The Secretary may develop such safeguards as the Secretary determines necessary to prevent fraud and abuse in the discharge of liability under this subsection. Notwithstanding any other provision of this subsection, the Secretary may promulgate regulations to reinstate the obligation of, and resume collection on, loans discharged under this subsection in any case in which—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81a44882-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/1/A\"><num value=\"A\">(A)</num><chapeau> a borrower received a discharge of liability under this subsection and after the discharge the borrower—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a44883-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/1/A/i\"><num value=\"i\">(i)</num><content> receives a loan made, insured, or guaranteed under this subchapter; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a44884-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> has earned income in excess of the poverty line; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81a44885-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/1/B\"><num value=\"B\">(B)</num><content> the Secretary determines the reinstatement and resumption to be necessary.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44886-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Disability determinations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A borrower who has been determined by the Secretary of Veterans Affairs to be unemployable due to a service-connected condition and who provides documentation of such determination to the Secretary of Education, shall be considered permanently and totally disabled for the purpose of discharging such borrower’s loans under this subsection, and such borrower shall not be required to present additional documentation for purposes of this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44887-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Automatic income monitoring</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81a44888-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall establish and implement, with respect to any borrower described in subparagraph (B), procedures to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a44889-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/A/i\"><num value=\"i\">(i)</num><content> use return information disclosed under section 6103(<i>l</i>)(13) of title 26, pursuant to approval provided under <ref href=\"/us/usc/t20/s1098h\">section 1098h of this title</ref>, to determine the borrower’s continued eligibility for the loan discharge described in subparagraph (B);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a4488a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> allow the borrower, at any time, to opt out of disclosure under such section 6103(<i>l</i>)(13) and instead provide such information as the Secretary may require to determine the borrower’s continued eligibility for such loan discharge; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a4488b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/A/iii\"><num value=\"iii\">(iii)</num><content> provide the borrower with an opportunity to update the return information so disclosed before determination of such borrower’s continued eligibility for such loan discharge.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id81a4488c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Applicability</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Subparagraph (A) shall apply—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a4488d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/B/i\"><num value=\"i\">(i)</num><content> to each borrower of a loan that is discharged due to the total and permanent disability (within the meaning of this subsection) of the borrower; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81a4488e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/a/3/B/ii\"><num value=\"ii\">(ii)</num><content> during the period beginning on the date on which such loan is so discharged and ending on the first day on which such loan may no longer be reinstated.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81a4488f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Payment of claims on loans in bankruptcy</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall pay to the holder of a loan described in section 1078(a)(1)(A) or (B), 1078–1,<ref class=\"footnoteRef\" idref=\"fn002066\">1</ref><note type=\"footnote\" id=\"fn002066\"><num>1</num> See References in Text note below.</note> 1078–2, 1078–3, or 1078–8 of this title, the amount of the unpaid balance of principal and interest owed on such loan—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81a44890-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/b/1\"><num value=\"1\">(1)</num><content> when the borrower files for relief under chapter 12 or 13 of title 11;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81a44891-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/b/2\"><num value=\"2\">(2)</num><content> when the borrower who has filed for relief under chapter 7 or 11 of such title commences an action for a determination of dischargeability under section 523(a)(8)(B) of such title; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81a44892-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/b/3\"><num value=\"3\">(3)</num><content> for loans described in section 523(a)(8)(A) of such title, when the borrower files for relief under chapter 7 or 11 of such title.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81a44893-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Discharge</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44894-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If a borrower who received, on or after <date date=\"1986-01-01\">January 1, 1986</date>, a loan made, insured, or guaranteed under this part and the student borrower, or the student on whose behalf a parent borrowed, is unable to complete the program in which such student is enrolled due to the closure of the institution or if such student’s eligibility to borrow under this part was falsely certified by the eligible institution or was falsely certified as a result of a crime of identity theft, or if the institution failed to make a refund of loan proceeds which the institution owed to such student’s lender, then the Secretary shall discharge the borrower’s liability on the loan (including interest and collection fees) by repaying the amount owed on the loan and shall subsequently pursue any claim available to such borrower against the institution and its affiliates and principals or settle the loan obligation pursuant to the financial responsibility authority under subpart 3 of part H. In the case of a discharge based upon a failure to refund, the amount of the discharge shall not exceed that portion of the loan which should have been refunded. The Secretary shall report to the authorizing committees annually as to the dollar amount of loan discharges attributable to failures to make refunds.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44895-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Assignment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A borrower whose loan has been discharged pursuant to this subsection shall be deemed to have assigned to the United States the right to a loan refund up to the amount discharged against the institution and its affiliates and principals.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44896-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Eligibility for additional assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The period of a student’s attendance at an institution at which the student was unable to complete a course of study due to the closing of the institution shall not be considered for purposes of calculating the student’s period of eligibility for additional assistance under this subchapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44897-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A borrower whose loan has been discharged pursuant to this subsection shall not be precluded from receiving additional grants, loans, or work assistance under this subchapter for which the borrower would be otherwise eligible (but for the default on such discharged loan). The amount discharged under this subsection shall be treated the same as loans under <ref href=\"/us/usc/t20/s1087ee/a/5\">section 1087ee(a)(5) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81a44898-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Reporting</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall report to consumer reporting agencies with respect to loans which have been discharged pursuant to this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81a44899-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Repayment of loans to parents</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If a student on whose behalf a parent has received a loan described in <ref href=\"/us/usc/t20/s1078–2\">section 1078–2 of this title</ref> dies, then the Secretary shall discharge the borrower’s liability on the loan by repaying the amount owed on the loan.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id81a4489a-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIV/s437\">Pub. L. 103–208</ref>, set out as a note under <ref href=\"/us/usc/t20/s1051\">section 1051 of this title</ref>.</p>\n</note>\n<note style=\"-uslm-lc:I86\" topic=\"miscellaneous\" id=\"id81a448a4-3b28-11eb-8459-b1d1037aec5b\">\n<heading class=\"centered smallCaps\">Discharging the Federal Student Loan Debt of Totally and Permanently Disabled Veterans</heading>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Memorandum of President of the United States, <date date=\"2019-08-21\">Aug. 21, 2019</date>, 84 F.R. 44677, provided:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Memorandum for the Secretary of Education [and] the Secretary of Veterans Affairs</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Since our Founding, the United States has been blessed with men and women willing to serve in defense of our Nation and our ideals. Many of those answering the call to serve make the ultimate sacrifice for their country, and many others carry physical and emotional scars for the rest of their lives.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">The Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.], as amended by the Higher Education Opportunity Act in 2008 and other acts (Higher Education Act), honors veterans who are totally and permanently disabled as a result of their service to the Nation by providing for the discharge of their Federal student loan debt. Borrowers who have been determined by the Secretary of Veterans Affairs to be unemployable due to a service-connected condition and who provide documentation of that determination to the Secretary of Education are entitled to the discharge of such debt.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">For the last decade, veterans seeking loan discharges have been required to submit an application to the Secretary of Education with proof of their disabilities obtained from the Department of Veterans Affairs. The process has been overly complicated and difficult, and prevented too many of our veterans from receiving the relief for which they are eligible. This has inflicted significant hardship and serious harm on these veterans and has frustrated the intent of the Congress that their Federal student loan debt be discharged.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Only half of the approximately 50,000 totally and permanently disabled veterans who currently qualify for the discharge of their Federal student loan debt have availed themselves of the benefits provided to them by the Higher Education Act. This has created a serious and critical problem for disabled veterans, who must deal with the day-to-day consequences of their service-connected injuries, and for our military, as readiness and recruitment suffer when we do not take care of our veterans. There is a pressing need to quickly and effectively resolve this problem. Therefore, my Administration will take prompt action to ensure that all totally and permanently disabled veterans are able to obtain, with minimal burden, the Federal student loan debt discharges to which they are legally entitled.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Accordingly, by the authority vested in me as President by the Constitution and the laws of the United States of America, and to express the gratitude of our Nation for the service of our totally and permanently disabled veterans, I hereby direct the following:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Section</inline> 1. <i>Policy</i>. It shall be the policy of the Federal Government to facilitate—in a manner that is quick, efficient, and minimally burdensome—the discharge of Federal student loan debt for totally and permanently disabled veterans.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 2. <i>Directive to the Secretaries of Education and Veterans Affairs</i>. (a) The Secretary of Education is hereby directed to develop as soon as practicable a process, consistent with applicable law, to facilitate the swift and effective discharge of the Federal student loan debt of totally and permanently disabled veterans pursuant to section 437 of the Higher Education Act, <ref href=\"/us/usc/t20/s1087\">20 U.S.C. 1087</ref>; section 455 of the Higher Education Act, <ref href=\"/us/usc/t20/s1087e\">20 U.S.C. 1087e</ref>; and section 464 of the Higher Education Act, <ref href=\"/us/usc/t20/s1087dd\">20 U.S.C. 1087dd</ref>. To the maximum extent feasible and consistent with applicable law, the process developed by the Secretary of Education should account for and make use of disability determinations made available to the Secretary of Education by the Department of Veterans Affairs.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) The Secretaries of Education and Veterans Affairs (Secretaries) shall take appropriate action to implement the policy set forth in section 1 of this memorandum as expeditiously as possible. To that end, the Secretaries shall consider all pathways for the Department of Veterans Affairs to share disability determinations with the Department of Education, so that veterans may be relieved of the burdensome administrative impediments to Federal student loan debt discharge.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 3. <i>Definitions</i>. As used in this memorandum:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(a) the term “Federal student loan debt” means liability to repay Federal Family Education Loan (FFEL) Program loans, William D. Ford Federal Direct Loan (Direct Loan) Program loans, and Federal Perkins Loans.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) the term “discharge” means discharge of FFEL Program loans and Direct Loan Program loans and cancellation of Federal Perkins Loans.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 4. <i>General Provisions</i>. (a) Nothing in this memorandum shall be construed to impair or otherwise affect:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(i) the authority granted by law to an executive department or agency, or the head thereof; or</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(b) This memorandum shall be implemented consistent with applicable law and subject to the availability of appropriations.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(c) This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">(d) The Secretary of Education is hereby authorized and directed to publish this memorandum in the Federal Register.</p>\n<signature>\n<name>Donald J.
