L. 105–244, title IV, § 491(2), Oct. 7, 1998, 112 Stat. 1758.)","seq_in_title":665,"parent_identifier":"/us/usc/t20/ch28/schIV/ptH/spt1","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28","level":"chapter","num":"CHAPTER 28—","heading":"HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"STUDENT ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIV/ptH","level":"part","num":"Part H—","heading":"Program Integrity","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch28/schIV/ptH/spt1","level":"subpart","num":"subpart 1—","heading":"state role","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8224eb00-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a\"><num value=\"1099a\">§ 1099a.</num><heading> State responsibilities</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8224eb01-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> State responsibilities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As part of the integrity program authorized by this part, each State, through one State agency or several State agencies selected by the State, shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8224eb02-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a/1\"><num value=\"1\">(1)</num><content> furnish the Secretary, upon request, information with respect to the process for licensing or other authorization for institutions of higher education to operate within the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8224eb03-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a/2\"><num value=\"2\">(2)</num><content> notify the Secretary promptly whenever the State revokes a license or other authority to operate an institution of higher education; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8224eb04-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a/3\"><num value=\"3\">(3)</num><chapeau> notify the Secretary promptly whenever the State has credible evidence that an institution of higher education within the State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8224eb05-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a/3/A\"><num value=\"A\">(A)</num><content> has committed fraud in the administration of the student assistance programs authorized by this subchapter; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8224eb06-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/a/3/B\"><num value=\"B\">(B)</num><content> has substantially violated a provision of this subchapter.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8224eb07-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1099a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Institutional responsibility</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each institution of higher education shall provide evidence to the Secretary that the institution has authority to operate within a State at the time the institution is certified under subpart 3 of this part.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8224eb08-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/329/tIV/s495\">Pub.
