<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8299cd02-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419"><num value="1419">§ 1419.</num><heading> Preschool grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd03-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall provide grants under this section to assist States to provide special education and related services, in accordance with this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd04-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/a/1"><num value="1">(1)</num><content> to children with disabilities aged 3 through 5, inclusive; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd05-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/a/2"><num value="2">(2)</num><content> at the State’s discretion, to 2-year-old children with disabilities who will turn 3 during the school year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd06-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligibility</heading><chapeau style="-uslm-lc:I11" class="indent0">A State shall be eligible for a grant under this section if such State—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd07-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/b/1"><num value="1">(1)</num><content> is eligible under <ref href="/us/usc/t20/s1412">section 1412 of this title</ref> to receive a grant under this subchapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd08-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/b/2"><num value="2">(2)</num><content> makes a free appropriate public education available to all children with disabilities, aged 3 through 5, residing in the State.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd09-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c"><num value="c" class="bold">(c)</num><heading class="bold"> Allocations to States</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd0a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall allocate the amount made available to carry out this section for a fiscal year among the States in accordance with paragraph (2) or (3), as the case may be.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd0b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Increase in funds</heading><chapeau style="-uslm-lc:I12" class="indent1">If the amount available for allocations to States under paragraph (1) for a fiscal year is equal to or greater than the amount allocated to the States under this section for the preceding fiscal year, those allocations shall be calculated as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd0c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Allocation</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8299cd0d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">Except as provided in subparagraph (B), the Secretary shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id8299cd0e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A/i/I"><num value="I">(I)</num><content> allocate to each State the amount the State received under this section for fiscal year 1997;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8299cd0f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A/i/II"><num value="II">(II)</num><content> allocate 85 percent of any remaining funds to States on the basis of the States’ relative populations of children aged 3 through 5; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8299cd10-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A/i/III"><num value="III">(III)</num><content> allocate 15 percent of those remaining funds to States on the basis of the States’ relative populations of all children aged 3 through 5 who are living in poverty.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8299cd11-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Data</heading><content><p style="-uslm-lc:I14" class="indent3">For the purpose of making grants under this paragraph, the Secretary shall use the most recent population data, including data on children living in poverty, that are available and satisfactory to the Secretary.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd12-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitations</heading><chapeau style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), allocations under this paragraph shall be subject to the following:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8299cd13-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Preceding years</heading><content><p style="-uslm-lc:I14" class="indent3">No State’s allocation shall be less than its allocation under this section for the preceding fiscal year.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8299cd14-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Minimum</heading><chapeau style="-uslm-lc:I14" class="indent3">No State’s allocation shall be less than the greatest of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id8299cd15-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/I"><num value="I">(I)</num><chapeau> the sum of—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id8299cd16-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/I/aa"><num value="aa">(aa)</num><content> the amount the State received under this section for fiscal year 1997; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id8299cd17-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/I/bb"><num value="bb">(bb)</num><content> ⅓ of 1 percent of the amount by which the amount appropriated under subsection (j) for the fiscal year exceeds the amount appropriated for this section for fiscal year 1997;</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8299cd18-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/II"><num value="II">(II)</num><chapeau> the sum of—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id8299cd19-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/II/aa"><num value="aa">(aa)</num><content> the amount the State received under this section for the preceding fiscal year; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id8299cd1a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/II/bb"><num value="bb">(bb)</num><content> that amount multiplied by the percentage by which the increase in the funds appropriated under this section from the preceding fiscal year exceeds 1.5 percent; or</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8299cd1b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/III"><num value="III">(III)</num><chapeau> the sum of—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id8299cd1c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/III/aa"><num value="aa">(aa)</num><content> the amount the State received under this section for the preceding fiscal year; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id8299cd1d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/ii/III/bb"><num value="bb">(bb)</num><content> that amount multiplied by 90 percent of the percentage increase in the amount appropriated under this section from the preceding fiscal year.</content>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8299cd1e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Maximum</heading><chapeau style="-uslm-lc:I14" class="indent3">Notwithstanding clause (ii), no State’s allocation under this paragraph shall exceed the sum of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id8299cd1f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/iii/I"><num value="I">(I)</num><content> the amount the State received under this section for the preceding fiscal year; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8299cd20-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/B/iii/II"><num value="II">(II)</num><content> that amount multiplied by the sum of 1.5 percent and the percentage increase in the amount appropriated under this section from the preceding fiscal year.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd21-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Ratable reductions</heading><content><p style="-uslm-lc:I13" class="indent2">If the amount available for allocations under this paragraph is insufficient to pay those allocations in full, those allocations shall be ratably reduced, subject to subparagraph (B)(i).</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd22-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Decrease in funds</heading><chapeau style="-uslm-lc:I12" class="indent1">If the amount available for allocations to States under paragraph (1) for a fiscal year is less than the amount allocated to the States under this section for the preceding fiscal year, those allocations shall be calculated as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd23-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Allocations</heading><chapeau style="-uslm-lc:I13" class="indent2">If the amount available for allocations is greater than the amount allocated to the States for fiscal year 1997, each State shall be allocated the sum of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8299cd24-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/3/A/i"><num value="i">(i)</num><content> the amount the State received under this section for fiscal year 1997; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8299cd25-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/3/A/ii"><num value="ii">(ii)</num><content> an amount that bears the same relation to any remaining funds as the increase the State received under this section for the preceding fiscal year over fiscal year 1997 bears to the total of all such increases for all States.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd26-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Ratable reductions</heading><content><p style="-uslm-lc:I13" class="indent2">If the amount available for allocations is equal to or less than the amount allocated to the States for fiscal year 1997, each State shall be allocated the amount the State received for fiscal year 1997, ratably reduced, if necessary.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd27-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/d"><num value="d" class="bold">(d)</num><heading class="bold"> Reservation for State activities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd28-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each State may reserve not more than the amount described in paragraph (2) for administration and other State-level activities in accordance with subsections (e) and (f).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd29-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Amount described</heading><chapeau style="-uslm-lc:I12" class="indent1">For each fiscal year, the Secretary shall determine and report to the State educational agency an amount that is 25 percent of the amount the State received under this section for fiscal year 1997, cumulatively adjusted by the Secretary for each succeeding fiscal year by the lesser of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8299cd2a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/d/2/A"><num value="A">(A)</num><content> the percentage increase, if any, from the preceding fiscal year in the State’s allocation under this section; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8299cd2b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/d/2/B"><num value="B">(B)</num><content> the percentage increase, if any, from the preceding fiscal year in the Consumer Price Index For All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd2c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/e"><num value="e" class="bold">(e)</num><heading class="bold"> State administration</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd2d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">For the purpose of administering this section (including the coordination of activities under this subchapter with, and providing technical assistance to, other programs that provide services to children with disabilities) a State may use not more than 20 percent of the maximum amount the State may reserve under subsection (d) for any fiscal year.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd2e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration of subchapter III</heading><content><p style="-uslm-lc:I12" class="indent1">Funds described in paragraph (1) may also be used for the administration of subchapter III.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd2f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f"><num value="f" class="bold">(f)</num><heading class="bold"> Other State-level activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Each State shall use any funds the State reserves under subsection (d) and does not use for administration under subsection (e)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd30-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/1"><num value="1">(1)</num><content> for support services (including establishing and implementing the mediation process required by <ref href="/us/usc/t20/s1415/e">section 1415(e) of this title</ref>), which may benefit children with disabilities younger than 3 or older than 5 as long as those services also benefit children with disabilities aged 3 through 5;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd31-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/2"><num value="2">(2)</num><content> for direct services for children eligible for services under this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd32-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/3"><num value="3">(3)</num><content> for activities at the State and local levels to meet the performance goals established by the State under <ref href="/us/usc/t20/s1412/a/15">section 1412(a)(15) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd33-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/4"><num value="4">(4)</num><content> to supplement other funds used to develop and implement a statewide coordinated services system designed to improve results for children and families, including children with disabilities and their families, but not more than 1 percent of the amount received by the State under this section for a fiscal year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd34-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/5"><num value="5">(5)</num><content> to provide early intervention services (which shall include an educational component that promotes school readiness and incorporates preliteracy, language, and numeracy skills) in accordance with subchapter III to children with disabilities who are eligible for services under this section and who previously received services under subchapter III until such children enter, or are eligible under State law to enter, kindergarten; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8299cd35-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/f/6"><num value="6">(6)</num><content> at the State’s discretion, to continue service coordination or case management for families who receive services under subchapter III.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd36-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g"><num value="g" class="bold">(g)</num><heading class="bold"> Subgrants to local educational agencies</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd37-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Subgrants required</heading><chapeau style="-uslm-lc:I12" class="indent1">Each State that receives a grant under this section for any fiscal year shall distribute all of the grant funds that the State does not reserve under subsection (d) to local educational agencies in the State that have established their eligibility under <ref href="/us/usc/t20/s1413">section 1413 of this title</ref>, as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd38-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Base payments</heading><content><p style="-uslm-lc:I13" class="indent2">The State shall first award each local educational agency described in paragraph (1) the amount that agency would have received under this section for fiscal year 1997 if the State had distributed 75 percent of its grant for that year under <ref href="/us/usc/t20/s1419/c/3">section 1419(c)(3) of this title</ref>, as such section was then in effect.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8299cd39-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Allocation of remaining funds</heading><chapeau style="-uslm-lc:I13" class="indent2">After making allocations under subparagraph (A), the State shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8299cd3a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/1/B/i"><num value="i">(i)</num><content> allocate 85 percent of any remaining funds to those local educational agencies on the basis of the relative numbers of children enrolled in public and private elementary schools and secondary schools within the local educational agency’s jurisdiction; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8299cd3b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/1/B/ii"><num value="ii">(ii)</num><content> allocate 15 percent of those remaining funds to those local educational agencies in accordance with their relative numbers of children living in poverty, as determined by the State educational agency.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8299cd3c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reallocation of funds</heading><content><p style="-uslm-lc:I12" class="indent1">If a State educational agency determines that a local educational agency is adequately providing a free appropriate public education to all children with disabilities aged 3 through 5 residing in the area served by the local educational agency with State and local funds, the State educational agency may reallocate any portion of the funds under this section that are not needed by that local educational agency to provide a free appropriate public education to other local educational agencies in the State that are not adequately providing special education and related services to all children with disabilities aged 3 through 5 residing in the areas the other local educational agencies serve.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8299cd3d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1419/h"><num value="h" class="bold">(h)</num><heading class="bold"> Subchapter III inapplicable</heading><content><p style="-uslm-lc:I11" class="indent0">Subchapter III does not apply to any child with a disability receiving a free appropriate public education, in accordance with this subchapter, with funds received under this section.</p>
</content>
</subsection>
