L. 111–39, title IV, § 405(2), July 1, 2009, 123 Stat. 1947.)","seq_in_title":603,"parent_identifier":"/us/usc/t20/ch28/schIV/ptE","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28","level":"chapter","num":"CHAPTER 28—","heading":"HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIV/ptE","level":"part","num":"Part E—","heading":"Federal Perkins Loans","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id81d65560-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc\"><num value=\"1087cc\">§ 1087cc.</num><heading> Agreements with institutions of higher education</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d65561-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Contents of agreements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An agreement with any institution of higher education for the payment of Federal capital contributions under this part shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65562-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/1\"><num value=\"1\">(1)</num><content> provide for the establishment and maintenance of a student loan fund for the purpose of this part;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65563-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2\"><num value=\"2\">(2)</num><chapeau> provide for the deposit in such fund of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65564-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2/A\"><num value=\"A\">(A)</num><content> Federal capital contributions from funds appropriated under <ref href=\"/us/usc/t20/s1087aa\">section 1087aa of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65565-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2/B\"><num value=\"B\">(B)</num><content> a capital contribution by an institution in an amount equal to one-third of the Federal capital contributions described in subparagraph (A);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65566-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2/C\"><num value=\"C\">(C)</num><content> collections of principal and interest on student loans made from deposited funds;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65567-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2/D\"><num value=\"D\">(D)</num><content> charges collected pursuant to regulations under <ref href=\"/us/usc/t20/s1087dd/c/1/H\">section 1087dd(c)(1)(H) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65568-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/2/E\"><num value=\"E\">(E)</num><content> any other earnings of the funds;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65569-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/3\"><num value=\"3\">(3)</num><chapeau> provide that such student loan fund shall be used only for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d6556a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/3/A\"><num value=\"A\">(A)</num><content> loans to students, in accordance with the provisions of this part;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d6556b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/3/B\"><num value=\"B\">(B)</num><content> administrative expenses, as provided in subsection (b);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d6556c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/3/C\"><num value=\"C\">(C)</num><content> capital distributions, as provided in <ref href=\"/us/usc/t20/s1087ff\">section 1087ff of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d6556d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/3/D\"><num value=\"D\">(D)</num><content> costs of litigation, and other collection costs agreed to by the Secretary in connection with the collection of a loan from the fund (and interest thereon) or a charge assessed pursuant to regulations under <ref href=\"/us/usc/t20/s1087dd/c/1/H\">section 1087dd(c)(1)(H) of this title</ref>;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d6556e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/4\"><num value=\"4\">(4)</num><chapeau> provide that where a note or written agreement evidencing a loan has been in default despite due diligence on the part of the institution in attempting collection thereon—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d6556f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/4/A\"><num value=\"A\">(A)</num><chapeau> if the institution has knowingly failed to maintain an acceptable collection record with respect to such loan, as determined by the Secretary in accordance with criteria established by regulation, the Secretary may—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d65570-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/4/A/i\"><num value=\"i\">(i)</num><content> require the institution to assign such note or agreement to the Secretary, without recompense; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d65571-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/4/A/ii\"><num value=\"ii\">(ii)</num><content> apportion any sums collected on such a loan, less an amount not to exceed 30 percent of any sums collected to cover the Secretary’s collection costs, among other institutions in accordance with <ref href=\"/us/usc/t20/s1087bb\">section 1087bb of this title</ref>; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d65572-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/4/B\"><num value=\"B\">(B)</num><content> if the institution is not one described in subparagraph (A), the Secretary may allow such institution to refer such note or agreement to the Secretary, without recompense, except that, once every six months, any sums collected on such a loan (less an amount not to exceed 30 percent of any such sums collected to cover the Secretary’s collection costs) shall be repaid to such institution and treated as an additional capital contribution under <ref href=\"/us/usc/t20/s1087bb\">section 1087bb of this title</ref>;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65573-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/5\"><num value=\"5\">(5)</num><content> provide that, if an institution of higher education determines not to service and collect student loans made available from funds under this part, the institution will assign, at the beginning of the repayment period, notes or evidence of obligations of student loans made from such funds to the Secretary and the Secretary shall apportion any sums collected on such notes or obligations (less an amount not to exceed 30 percent of any such sums collected to cover that Secretary’s collection costs) among other institutions in accordance with <ref href=\"/us/usc/t20/s1087bb\">section 1087bb of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65574-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/6\"><num value=\"6\">(6)</num><content> provide that, notwithstanding any other provision of law, the Secretary will provide to the institution any information with respect to the names and addresses of borrowers or other relevant information which is available to the Secretary, from whatever source such information may be derived;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65575-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/7\"><num value=\"7\">(7)</num><content> provide assurances that the institution will comply with the provisions of <ref href=\"/us/usc/t20/s1087cc–1\">section 1087cc–1 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65576-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/8\"><num value=\"8\">(8)</num><content> provide that the institution of higher education will make loans first to students with exceptional need; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d65577-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/a/9\"><num value=\"9\">(9)</num><content> include such other reasonable provisions as may be necessary to protect the United States from unreasonable risk of loss and as are agreed to by the Secretary and the institution, except that nothing in this paragraph shall be construed to permit the Secretary to require the assignment of loans to the Secretary other than as is provided for in paragraphs (4) and (5).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d65578-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Administrative expenses</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">An institution which has entered into an agreement under subsection (a) shall be entitled, for each fiscal year during which it makes student loans from a student loan fund established under such agreement, to a payment in lieu of reimbursement for its expenses in administering its student loan program under this part during such year. Such payment shall be made in accordance with <ref href=\"/us/usc/t20/s1096\">section 1096 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d65579-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Cooperative agreements with consumer reporting agencies</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f6a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/1\"><num value=\"1\">(1)</num><content> For the purpose of promoting responsible repayment of loans made pursuant to this part, the Secretary and each institution of higher education participating in the program under this part shall enter into cooperative agreements with consumer reporting agencies to provide for the exchange of information concerning student borrowers concerning whom the Secretary has received a referral pursuant to <ref href=\"/us/usc/t20/s1087gg\">section 1087gg of this title</ref> and regarding loans held by the Secretary or an institution.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f6b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/2\"><num value=\"2\">(2)</num><chapeau> Each cooperative agreement made pursuant to paragraph (1) shall be made in accordance with the requirements of <ref href=\"/us/usc/t20/s1080a\">section 1080a of this title</ref> except that such agreement shall provide for the disclosure by the Secretary or an institution, as the case may be, to such consumer reporting agencies, with respect to any loan held by the Secretary or the institution, respectively, of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d89f6c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/2/A\"><num value=\"A\">(A)</num><content> the date of disbursement and the amount of such loans made to any borrower under this part at the time of disbursement of the loan;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d89f6d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/2/B\"><num value=\"B\">(B)</num><content> information concerning the repayment and collection of any such loan, including information concerning the status of such loan; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d89f6e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/2/C\"><num value=\"C\">(C)</num><content> the date of cancellation of the note upon completion of repayment by the borrower of any such loan, or upon cancellation or discharge of the borrower’s obligation on the loan for any reason.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f6f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/3\"><num value=\"3\">(3)</num><content> Notwithstanding paragraphs (4) and (5) of subsection (a) of <ref href=\"/us/usc/t15/s1681c\">section 1681c of title 15</ref>, a consumer reporting agency may make a report containing information received from the Secretary or an institution regarding the status of a borrower’s account on a loan made under this part until the loan is paid in full.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f70-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/4\"><num value=\"4\">(4)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f71-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/4/A\"><num value=\"A\">(A)</num><content> Except as provided in subparagraph (B), an institution of higher education, after consultation with the Secretary and pursuant to the agreements entered into under paragraph (1), shall disclose at least annually to any consumer reporting agency with which the Secretary has such an agreement the information set forth in paragraph (2), and shall disclose promptly to such consumer reporting agency any changes to the information previously disclosed.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f72-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/4/B\"><num value=\"B\">(B)</num><content> The Secretary may promulgate regulations establishing criteria under which an institution of higher education may cease reporting the information described in paragraph (2) before a loan is paid in full.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id81d89f73-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/c/5\"><num value=\"5\">(5)</num><content> Each institution of higher education shall notify the appropriate consumer reporting agencies whenever a borrower of a loan that is made and held by the institution and that is in default makes 6 consecutive monthly payments on such loan, for the purpose of encouraging such consumer reporting agencies to update the status of information maintained with respect to that borrower.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d89f74-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitation on use of interest bearing accounts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the provisions of subsection (a)(9), the Secretary may not require that any collection agency, collection attorney, or loan servicer collecting loans made under this part deposit amounts collected on such loans in interest bearing accounts, unless such agency, attorney, or servicer holds such amounts for more than 45 days.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d89f75-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087cc/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Special due diligence rule</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the provisions of subsection (a)(5) <ref class=\"footnoteRef\" idref=\"fn002082\">1</ref><note type=\"footnote\" id=\"fn002082\"><num>1</num> See References in Text note below.</note> relating to due diligence, the Secretary shall make every effort to ensure that institutions of higher education may use Internal Revenue Service skip-tracing collection procedures on loans made under this part.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id81d89f76-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIV/s463\">Pub.
