<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id81ccb86f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1087h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Budget justification</heading><content><p style="-uslm-lc:I11" class="indent0">No funds may be expended under this section unless the Secretary includes in the Department of Education’s annual budget justification to Congress a detailed description of the specific activities for which the funds made available by this section have been used in the prior and current years (if applicable), the activities and costs planned for the budget year, and the projection of activities and costs for each remaining year for which administrative expenses under this section are made available.</p>

L. 105–78, title VI, § 609(m)</ref>, <date date="1997-11-13">Nov. 13, 1997</date>, <ref href="/us/stat/111/1524">111 Stat. 1524</ref>, provided that: <quotedContent origin="/us/pl/105/78/tVI/s609/m">“Nothing in this Act [see Tables for classification] or an amendment made by this Act shall be construed to prohibit the Secretary of Education from using funds that are returned or otherwise recovered by the Secretary under section 422(g) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1072/g">20 U.S.C. 1072(g)</ref>) including the balances of returned reserve funds, formerly held by the Higher Education Assistance Foundation, that are currently held in Higher Education Assistance Foundation Claims Reserves, Treasury account number 91X6192, for expenditure for expenses pursuant to section 458 of such Act (<ref href="/us/usc/t20/s1087h">20 U.S.C. 1087h</ref>).”</quotedContent>

A, title I, § 101(e) [title III, § 304]</ref>, <date date="1996-09-30">Sept. 30, 1996</date>, <ref href="/us/stat/110/3009-233">110 Stat. 3009–233</ref>, 3009–261, provided in part that: <quotedContent origin="/us/pl/104/208/dA/tI/s101/e/tIII/s304">“Notwithstanding section 458 of the Higher Education Act [of 1965] [<ref href="/us/usc/t20/s1087h">20 U.S.C. 1087h</ref>], the Secretary may not use funds available under that section or any other section for subsequent fiscal years for administrative expenses of the William D. Ford Direct Loan Program.”</quotedContent>
