, 2010</date>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id816b10ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1071/d/2"><num value="2">(2)</num><content> no funds are authorized to be appropriated, or may be expended, under this chapter or any other Act to make or insure loans under this part (including consolidation loans) for which the first disbursement is after <date date="2010-06-30">June 30, 2010</date>,</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the changes made in sections 425(a), 428(b)(1)(A), and 428(b)(1)(B) of the Act [<ref href="/us/usc/t20/s1075/a">20 U.S.C. 1075(a)</ref>, 1078(b)(1)(A), (B)] shall apply with respect only to loans disbursed on or after <date date="1987-01-01">January 1, 1987</date>, or made to cover the costs of instruction for periods of enrollment beginning on or after <date date="1987-01-01">January 1, 1987</date>;</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Changes Effective Without Regard to Regulations; Republication of Regulations</inline>.—</heading><content>The changes made in part B of title IV of the Act [<ref href="/us/usc/t20/s1071">20 U.S.C. 1071</ref> et seq.] by the amendment made by subsection (a) of this section shall be effective in accordance with subsection (b) of this section without regard to whether such changes are reflected in the regulations prescribed by the Secretary of Education for the purpose of such part.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">New Borrowers</inline>.—</heading><content>For the purpose of this section, the term ‘new borrower’ means, with respect to any date, an individual who on that date has no outstanding balance of principal or interest owing on any loan made, insured, or guaranteed under part B of title IV of the Act [<ref href="/us/usc/t20/s1071">20 U.S.C. 1071</ref> et seq.].”</content>
