L. 100–297, title III, § 3501(a), Apr. 28, 1988, 102 Stat. 355.)","seq_in_title":884,"parent_identifier":"/us/usc/t20/ch31/schIV","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch31","level":"chapter","num":"CHAPTER 31—","heading":"GENERAL PROVISIONS CONCERNING EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch31/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"ENFORCEMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82844860-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e\"><num value=\"1234e\">§ 1234e.</num><heading> Cease and desist orders</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82844861-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Issuance and contents of complaint</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In accordance with <ref href=\"/us/usc/t20/s1234c\">section 1234c of this title</ref>, the Secretary may issue to a recipient under an applicable program a complaint which—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82844862-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/a/1\"><num value=\"1\">(1)</num><content> describes the factual and legal basis for the Secretary’s belief that the recipient is failing to comply substantially with a requirement of law; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82844863-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/a/2\"><num value=\"2\">(2)</num><content> contains a notice of a hearing to be held before the Office on a date at least 30 days after the service of the complaint.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82844864-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Appearance contesting order</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The recipient upon which a complaint has been served shall have the right to appear before the Office on the date specified and to show cause why an order should not be entered by the Office requiring the recipient to cease and desist from the violation of law charged in the complaint.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82844865-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Report; issuance of cease and desist order</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The testimony in any hearing held under this section shall be reduced to writing and filed with the Office. If upon that hearing the Office is of the opinion that the recipient is in violation of any requirement of law as charged in the complaint, the Office shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82844866-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/c/1\"><num value=\"1\">(1)</num><content> make a report in writing stating its findings of fact; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82844867-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/c/2\"><num value=\"2\">(2)</num><content> issue to the recipient an order requiring the recipient to cease and desist from the practice, policy, or procedure which resulted in the violation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82844868-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Report and order as final agency action</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The report and order of the Office under this section shall become the final agency action when the recipient receives the report and order.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82844869-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Enforcement of final order</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may enforce a final order of the Office under this section which becomes final agency action by—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8284486a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/e/1\"><num value=\"1\">(1)</num><content> withholding from the recipient any portion of the amount payable to it, including the amount payable for administrative costs, under the applicable program; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8284486b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1234e/e/2\"><num value=\"2\">(2)</num><content> certifying the facts to the Attorney General who shall cause an appropriate proceeding to be brought for the enforcement of the order.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8284486c-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/90/247/tIV/s456\">Pub.
