definition of eligible entity</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a0f857-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purpose</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of this part is—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f858-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/a/1\"><num value=\"1\">(1)</num><content> to provide Federal funding for personnel preparation, technical assistance, model demonstration projects, information dissemination, and studies and evaluations, in order to improve early intervention, educational, and transitional results for children with disabilities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a0f859-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/a/2\"><num value=\"2\">(2)</num><content> to assist State educational agencies and local educational agencies in improving their education systems for children with disabilities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a0f85a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definition of eligible entity</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a0f85b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In this part, the term “eligible entity” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f85c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/A\"><num value=\"A\">(A)</num><content> a State educational agency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f85d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/B\"><num value=\"B\">(B)</num><content> a local educational agency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f85e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/C\"><num value=\"C\">(C)</num><content> a public charter school that is a local educational agency under State law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f85f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/D\"><num value=\"D\">(D)</num><content> an institution of higher education;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f860-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/E\"><num value=\"E\">(E)</num><content> a public agency not described in subparagraphs (A) through (D);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f861-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/F\"><num value=\"F\">(F)</num><content> a private nonprofit organization;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f862-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/G\"><num value=\"G\">(G)</num><content> an outlying area;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f863-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/H\"><num value=\"H\">(H)</num><content> an Indian tribe or a tribal organization (as defined under <ref href=\"/us/usc/t25/s5304\">section 5304 of title 25</ref>); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a0f864-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/1/I\"><num value=\"I\">(I)</num><content> a for-profit organization, if the Secretary finds it appropriate in light of the purposes of a particular competition for a grant, contract, or cooperative agreement under this part.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a0f865-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1461/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may limit which eligible entities described in paragraph (1) are eligible for a grant, contract, or cooperative agreement under this part to 1 or more of the categories of eligible entities described in paragraph (1).</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id82a0f866-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s661\">Pub.
