Ford Federal Direct Loan Program","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id81d173a7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j\"><num value=\"1087j\">§ 1087j.</num><heading> Loan cancellation for teachers</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173a8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Statement of purpose</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">It is the purpose of this section to encourage individuals to enter and continue in the teaching profession.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173a9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Program authorized</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall carry out a program of canceling the obligation to repay a qualified loan amount in accordance with subsection (c) for Federal Direct Stafford Loans and Federal Direct Unsubsidized Stafford Loans made under this part for any new borrower on or after <date date=\"1998-10-01\">October 1, 1998</date>, who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d173aa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/b/1\"><num value=\"1\">(1)</num><chapeau> has been employed as a full-time teacher for 5 consecutive complete school years—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173ab-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/b/1/A\"><num value=\"A\">(A)</num><content> in a school or location that qualifies under <ref href=\"/us/usc/t20/s1087ee/a/2/A\">section 1087ee(a)(2)(A) of this title</ref> for loan cancellation for Perkins loan recipients who teach in such schools or locations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173ac-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/b/1/B\"><num value=\"B\">(B)</num><content> if employed as an elementary school or secondary school teacher, is highly qualified as defined in section 9101 <ref class=\"footnoteRef\" idref=\"fn002080\">1</ref><note type=\"footnote\" id=\"fn002080\"><num>1</num> See References in Text note below.</note> of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7801\">20 U.S.C. 7801</ref>], or meets the requirements of subsection (g)(3); and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id81d173ad-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/b/2\"><num value=\"2\">(2)</num><content> is not in default on a loan for which the borrower seeks forgiveness.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173ae-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Qualified loan amounts</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173af-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall cancel not more than $5,000 in the aggregate of the loan obligation on a Federal Direct Stafford Loan or a Federal Direct Unsubsidized Stafford Loan that is outstanding after the completion of the fifth complete school year of teaching described in subsection (b)(1). No borrower may receive a reduction of loan obligations under both this section and <ref href=\"/us/usc/t20/s1078–10\">section 1078–10 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173b0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Treatment of consolidation loans</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A loan amount for a Federal Direct Consolidation Loan may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 1078 or 1078–8 of this title, for a borrower who meets the requirements of subsection (b), as determined in accordance with regulations prescribed by the Secretary.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173b1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Additional amounts for teachers in mathematics, science, or special education</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding the amount specified in paragraph (1), the aggregate amount that the Secretary shall cancel under this section shall be not more than $17,500 in the case of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173b2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/A\"><num value=\"A\">(A)</num><chapeau> a secondary school teacher—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d173b3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/A/i\"><num value=\"i\">(i)</num><content> who meets the requirements of subsection (b); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d173b4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/A/ii\"><num value=\"ii\">(ii)</num><content> whose qualifying employment for purposes of such subsection is teaching mathematics or science on a full-time basis; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173b5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/B\"><num value=\"B\">(B)</num><chapeau> an elementary school or secondary school teacher—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d173b6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/B/i\"><num value=\"i\">(i)</num><content> who meets the requirements of subsection (b);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d173b7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/B/ii\"><num value=\"ii\">(ii)</num><content> whose qualifying employment for purposes of such subsection is as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in <ref href=\"/us/usc/t20/s1401\">section 1401 of this title</ref>); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id81d173b8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/c/3/B/iii\"><num value=\"iii\">(iii)</num><content> who, as certified by the chief administrative officer of the public or non-profit private elementary school or secondary school in which the borrower is employed, or, in the case of a teacher who is employed by an educational service agency, as certified by the chief administrative officer of such agency, is teaching children with disabilities that correspond with the borrower’s special education training and has demonstrated knowledge and teaching skills in the content areas of the elementary school or secondary school curriculum that the borrower is teaching.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173b9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173ba-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to authorize any refunding of any canceled loan.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173bb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> List</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If the list of schools in which a teacher may perform service pursuant to subsection (b) is not available before May 1 of any year, the Secretary may use the list for the year preceding the year for which the determination is made to make such service determination.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173bc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Additional eligibility provisions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173bd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Continued eligibility</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Any teacher who performs service in a school that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173be-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/1/A\"><num value=\"A\">(A)</num><content> meets the requirements of subsection (b)(1)(A) in any year during such service; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173bf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/1/B\"><num value=\"B\">(B)</num><content> in a subsequent year fails to meet the requirements of such subsection, may continue to teach in such school and shall be eligible for loan cancellation pursuant to subsection (b).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173c0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Prevention of double benefits</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">No borrower may, for the same voluntary service, receive a benefit under both this section and—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173c1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/2/A\"><num value=\"A\">(A)</num><content> <ref href=\"/us/usc/t20/s1078–11\">section 1078–11 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173c2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/2/B\"><num value=\"B\">(B)</num><content> <ref href=\"/us/usc/t20/s1087e/m\">section 1087e(m) of this title</ref>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id81d173c3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/2/C\"><num value=\"C\">(C)</num><content> subtitle D of title I of the National and Community Service Act of 1990 (<ref href=\"/us/usc/t42/s12601\">42 U.S.C. 12601</ref> et seq.).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id81d173c4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Private school teachers</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An individual who is employed as a teacher in a private school and is exempt from State certification requirements (unless otherwise applicable under State law), may, in lieu of the requirement of subsection (b)(1)(B), have such employment treated as qualifying employment under this section if such individual is permitted to and does satisfy rigorous subject knowledge and skills tests by taking competency tests in the applicable grade levels and subject areas. For such purposes, the competency tests taken by such a private school teacher shall be recognized by 5 or more States for the purpose of fulfilling the highly qualified teacher requirements under section 9101 <sup>1</sup> of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7801\">20 U.S.C. 7801</ref>], and the score achieved by such teacher on each test shall equal or exceed the average passing score of those 5 States.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id81d173c5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1087j/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> “Year” defined</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For the purpose of this section, the term “year” where applied to service as a teacher means an academic year as defined by the Secretary.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id81d173c6-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIV/s460\">Pub.
