<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8299cccb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417"><num value="1417">§ 1417.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cccc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/a"><num value="a" class="bold">(a)</num><heading class="bold"> Responsibilities of Secretary</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8299cccd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/a/1"><num value="1">(1)</num><chapeau> cooperate with, and (directly or by grant or contract) furnish technical assistance necessary to, a State in matters relating to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8299ccce-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/a/1/A"><num value="A">(A)</num><content> the education of children with disabilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8299cccf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/a/1/B"><num value="B">(B)</num><content> carrying out this subchapter; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299ccd0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/a/2"><num value="2">(2)</num><content> provide short-term training programs and institutes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299ccd1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/b"><num value="b" class="bold">(b)</num><heading class="bold"> Prohibition against Federal mandates, direction, or control</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this chapter shall be construed to authorize an officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school’s specific instructional content, academic achievement standards and assessments, curriculum, or program of instruction.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299ccd2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/c"><num value="c" class="bold">(c)</num><heading class="bold"> Confidentiality</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall take appropriate action, in accordance with <ref href="/us/usc/t20/s1232g">section 1232g of this title</ref>, to ensure the protection of the confidentiality of any personally identifiable data, information, and records collected or maintained by the Secretary and by State educational agencies and local educational agencies pursuant to this subchapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299ccd3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/d"><num value="d" class="bold">(d)</num><heading class="bold"> Personnel</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary is authorized to hire qualified personnel necessary to carry out the Secretary’s duties under subsection (a), under <ref href="/us/usc/t20/s1418">section 1418 of this title</ref>, and under part D of subchapter IV, without regard to the provisions of title 5 relating to appointments in the competitive service and without regard to chapter 51 and subchapter III of chapter 53 of such title relating to classification and general schedule pay rates, except that no more than 20 such personnel shall be employed at any time.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299ccd4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/e"><num value="e" class="bold">(e)</num><heading class="bold"> Model forms</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than the date that the Secretary publishes final regulations under this chapter, to implement amendments made by the Individuals with Disabilities Education Improvement Act of 2004, the Secretary shall publish and disseminate widely to States, local educational agencies, and parent and community training and information centers—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8299ccd5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/e/1"><num value="1">(1)</num><content> a model IEP form;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299ccd6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/e/2"><num value="2">(2)</num><content> a model individualized family service plan (IFSP) form;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299ccd7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/e/3"><num value="3">(3)</num><content> a model form of the notice of procedural safeguards described in <ref href="/us/usc/t20/s1415/d">section 1415(d) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299ccd8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1417/e/4"><num value="4">(4)</num><content> a model form of the prior written notice described in subsections (b)(3) and (c)(1) of <ref href="/us/usc/t20/s1415">section 1415 of this title</ref> that is consistent with the requirements of this subchapter and is sufficient to meet such requirements.</content>
