L. 108–446, title I, § 101, Dec. 3, 2004, 118 Stat. 2757.)","seq_in_title":921,"parent_identifier":"/us/usc/t20/ch33/schIII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33","level":"chapter","num":"CHAPTER 33—","heading":"EDUCATION OF INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"INFANTS AND TODDLERS WITH DISABILITIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id829c3e32-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440\"><num value=\"1440\">§ 1440.</num><heading> Payor of last resort</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id829c3e33-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Nonsubstitution</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Funds provided under <ref href=\"/us/usc/t20/s1443\">section 1443 of this title</ref> may not be used to satisfy a financial commitment for services that would have been paid for from another public or private source, including any medical program administered by the Secretary of Defense, but for the enactment of this subchapter, except that whenever considered necessary to prevent a delay in the receipt of appropriate early intervention services by an infant, toddler, or family in a timely fashion, funds provided under <ref href=\"/us/usc/t20/s1443\">section 1443 of this title</ref> may be used to pay the provider of services pending reimbursement from the agency that has ultimate responsibility for the payment.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id829c3e34-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Obligations related to and methods of ensuring services</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829c3e35-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Establishing financial responsibility for services</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id829c3e36-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Chief Executive Officer of a State or designee of the officer shall ensure that an interagency agreement or other mechanism for interagency coordination is in effect between each public agency and the designated lead agency, in order to ensure—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id829c3e37-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/1/A/i\"><num value=\"i\">(i)</num><content> the provision of, and financial responsibility for, services provided under this subchapter; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id829c3e38-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> such services are consistent with the requirements of <ref href=\"/us/usc/t20/s1435\">section 1435 of this title</ref> and the State’s application pursuant to <ref href=\"/us/usc/t20/s1437\">section 1437 of this title</ref>, including the provision of such services during the pendency of any such dispute.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id829c3e39-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Consistency between agreements or mechanisms under subchapter II</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Chief Executive Officer of a State or designee of the officer shall ensure that the terms and conditions of such agreement or mechanism are consistent with the terms and conditions of the State’s agreement or mechanism under <ref href=\"/us/usc/t20/s1412/a/12\">section 1412(a)(12) of this title</ref>, where appropriate.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829c3e3a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Reimbursement for services by public agency</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id829c3e3b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If a public agency other than an educational agency fails to provide or pay for the services pursuant to an agreement required under paragraph (1), the local educational agency or State agency (as determined by the Chief Executive Officer or designee) shall provide or pay for the provision of such services to the child.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id829c3e3c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Reimbursement</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Such local educational agency or State agency is authorized to claim reimbursement for the services from the public agency that failed to provide or pay for such services and such public agency shall reimburse the local educational agency or State agency pursuant to the terms of the interagency agreement or other mechanism required under paragraph (1).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829c3e3d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Special rule</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The requirements of paragraph (1) may be met through—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829c3e3e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/3/A\"><num value=\"A\">(A)</num><content> State statute or regulation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829c3e3f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/3/B\"><num value=\"B\">(B)</num><content> signed agreements between respective agency officials that clearly identify the responsibilities of each agency relating to the provision of services; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829c3e40-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/b/3/C\"><num value=\"C\">(C)</num><content> other appropriate written methods as determined by the Chief Executive Officer of the State or designee of the officer and approved by the Secretary through the review and approval of the State’s application pursuant to <ref href=\"/us/usc/t20/s1437\">section 1437 of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id829c3e41-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1440/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Reduction of other benefits</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this subchapter shall be construed to permit the State to reduce medical or other assistance available or to alter eligibility under title V of the Social Security Act [<ref href=\"/us/usc/t42/s701\">42 U.S.C. 701</ref> et seq.] (relating to maternal and child health) or title XIX of the Social Security Act [<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.] (relating to medicaid for infants or toddlers with disabilities) within the State.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id829c3e42-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s640\">Pub.
