L. 108–446, title I, § 101, Dec. 3, 2004, 118 Stat. 2661.)","seq_in_title":900,"parent_identifier":"/us/usc/t20/ch33/schI","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33","level":"chapter","num":"CHAPTER 33—","heading":"EDUCATION OF INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82892a99-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407\"><num value=\"1407\">§ 1407.</num><heading> State administration</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a9a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Rulemaking</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State that receives funds under this chapter shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a9b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407/a/1\"><num value=\"1\">(1)</num><content> ensure that any State rules, regulations, and policies relating to this chapter conform to the purposes of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a9c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407/a/2\"><num value=\"2\">(2)</num><content> identify in writing to local educational agencies located in the State and the Secretary any such rule, regulation, or policy as a State-imposed requirement that is not required by this chapter and Federal regulations; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82892a9d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407/a/3\"><num value=\"3\">(3)</num><content> minimize the number of rules, regulations, and policies to which the local educational agencies and schools located in the State are subject under this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82892a9e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1407/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Support and facilitation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">State rules, regulations, and policies under this chapter shall support and facilitate local educational agency and school-level system improvement designed to enable children with disabilities to meet the challenging State student academic achievement standards.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id82892a9f-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s608\">Pub.
