and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id827861c0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/a/2\"><num value=\"2\">(2)</num><content> has legally binding effect in connection with, or affecting, the provision of financial assistance under any applicable program.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id827861c1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Citation of authority</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Regulations shall contain, immediately following each substantive provision of such regulations, citations to the particular section or sections of statutory law or other legal authority on which such provision is based.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id827861c2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Uniform application</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">All regulations shall be uniformly applied and enforced throughout the 50 States.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id827861c3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application of exemption</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The exemption for public property, loans, grants and benefits in <ref href=\"/us/usc/t5/s553/a/2\">section 553(a)(2) of title 5</ref> shall apply only to regulations—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id827861c4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/d/1\"><num value=\"1\">(1)</num><content> that govern the first grant competition under a new or substantially revised program authority as determined by the Secretary; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id827861c5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/d/2\"><num value=\"2\">(2)</num><content> where the Secretary determines that the requirements of this subsection will cause extreme hardship to the intended beneficiaries of the program affected by such regulations.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id827861c6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Schedule for promulgation of final regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 60 days after the date of enactment of any Act, or any portion of any Act, affecting the administration of any applicable program, the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Labor and Human Resources of the Senate a schedule in accordance with which the Secretary plans to promulgate final regulations that the Secretary determines are necessary to implement such Act or portion of such Act. Such schedule shall provide that all such final regulations shall be promulgated within 360 days after the date of enactment of such Act or portion of such Act.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id827861c7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1232/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Transmittal of final regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Concurrently with the publication of any final regulations, the Secretary shall transmit a copy of such final regulations to the Speaker of the House of Representatives and the President pro tempore of the Senate.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id827861c8-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/90/247/tIV/s437\">Pub. L. 92–318, title V, § 503</ref>, <date date=\"1972-06-23\">June 23, 1972</date>, <ref href=\"/us/stat/86/346\">86 Stat. 346</ref>, provided for a study by the Commissioner of all rules, regulations, etc., in connection with the administration of any program to which the General Education Provisions Act [this chapter] applies, with a report to be submitted to Congress not later than one year after <date date=\"1972-06-23\">June 23, 1972</date>. Such section further mandated the publication of all rules, regulations, etc., in the Federal Register not later than 60 days after submission of such report, followed by a public hearing on such matters within the 60 day period following such publication.
