<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id822e8806-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a"><num value="1103a">§ 1103a.</num><heading> Waiver authority and reporting requirement</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id822e8807-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Waiver requirements; need-based assistance students</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may waive the requirements set forth in <ref href="/us/usc/t20/s1101a/a/2/A/i">section 1101a(a)(2)(A)(i) of this title</ref> in the case of an institution—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id822e8808-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a/1"><num value="1">(1)</num><content> that is extensively subsidized by the State in which the institution is located and charges low or no tuition;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id822e8809-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a/2"><num value="2">(2)</num><content> that serves a substantial number of low-income students as a percentage of the institution’s total student population;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id822e880a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a/3"><num value="3">(3)</num><content> that is contributing substantially to increasing higher education opportunities for educationally disadvantaged, underrepresented, or minority students, who are low-income individuals;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id822e880b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a/4"><num value="4">(4)</num><content> which is substantially increasing higher educational opportunities for individuals in rural or other isolated areas which are unserved by postsecondary institutions; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id822e880c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/a/5"><num value="5">(5)</num><content> wherever located, if the Secretary determines that the waiver will substantially increase higher education opportunities appropriate to the needs of Hispanic Americans.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id822e880d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Waiver determinations; expenditures</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id822e880e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Waiver determinations</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may waive the requirements set forth in <ref href="/us/usc/t20/s1101a/a/2/A/ii">section 1101a(a)(2)(A)(ii) of this title</ref> if the Secretary determines, based on persuasive evidence submitted by the institution, that the institution’s failure to meet the requirements is due to factors which, when used in the determination of compliance with the requirements, distort such determination, and that the institution’s designation as an eligible institution under part A is otherwise consistent with the purposes of this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id822e880f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Expenditures</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall submit to Congress every other year a report concerning the institutions that, although not satisfying the requirements of <ref href="/us/usc/t20/s1101a/a/2/A/ii">section 1101a(a)(2)(A)(ii) of this title</ref>, have been determined to be eligible institutions under part A. Such report shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id822e8810-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/b/2/A"><num value="A">(A)</num><content> identify the factors referred to in paragraph (1) that were considered by the Secretary as factors that distorted the determination of compliance with clauses (i) and (ii) of <ref href="/us/usc/t20/s1101a/a/2/A">section 1101a(a)(2)(A) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id822e8811-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1103a/b/2/B"><num value="B">(B)</num><content> contain a list of each institution determined to be an eligible institution under part A including a statement of the reasons for each such determination.</content>
