L. 108–446, title I, § 101, Dec. 3, 2004, 118 Stat. 2659.)","seq_in_title":899,"parent_identifier":"/us/usc/t20/ch33/schI","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33","level":"chapter","num":"CHAPTER 33—","heading":"EDUCATION OF INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82892a84-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406\"><num value=\"1406\">§ 1406.</num><heading> Requirements for prescribing regulations</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a85-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out the provisions of this chapter, the Secretary shall issue regulations under this chapter only to the extent that such regulations are necessary to ensure that there is compliance with the specific requirements of this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a86-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Protections provided to children</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may not implement, or publish in final form, any regulation prescribed pursuant to this chapter that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a87-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/b/1\"><num value=\"1\">(1)</num><content> violates or contradicts any provision of this chapter; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a88-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/b/2\"><num value=\"2\">(2)</num><content> procedurally or substantively lessens the protections provided to children with disabilities under this chapter, as embodied in regulations in effect on <date date=\"1983-07-20\">July 20, 1983</date> (particularly as such protections related to parental consent to initial evaluation or initial placement in special education, least restrictive environment, related services, timelines, attendance of evaluation personnel at individualized education program meetings, or qualifications of personnel), except to the extent that such regulation reflects the clear and unequivocal intent of Congress in legislation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a89-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Public comment period</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide a public comment period of not less than 75 days on any regulation proposed under subchapter II or subchapter III on which an opportunity for public comment is otherwise required by law.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a8a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Policy letters and statements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may not issue policy letters or other statements (including letters or statements regarding issues of national significance) that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a8b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/d/1\"><num value=\"1\">(1)</num><content> violate or contradict any provision of this chapter; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a8c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/d/2\"><num value=\"2\">(2)</num><content> establish a rule that is required for compliance with, and eligibility under, this chapter without following the requirements of <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a8d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Explanation and assurances</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Any written response by the Secretary under subsection (d) regarding a policy, question, or interpretation under subchapter II shall include an explanation in the written response that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a8e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/e/1\"><num value=\"1\">(1)</num><content> such response is provided as informal guidance and is not legally binding;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a8f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/e/2\"><num value=\"2\">(2)</num><content> when required, such response is issued in compliance with the requirements of <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a90-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/e/3\"><num value=\"3\">(3)</num><content> such response represents the interpretation by the Department of Education of the applicable statutory or regulatory requirements in the context of the specific facts presented.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a91-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Correspondence from Department of Education describing interpretations of this chapter</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82892a92-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall, on a quarterly basis, publish in the Federal Register, and widely disseminate to interested entities through various additional forms of communication, a list of correspondence from the Department of Education received by individuals during the previous quarter that describes the interpretations of the Department of Education of this chapter or the regulations implemented pursuant to this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82892a93-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Additional information</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For each item of correspondence published in a list under paragraph (1), the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82892a94-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/f/2/A\"><num value=\"A\">(A)</num><content> identify the topic addressed by the correspondence and shall include such other summary information as the Secretary determines to be appropriate; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82892a95-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1406/f/2/B\"><num value=\"B\">(B)</num><content> ensure that all such correspondence is issued, where applicable, in compliance with the requirements of <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id82892a96-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s607\">Pub.
