value=\"1418\">§ 1418.</num><heading> Program information</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8299ccde-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State that receives assistance under this subchapter, and the Secretary of the Interior, shall provide data each year to the Secretary of Education and the public on the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccdf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299cce0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A\"><num value=\"A\">(A)</num><chapeau> The number and percentage of children with disabilities, by race, ethnicity, limited English proficiency status, gender, and disability category, who are in each of the following separate categories:</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/i\"><num value=\"i\">(i)</num><content> Receiving a free appropriate public education.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> Participating in regular education.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/iii\"><num value=\"iii\">(iii)</num><content> In separate classes, separate schools or facilities, or public or private residential facilities.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/iv\"><num value=\"iv\">(iv)</num><content> For each year of age from age 14 through 21, stopped receiving special education and related services because of program completion (including graduation with a regular secondary school diploma), or other reasons, and the reasons why those children stopped receiving special education and related services.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/v\"><num value=\"v\">(v)</num><subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/v/I\"><num value=\"I\">(I)</num><content> Removed to an interim alternative educational setting under <ref href=\"/us/usc/t20/s1415/k/1\">section 1415(k)(1) of this title</ref>.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/v/II\"><num value=\"II\">(II)</num><content> The acts or items precipitating those removals.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299cce8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/A/v/III\"><num value=\"III\">(III)</num><content> The number of children with disabilities who are subject to long-term suspensions or expulsions.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299cce9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/B\"><num value=\"B\">(B)</num><content> The number and percentage of children with disabilities, by race, gender, and ethnicity, who are receiving early intervention services.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/C\"><num value=\"C\">(C)</num><content> The number and percentage of children with disabilities, by race, gender, and ethnicity, who, from birth through age 2, stopped receiving early intervention services because of program completion or for other reasons.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299cceb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/D\"><num value=\"D\">(D)</num><content> The incidence and duration of disciplinary actions by race, ethnicity, limited English proficiency status, gender, and disability category, of children with disabilities, including suspensions of 1 day or more.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccec-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/E\"><num value=\"E\">(E)</num><content> The number and percentage of children with disabilities who are removed to alternative educational settings or expelled as compared to children without disabilities who are removed to alternative educational settings or expelled.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299cced-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/F\"><num value=\"F\">(F)</num><content> The number of due process complaints filed under <ref href=\"/us/usc/t20/s1415\">section 1415 of this title</ref> and the number of hearings conducted.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccee-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/G\"><num value=\"G\">(G)</num><content> The number of hearings requested under <ref href=\"/us/usc/t20/s1415/k\">section 1415(k) of this title</ref> and the number of changes in placements ordered as a result of those hearings.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccef-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/1/H\"><num value=\"H\">(H)</num><content> The number of mediations held and the number of settlement agreements reached through such mediations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccf0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/2\"><num value=\"2\">(2)</num><content> The number and percentage of infants and toddlers, by race, and ethnicity, who are at risk of having substantial developmental delays (as defined in <ref href=\"/us/usc/t20/s1432\">section 1432 of this title</ref>), and who are receiving early intervention services under subchapter III.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8299ccf1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/a/3\"><num value=\"3\">(3)</num><content> Any other information that may be required by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8299ccf2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Data reporting</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8299ccf3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Protection of identifiable data</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The data described in subsection (a) shall be publicly reported by each State in a manner that does not result in the disclosure of data identifiable to individual children.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8299ccf4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Sampling</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may permit States and the Secretary of the Interior to obtain the data described in subsection (a) through sampling.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8299ccf5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may provide technical assistance to States to ensure compliance with the data collection and reporting requirements under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8299ccf6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Disproportionality</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8299ccf7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each State that receives assistance under this subchapter, and the Secretary of the Interior, shall provide for the collection and examination of data to determine if significant disproportionality based on race and ethnicity is occurring in the State and the local educational agencies of the State with respect to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccf8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/1/A\"><num value=\"A\">(A)</num><content> the identification of children as children with disabilities, including the identification of children as children with disabilities in accordance with a particular impairment described in <ref href=\"/us/usc/t20/s1401/3\">section 1401(3) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccf9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/1/B\"><num value=\"B\">(B)</num><content> the placement in particular educational settings of such children; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccfa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/1/C\"><num value=\"C\">(C)</num><content> the incidence, duration, and type of disciplinary actions, including suspensions and expulsions.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8299ccfb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Review and revision of policies, practices, and procedures</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In the case of a determination of significant disproportionality with respect to the identification of children as children with disabilities, or the placement in particular educational settings of such children, in accordance with paragraph (1), the State or the Secretary of the Interior, as the case may be, shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccfc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/2/A\"><num value=\"A\">(A)</num><content> provide for the review and, if appropriate, revision of the policies, procedures, and practices used in such identification or placement to ensure that such policies, procedures, and practices comply with the requirements of this chapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccfd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/2/B\"><num value=\"B\">(B)</num><content> require any local educational agency identified under paragraph (1) to reserve the maximum amount of funds under <ref href=\"/us/usc/t20/s1413/f\">section 1413(f) of this title</ref> to provide comprehensive coordinated early intervening services to serve children in the local educational agency, particularly children in those groups that were significantly overidentified under paragraph (1); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8299ccfe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1418/d/2/C\"><num value=\"C\">(C)</num><content> require the local educational agency to publicly report on the revision of policies, practices, and procedures described
