<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8201369c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091"><num value="1091">§ 1091.</num><heading> Student eligibility</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8201369d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">In order to receive any grant, loan, or work assistance under this subchapter, a student must—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8201369e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/1"><num value="1">(1)</num><content> be enrolled or accepted for enrollment in a degree, certificate, or other program (including a program of study abroad approved for credit by the eligible institution at which such student is enrolled) leading to a recognized educational credential at an institution of higher education that is an eligible institution in accordance with the provisions of <ref href="/us/usc/t20/s1094">section 1094 of this title</ref>, except as provided in subsections (b)(3) and (b)(4), and not be enrolled in an elementary or secondary school;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8201369f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/2"><num value="2">(2)</num><content> if the student is presently enrolled at an institution, be maintaining satisfactory progress in the course of study the student is pursuing in accordance with the provisions of subsection (c);(q)</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id820136a0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/3"><num value="3">(3)</num><content> not owe a refund on grants previously received at any institution under this subchapter, or be in default on any loan from a student loan fund at any institution provided for in part E, or a loan made, insured, or guaranteed by the Secretary under this subchapter for attendance at any institution;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id820136a1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/4"><num value="4">(4)</num><chapeau> file with the Secretary, as part of the original financial aid application process, a certification, which need not be notarized, but which shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id820136a2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/4/A"><num value="A">(A)</num><content> a statement of educational purpose stating that the money attributable to such grant, loan, or loan guarantee will be used solely for expenses related to attendance or continued attendance at such institution; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id820136a3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/4/B"><num value="B">(B)</num><content> such student’s social security number;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id820136a4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/5"><num value="5">(5)</num><content> be a citizen or national of the United States, a permanent resident of the United States, or able to provide evidence from the Immigration and Naturalization Service that he or she is in the United States for other than a temporary purpose with the intention of becoming a citizen or permanent resident; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id820136a5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/a/6"><num value="6">(6)</num><content> if the student has been convicted of, or has pled nolo contendere or guilty to, a crime involving fraud in obtaining funds under this subchapter, have completed the repayment of such funds to the Secretary, or to the holder in the case of a loan under this subchapter obtained by fraud.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id820136a6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligibility for student loans</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id820136a7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/1"><num value="1">(1)</num><chapeau> In order to be eligible to receive any loan under this subchapter (other than a loan under section 1078–2 or 1078–3 of this title, or under <ref href="/us/usc/t20/s1078–8">section 1078–8 of this title</ref> pursuant to an exercise of discretion under <ref href="/us/usc/t20/s1087tt">section 1087tt of this title</ref>) for any period of enrollment, a student who is not a graduate or professional student (as defined in regulations of the Secretary), and who is enrolled in a program at an institution which has a participation agreement with the Secretary to make awards under subpart 1 of part A of this subchapter, shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id820136a8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I12" class="indent1" id="id820136a9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/1/A/i"><num value="i">(i)</num><content> have received a determination of eligibility or ineligibility for a Pell Grant under such subpart 1 for such period of enrollment; and (ii) if determined to be eligible, have filed an application for a Pell Grant for such enrollment period; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id820136aa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/1/B"><num value="B">(B)</num><content> have (i) filed an application with the Pell Grant processor for such institution for such enrollment period, and (ii) received from the financial aid administrator of the institution a preliminary determination of the student’s eligibility or ineligibility for a grant under such subpart 1.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id820136ab-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/2"><num value="2">(2)</num><chapeau> In order to be eligible to receive any loan under section 1078–1 <ref class="footnoteRef" idref="fn002090">1</ref><note type="footnote" id="fn002090"><num>1</num> See References in Text note below.</note> of this title for any period of enrollment, a student shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id820136ac-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/2/A"><num value="A">(A)</num><content> have received a determination of need for a loan under <ref href="/us/usc/t20/s1078/a/2/B">section 1078(a)(2)(B) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id820136ad-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/2/B"><num value="B">(B)</num><content> if determined to have need for a loan under <ref href="/us/usc/t20/s1078">section 1078 of this title</ref>, have applied for such a loan; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id820136ae-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/2/C"><num value="C">(C)</num><content> has applied for a loan under <ref href="/us/usc/t20/s1078–8">section 1078–8 of this title</ref>, if such student is eligible to apply for such a loan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id820136af-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/3"><num value="3">(3)</num><chapeau> A student who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id820136b0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/3/A"><num value="A">(A)</num><content> is carrying at least one-half the normal full-time work load for the course of study that the student is pursuing, as determined by an eligible institution, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id820136b1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/3/B"><num value="B">(B)</num><content> is enrolled in a course of study necessary for enrollment in a program leading to a degree or certificate,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be, notwithstanding paragraph (1) of subsection (a), eligible to apply for loans under part B or D of this subchapter. The eligibility described in this paragraph shall be restricted to one 12-month period.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id820136b2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/4"><num value="4">(4)</num><chapeau> A student who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id820136b3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/4/A"><num value="A">(A)</num><content> is carrying at least one-half the normal full-time work load for the course of study the student is pursuing, as determined by the institution, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6b4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/4/B"><num value="B">(B)</num><content> is enrolled or accepted for enrollment in a program at an eligible institution necessary for a professional credential or certification from a State that is required for employment as a teacher in an elementary or secondary school in that State,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be, notwithstanding paragraph (1) of subsection (a), eligible to apply for loans under part B, D, or E or work-study assistance under part C of this subchapter.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6b5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/b/5"><num value="5">(5)</num><content> Notwithstanding any other provision of this subsection, no incarcerated student is eligible to receive a loan under this subchapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6b6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c"><num value="c" class="bold">(c)</num><heading class="bold"> Satisfactory progress</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6b7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/1"><num value="1">(1)</num><chapeau> For the purpose of subsection (a)(2), a student is maintaining satisfactory progress if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6b8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/1/A"><num value="A">(A)</num><content> the institution at which the student is in attendance, reviews the progress of the student at the end of each academic year, or its equivalent, as determined by the institution, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6b9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/1/B"><num value="B">(B)</num><content> the student has a cumulative C average, or its equivalent or academic standing consistent with the requirements for graduation, as determined by the institution, at the end of the second such academic year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6ba-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/2"><num value="2">(2)</num><content> Whenever a student fails to meet the eligibility requirements of subsection (a)(2) as a result of the application of this subsection and subsequent to that failure the student has academic standing consistent with the requirements for graduation, as determined by the institution, for any grading period, the student may, subject to this subsection, again be eligible under subsection (a)(2) for a grant, loan, or work assistance under this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6bb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/3"><num value="3">(3)</num><chapeau> Any institution of higher education at which the student is in attendance may waive the provisions of paragraph (1) or paragraph (2) of this subsection for undue hardship based on—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6bc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/3/A"><num value="A">(A)</num><content> the death of a relative of the student,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6bd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/3/B"><num value="B">(B)</num><content> the personal injury or illness of the student, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8203a6be-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/c/3/C"><num value="C">(C)</num><content> special circumstances as determined by the institution.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6bf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d"><num value="d" class="bold">(d)</num><heading class="bold"> Students who are not high school graduates</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6c0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Student eligibility</heading><chapeau style="-uslm-lc:I12" class="indent1">In order for a student who does not have a certificate of graduation from a school providing secondary education, or the recognized equivalent of such certificate, to be eligible for any assistance under subparts 1, 3, and 4 of part A and parts B, C, D, and E of this subchapter, the student shall meet the requirements of one of the following subparagraphs:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6c1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1/A"><num value="A">(A)</num><chapeau> The student is enrolled in an eligible career pathway program and meets one of the following standards:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8203a6c2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1/A/i"><num value="i">(i)</num><content> The student shall take an independently administered examination and shall achieve a score, specified by the Secretary, demonstrating that such student can benefit from the education or training being offered. Such examination shall be approved by the Secretary on the basis of compliance with such standards for development, administration, and scoring as the Secretary may prescribe in regulations.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a6c3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1/A/ii"><num value="ii">(ii)</num><content> The student shall be determined as having the ability to benefit from the education or training in accordance with such process as the State shall prescribe. Any such process described or approved by a State for the purposes of this section shall be effective 6 months after the date of submission to the Secretary unless the Secretary disapproves such process. In determining whether to approve or disapprove such process, the Secretary shall take into account the effectiveness of such process in enabling students without secondary school diplomas or the equivalent thereof to benefit from the instruction offered by institutions utilizing such process, and shall also take into account the cultural diversity, economic circumstances, and educational preparation of the populations served by the institutions.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a6c4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1/A/iii"><num value="iii">(iii)</num><content> The student shall be determined by the institution of higher education as having the ability to benefit from the education or training offered by the institution of higher education upon satisfactory completion of 6 credit hours or the equivalent coursework that are applicable toward a degree or certificate offered by the institution of higher education.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6c5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/1/B"><num value="B">(B)</num><content> The student has completed a secondary school education in a home school setting that is treated as a home school or private school under State law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6c6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Eligible career pathway program</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection, the term “eligible career pathway program” means a program that combines rigorous and high-quality education, training, and other services that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6c7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/A"><num value="A">(A)</num><content> aligns with the skill needs of industries in the economy of the State or regional economy involved;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6c8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/B"><num value="B">(B)</num><content> prepares an individual to be successful in any of a full range of secondary or postsecondary education options, including apprenticeships registered under the Act of <date date="1937-08-16">August 16, 1937</date> (commonly known as the “National Apprenticeship Act”; <ref href="/us/stat/50/664">50 Stat. 664</ref>, chapter 663; <ref href="/us/usc/t29/s50">29 U.S.C. 50</ref> et seq.) (referred to individually in this chapter as an “apprenticeship”, except in section 171); <sup>1</sup></content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6c9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/C"><num value="C">(C)</num><content> includes counseling to support an individual in achieving the individual’s education and career goals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6ca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/D"><num value="D">(D)</num><content> includes, as appropriate, education offered concurrently with and in the same context as workforce preparation activities and training for a specific occupation or occupational cluster;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6cb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/E"><num value="E">(E)</num><content> organizes education, training, and other services to meet the particular needs of an individual in a manner that accelerates the educational and career advancement of the individual to the extent practicable;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6cc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/F"><num value="F">(F)</num><content> enables an individual to attain a secondary school diploma or its recognized equivalent, and at least 1 recognized postsecondary credential; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6cd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/d/2/G"><num value="G">(G)</num><content> helps an individual enter or advance within a specific occupation or occupational cluster.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6ce-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/e"><num value="e" class="bold">(e)</num><heading class="bold"> Certification for GSL eligibility</heading><chapeau style="-uslm-lc:I11" class="indent0">Each eligible institution may certify student eligibility for a loan by an eligible lender under part B of this subchapter prior to completing the review for accuracy of the information submitted by the applicant required by regulations issued under this subchapter, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6cf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/e/1"><num value="1">(1)</num><content> checks for the loans are mailed to the eligible institution prior to disbursements;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6d0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/e/2"><num value="2">(2)</num><content> the disbursement is not made until the review is complete; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6d1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/e/3"><num value="3">(3)</num><content> the eligible institution has no evidence or documentation on which the institution may base a determination that the information submitted by the applicant is incorrect.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6d2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/f"><num value="f" class="bold">(f)</num><heading class="bold"> Loss of eligibility for violation of loan limits</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6d3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/f/1"><num value="1">(1)</num><content> No student shall be eligible to receive any grant, loan, or work assistance under this subchapter if the eligible institution determines that the student fraudulently borrowed in violation of the annual loan limits under part B, part D, or part E of this subchapter in the same academic year, or if the student fraudulently borrowed in excess of the aggregate maximum loan limits under such part B, part D, or part E.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8203a6d4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/f/2"><num value="2">(2)</num><content> If the institution determines that the student inadvertently borrowed amounts in excess of such annual or aggregate maximum loan limits, such institution shall allow the student to repay any amount borrowed in excess of such limits prior to certifying the student’s eligibility for further assistance under this subchapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6d5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g"><num value="g" class="bold">(g)</num><heading class="bold"> Verification of immigration status</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6d6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall implement a system under which the statements and supporting documentation, if required, of an individual declaring that such individual is in compliance with the requirements of subsection (a)(5) shall be verified prior to the individual’s receipt of a grant, loan, or work assistance under this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6d7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I12" class="indent1">The documents collected and maintained by an eligible institution in the admission of a student to the institution may be used by the student in lieu of the documents used to establish both employment authorization and identity under <ref href="/us/usc/t8/s1324a/b/1/B">section 1324a(b)(1)(B) of title 8</ref> to verify eligibility to participate in work-study programs under part C of this subchapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6d8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Verification mechanisms</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary is authorized to verify such statements and supporting documentation through a data match, using an automated or other system, with other Federal agencies that may be in possession of information relevant to such statements and supporting documentation.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6d9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Review</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of such an individual who is not a citizen or national of the United States, if the statement described in paragraph (1) is submitted but the documentation required under paragraph (2) is not presented or if the documentation required under paragraph (2)(A) is presented but such documentation is not verified under paragraph (3)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6da-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/A"><num value="A">(A)</num><chapeau> the institution—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8203a6db-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/A/i"><num value="i">(i)</num><content> shall provide a reasonable opportunity to submit to the institution evidence indicating a satisfactory immigration status, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a6dc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/A/ii"><num value="ii">(ii)</num><content> may not delay, deny, reduce, or terminate the individual’s eligibility for the grant, loan, or work assistance on the basis of the individual’s immigration status until such a reasonable opportunity has been provided; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6dd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/B"><num value="B">(B)</num><chapeau> if there are submitted documents which the institution determines constitute reasonable evidence indicating such status—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8203a6de-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/B/i"><num value="i">(i)</num><content> the institution shall transmit to the Immigration and Naturalization Service either photostatic or other similar copies of such documents, or information from such documents, as specified by the Immigration and Naturalization Service, for official verification,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a6df-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/B/ii"><num value="ii">(ii)</num><content> pending such verification, the institution may not delay, deny, reduce, or terminate the individual’s eligibility for the grant, loan, or work assistance on the basis of the individual’s immigration status, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a6e0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/g/4/B/iii"><num value="iii">(iii)</num><content> the institution shall not be liable for the consequences of any action, delay, or failure of the Service to conduct such verification.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6e1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/h"><num value="h" class="bold">(h)</num><heading class="bold"> Limitations of enforcement actions against institutions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall not take any compliance, disallowance, penalty, or other regulatory action against an institution of higher education with respect to any error in the institution’s determination to make a student eligible for a grant, loan, or work assistance based on citizenship or immigration status—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/h/1"><num value="1">(1)</num><content> if the institution has provided such eligibility based on a verification of satisfactory immigration status by the Immigration and Naturalization Service,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/h/2"><num value="2">(2)</num><content> because the institution, under subsection (g)(4)(A)(i), was required to provide a reasonable opportunity to submit documentation, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/h/3"><num value="3">(3)</num><content> because the institution, under subsection (g)(4)(B)(i), was required to wait for the response of the Immigration and Naturalization Service to the institution’s request for official verification of the immigration status of the student.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6e5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/i"><num value="i" class="bold">(i)</num><heading class="bold"> Validity of loan guarantees for loan payments made before immigration status verification completed</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding subsection (h),<sup>1</sup> if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/i/1"><num value="1">(1)</num><content> a guaranty is made under this subchapter for a loan made with respect to an individual,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/i/2"><num value="2">(2)</num><content> at the time the guaranty is entered into, the provisions of subsection (h) <sup>1</sup> had been complied with,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/i/3"><num value="3">(3)</num><content> amounts are paid under the loan subject to such guaranty, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/i/4"><num value="4">(4)</num><content> there is a subsequent determination that, because of an unsatisfactory immigration status, the individual is not eligible for the loan,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the official of the institution making the determination shall notify and instruct the entity making the loan to cease further payments under the loan, but such guaranty shall not be voided or otherwise nullified with respect to such payments made before the date the entity receives the notice.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/j"><num value="j" class="bold">(j)</num><heading class="bold"> Repealed. <ref href="/us/pl/110/315/tIV/s485/a/4">Pub. <subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/k"><num value="k" class="bold">(k)</num><heading class="bold"> Special rule for correspondence courses</heading><content><p style="-uslm-lc:I11" class="indent0">A student shall not be eligible to receive grant, loan, or work assistance under this subchapter for a correspondence course unless such course is part of a program leading to an associate, bachelor or graduate degree.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l"><num value="l" class="bold">(l)</num><heading class="bold"> Courses offered through distance education</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l/1"><num value="1" class="bold">(1)</num><heading class="bold"> Relation to correspondence courses</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8203a6ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A student enrolled in a course of instruction at an institution of higher education that is offered principally through distance education and leads to a recognized certificate, or recognized associate, recognized baccalaureate, or recognized graduate degree, conferred by such institution, shall not be considered to be enrolled in correspondence courses.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8203a6ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I13" class="indent2">An institution of higher education referred to in subparagraph (A) shall not include an institution or school described in <ref href="/us/usc/t20/s2302/3/C">section 2302(3)(C) of this title</ref>.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reductions of financial aid</heading><content><p style="-uslm-lc:I12" class="indent1">A student’s eligibility to receive grants, loans, or work assistance under this subchapter shall be reduced if a financial aid officer determines under the discretionary authority provided in <ref href="/us/usc/t20/s1087tt">section 1087tt of this title</ref> that distance education results in a substantially reduced cost of attendance to such student.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a6f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/l/3"><num value="3" class="bold">(3)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I12" class="indent1">For award years beginning prior to <date date="2008-07-01">July 1, 2008</date>, the Secretary shall not take any compliance, disallowance, penalty, or other action based on a violation of this subsection against a student or an eligible institution when such action arises out of such institution’s prior award of student assistance under this subchapter if the institution demonstrates to the satisfaction of the Secretary that its course of instruction would have been in conformance with the requirements of this subsection.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6f2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/m"><num value="m" class="bold">(m)</num><heading class="bold"> Students with a first baccalaureate or professional degree</heading><content><p style="-uslm-lc:I11" class="indent0">A student shall not be ineligible for assistance under parts B, C, D, and E of this subchapter because such student has previously received a baccalaureate or professional degree.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6f3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/n"><num value="n" class="bold">(n)</num><heading class="bold"> Data base matching</heading><content><p style="-uslm-lc:I11" class="indent0">To enforce the Selective Service registration provisions of <ref href="/us/usc/t50/s3811/f">section 3811(f) of title 50</ref>, the Secretary shall conduct data base matches with the Selective Service, using common demographic data elements. Appropriate confirmation, through an application output document or through other means, of any person’s registration shall fulfill the requirement to file a separate statement of compliance. In the absence of a confirmation from such data matches, an institution may also use data or documents that support either the student’s registration, or the absence of a registration requirement for the student, to fulfill the requirement to file a separate statement of compliance. The mechanism for reporting the resolution of nonconfirmed matches shall be prescribed by the Secretary in regulations.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6f4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/o"><num value="o" class="bold">(o)</num><heading class="bold"> Study abroad</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this chapter shall be construed to limit or otherwise prohibit access to study abroad programs approved by the home institution at which a student is enrolled. An otherwise eligible student who is engaged in a program of study abroad approved for academic credit by the home institution at which the student is enrolled shall be eligible to receive grant, loan, or work assistance under this subchapter, without regard to whether such study abroad program is required as part of the student’s degree program.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a6f5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p"><num value="p" class="bold">(p)</num><heading class="bold"> Verification of social security number</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Education, in cooperation with the Commissioner of the Social Security Administration, shall verify any social security number provided by a student to an eligible institution under subsection (a)(4) and shall enforce the following conditions:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6f6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/1"><num value="1">(1)</num><content> Except as provided in paragraphs (2) and (3), an institution shall not deny, reduce, delay, or terminate a student’s eligibility for assistance under this part because social security number verification is pending.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6f7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/2"><num value="2">(2)</num><content> If there is a determination by the Secretary that the social security number provided to an eligible institution by a student is incorrect, the institution shall deny or terminate the student’s eligibility for any grant, loan, or work assistance under this subchapter until such time as the student provides documented evidence of a social security number that is determined by the institution to be correct.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6f8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/3"><num value="3">(3)</num><content> If there is a determination by the Secretary that the social security number provided to an eligible institution by a student is incorrect, and a correct social security number cannot be provided by such student, and a loan has been guaranteed for such student under part B of this subchapter, the institution shall notify and instruct the lender and guaranty agency making and guaranteeing the loan, respectively, to cease further disbursements of the loan, but such guaranty shall not be voided or otherwise nullified with respect to such disbursements made before the date that the lender and the guaranty agency receives such notice.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8203a6f9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/4"><num value="4">(4)</num><chapeau> Nothing in this subsection shall permit the Secretary to take any compliance, disallowance, penalty, or other regulatory action against—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6fa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/4/A"><num value="A">(A)</num><content> any institution of higher education with respect to any error in a social security number, unless such error was a result of fraud on the part of the institution; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a6fb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/p/4/B"><num value="B">(B)</num><content> any student with respect to any error in a social security number, unless such error was a result of fraud on the part of the student.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a700-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/r/2"><num value="2" class="bold">(2)</num><heading class="bold"> Rehabilitation</heading><chapeau style="-uslm-lc:I12" class="indent1">A student whose eligibility has been suspended under paragraph (1) may resume eligibility before the end of the ineligibility period determined under such paragraph if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a701-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/r/2/A"><num value="A">(A)</num><chapeau> the student satisfactorily completes a drug rehabilitation program that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8203a702-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/r/2/A/i"><num value="i">(i)</num><content> complies with such criteria as the Secretary shall prescribe in regulations for purposes of this paragraph; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8203a703-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/r/2/A/ii"><num value="ii">(ii)</num><content> includes two unannounced drug tests;</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a704-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/r/2/B"><num value="B">(B)</num><content> the student successfully passes two unannounced drug tests conducted by a drug rehabilitation program that complies with such criteria as the Secretary shall prescribe in regulations for purposes of subparagraph (A)(i); or</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a707-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s"><num value="s" class="bold">(s)</num><heading class="bold"> Students with intellectual disabilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a708-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection the terms “comprehensive transition and postsecondary program for students with intellectual disabilities” and “student with an intellectual disability” have the meanings given the terms in <ref href="/us/usc/t20/s1140">section 1140 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a709-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">Notwithstanding subsections (a), (c), and (d), in order to receive any grant or work assistance under <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>, subpart 3 of part A, or part C, a student with an intellectual disability shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a70a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/2/A"><num value="A">(A)</num><content> be enrolled or accepted for enrollment in a comprehensive transition and postsecondary program for students with intellectual disabilities at an institution of higher education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a70b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/2/B"><num value="B">(B)</num><content> be maintaining satisfactory progress in the program as determined by the institution, in accordance with standards established by the institution; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8203a70c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/2/C"><num value="C">(C)</num><content> meet the requirements of paragraphs (3), (4), (5), and (6) of subsection (a).</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a70d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/3"><num value="3" class="bold">(3)</num><heading class="bold"> Authority</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law unless such provision is enacted with specific reference to this section, the Secretary is authorized to waive any statutory provision applicable to the student financial assistance programs under <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>, subpart 3 of part A, or part C (other than a provision of part F related to such a program), or any institutional eligibility provisions of this subchapter, as the Secretary determines necessary to ensure that programs enrolling students with intellectual disabilities otherwise determined to be eligible under this subsection may receive such financial assistance.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a70e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/s/4"><num value="4" class="bold">(4)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding regulations applicable to grant or work assistance awards made under <ref href="/us/usc/t20/s1070a">section 1070a of this title</ref>, subpart 3 of part A, and part C (other than a regulation under part F related to such an award), including with respect to eligible programs, instructional time, credit status, and enrollment status as described in <ref href="/us/usc/t20/s1088">section 1088 of this title</ref>, the Secretary shall promulgate regulations allowing programs enrolling students with intellectual disabilities otherwise determined to be eligible under this subsection to receive such awards.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8203a70f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/t"><num value="t" class="bold">(t)</num><heading class="bold"> Data analysis on access to Federal student aid for certain populations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a710-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/t/1"><num value="1" class="bold">(1)</num><heading class="bold"> Development of the system</heading><content><p style="-uslm-lc:I12" class="indent1">Within one year of <date date="2008-08-14">August 14, 2008</date>, the Secretary shall analyze data from the FAFSA containing information regarding the number, characteristics, and circumstances of students denied Federal student aid based on a drug conviction while receiving Federal aid.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a711-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/t/2"><num value="2" class="bold">(2)</num><heading class="bold"> Results from analysis</heading><content><p style="-uslm-lc:I12" class="indent1">The results from the analysis of such information shall be made available on a continuous basis via the Department website and the Digest of Education Statistics.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8203a712-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1091/t/3"><num value="3" class="bold">(3)</num><heading class="bold"> Data updating</heading><content><p style="-uslm-lc:I12" class="indent1">The data analyzed under this subsection shall be updated at the beginning of each award year and at least one additional time during such award year.</p>
