L. 114–95, title IX, §§ 9214(d)(3), 9215(ss)(7), Dec. 10, 2015, 129 Stat. 2165, 2183.)","seq_in_title":929,"parent_identifier":"/us/usc/t20/ch33/schIV/ptA","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33","level":"chapter","num":"CHAPTER 33—","heading":"EDUCATION OF INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"NATIONAL ACTIVITIES TO IMPROVE EDUCATION OF CHILDREN WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schIV/ptA","level":"part","num":"Part A—","heading":"State Personnel Development Grants","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id829e87e6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453\"><num value=\"1453\">§ 1453.</num><heading> Applications</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id829e87e7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829e87e8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Submission</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State educational agency that desires to receive a grant under this part shall submit to the Secretary an application at such time, in such manner, and including such information as the Secretary may require.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829e87e9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> State plan</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The application shall include a plan that identifies and addresses the State and local needs for the personnel preparation and professional development of personnel, as well as individuals who provide direct supplementary aids and services to children with disabilities, and that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87ea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2/A\"><num value=\"A\">(A)</num><content> is designed to enable the State to meet the requirements of <ref href=\"/us/usc/t20/s1412/a/14\">section 1412(a)(14) of this title</ref> and section 1435(a)(8) and (9) of this title;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87eb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2/B\"><num value=\"B\">(B)</num><chapeau> is based on an assessment of State and local needs that identifies critical aspects and areas in need of improvement related to the preparation, ongoing training, and professional development of personnel who serve infants, toddlers, preschoolers, and children with disabilities within the State, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id829e87ec-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2/B/i\"><num value=\"i\">(i)</num><content> current and anticipated personnel vacancies and shortages; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id829e87ed-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> the number of preservice and inservice programs; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87ee-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/2/C\"><num value=\"C\">(C)</num><content> is integrated and aligned, to the maximum extent possible, with State plans and activities under the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s6301\">20 U.S.C. 6301</ref> et seq.], the Rehabilitation Act of 1973 [<ref href=\"/us/usc/t29/s701\">29 U.S.C. 701</ref> et seq.], and the Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.].</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id829e87ef-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State application shall contain an assurance that the State educational agency will carry out each of the strategies described in subsection (b)(4).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id829e87f0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Elements of State personnel development plan</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State personnel development plan under subsection (a)(2) shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id829e87f1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/1\"><num value=\"1\">(1)</num><chapeau> describe a partnership agreement that is in effect for the period of the grant, which agreement shall specify—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87f2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/1/A\"><num value=\"A\">(A)</num><content> the nature and extent of the partnership described in <ref href=\"/us/usc/t20/s1452/b\">section 1452(b) of this title</ref> and the respective roles of each member of the partnership, including the partner described in <ref href=\"/us/usc/t20/s1452/b/3\">section 1452(b)(3) of this title</ref> if applicable; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87f3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/1/B\"><num value=\"B\">(B)</num><content> how the State educational agency will work with other persons and organizations involved in, and concerned with, the education of children with disabilities, including the respective roles of each of the persons and organizations;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id829e87f4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/2\"><num value=\"2\">(2)</num><content> describe how the strategies and activities described in paragraph (4) will be coordinated with activities supported with other public resources (including part B [subchapter II] and part C [subchapter III] funds retained for use at the State level for personnel and professional development purposes) and private resources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id829e87f5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/3\"><num value=\"3\">(3)</num><content> describe how the State educational agency will align its personnel development plan under this part with the plan and application submitted under sections 1111 and 2101(d), respectively, of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s6311\">20 U.S.C. 6311</ref>, 6611(d)];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id829e87f6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/4\"><num value=\"4\">(4)</num><chapeau> describe those strategies the State educational agency will use to address the professional development and personnel needs identified under subsection (a)(2) and how such strategies will be implemented, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87f7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/4/A\"><num value=\"A\">(A)</num><content> a description of the programs and activities to be supported under this part that will provide personnel with the knowledge and skills to meet the needs of, and improve the performance and achievement of, infants, toddlers, preschoolers, and children with disabilities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id829e87f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/4/B\"><num value=\"B\">(B)</num><content> how such strategies will be integrated, to the maximum extent possible, with other activities supported by grants funded under <ref href=\"/us/usc/t20/s1462\">section 1462 of this title</ref>;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id829e87f9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/5\"><num value=\"5\">(5)</num><content> provide an assurance that the State educational agency will provide technical assistance to local educational agencies to improve the quality of professional development available to meet the needs of personnel who serve children with disabilities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f7fa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/6\"><num value=\"6\">(6)</num><content> provide an assurance that the State educational agency will provide technical assistance to entities that provide services to infants and toddlers with disabilities to improve the quality of professional development available to meet the needs of personnel serving such children;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f7fb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/7\"><num value=\"7\">(7)</num><content> describe how the State educational agency will recruit and retain teachers who meet the qualifications described in <ref href=\"/us/usc/t20/s1412/a/14/C\">section 1412(a)(14)(C) of this title</ref> and other qualified personnel in geographic areas of greatest need;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f7fc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/8\"><num value=\"8\">(8)</num><content> describe the steps the State educational agency will take to ensure that poor and minority children are not taught at higher rates by teachers who do not meet the qualifications described in <ref href=\"/us/usc/t20/s1412/a/14/C\">section 1412(a)(14)(C) of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f7fd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/b/9\"><num value=\"9\">(9)</num><content> describe how the State educational agency will assess, on a regular basis, the extent to which the strategies implemented under this part have been effective in meeting the performance goals described in <ref href=\"/us/usc/t20/s1412/a/15\">section 1412(a)(15) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a0f7fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Peer review</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a0f7ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall use a panel of experts who are competent, by virtue of their training, expertise, or experience, to evaluate applications for grants under <ref href=\"/us/usc/t20/s1451/c/1\">section 1451(c)(1) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a0f800-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Composition of panel</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A majority of a panel described in paragraph (1) shall be composed of individuals who are not employees of the Federal Government.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a0f801-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Payment of fees and expenses of certain members</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may use available funds appropriated to carry out this part to pay the expenses and fees of panel members who are not employees of the Federal Government.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a0f802-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Reporting procedures</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State educational agency that receives a grant under this part shall submit annual performance reports to the Secretary. The reports shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f803-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/d/1\"><num value=\"1\">(1)</num><content> describe the progress of the State educational agency in implementing its plan;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f804-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/d/2\"><num value=\"2\">(2)</num><content> analyze the effectiveness of the State educational agency’s activities under this part and of the State educational agency’s strategies for meeting its goals under <ref href=\"/us/usc/t20/s1412/a/15\">section 1412(a)(15) of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f805-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1453/d/3\"><num value=\"3\">(3)</num><content> identify changes in the strategies used by the State educational agency and described in subsection (b)(4), if any, to improve the State educational agency’s performance.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id82a0f806-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s653\">Pub.
