L. 108–446, title I, § 101, Dec. 3, 2004, 118 Stat. 2783.)","seq_in_title":935,"parent_identifier":"/us/usc/t20/ch33/schIV/ptB","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33","level":"chapter","num":"CHAPTER 33—","heading":"EDUCATION OF INDIVIDUALS WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"NATIONAL ACTIVITIES TO IMPROVE EDUCATION OF CHILDREN WITH DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch33/schIV/ptB","level":"part","num":"Part B—","heading":"Personnel Preparation, Technical Assistance, Model Demonstration Projects, and Dissemination of Information","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82a369f7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464\"><num value=\"1464\">§ 1464.</num><heading> Studies and evaluations</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a369f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Studies and evaluations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a369f9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Delegation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall delegate to the Director of the Institute of Education Sciences responsibility to carry out this section, other than subsections (d) and (f).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a369fa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Assessment</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall, directly or through grants, contracts, or cooperative agreements awarded to eligible entities on a competitive basis, assess the progress in the implementation of this chapter, including the effectiveness of State and local efforts to provide—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a369fb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/a/2/A\"><num value=\"A\">(A)</num><content> a free appropriate public education to children with disabilities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a369fc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/a/2/B\"><num value=\"B\">(B)</num><content> early intervention services to infants and toddlers with disabilities, and infants and toddlers who would be at risk of having substantial developmental delays if early intervention services were not provided to the infants and toddlers.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a369fd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Assessment of national activities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a369fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall carry out a national assessment of activities carried out with Federal funds under this chapter in order—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a369ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/1/A\"><num value=\"A\">(A)</num><content> to determine the effectiveness of this chapter in achieving the purposes of this chapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a00-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/1/B\"><num value=\"B\">(B)</num><content> to provide timely information to the President, Congress, the States, local educational agencies, and the public on how to implement this chapter more effectively; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a01-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/1/C\"><num value=\"C\">(C)</num><content> to provide the President and Congress with information that will be useful in developing legislation to achieve the purposes of this chapter more effectively.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a36a02-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Scope of assessment</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The national assessment shall assess activities supported under this chapter, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a03-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/A\"><num value=\"A\">(A)</num><content> the implementation of programs assisted under this chapter and the impact of such programs on addressing the developmental needs of, and improving the academic achievement of, children with disabilities to enable the children to reach challenging developmental goals and challenging State academic content standards based on State academic assessments;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a04-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/B\"><num value=\"B\">(B)</num><content> the types of programs and services that have demonstrated the greatest likelihood of helping students reach the challenging State academic content standards and developmental goals;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a05-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/C\"><num value=\"C\">(C)</num><content> the implementation of the professional development activities assisted under this chapter and the impact on instruction, student academic achievement, and teacher qualifications to enhance the ability of special education teachers and regular education teachers to improve results for children with disabilities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a06-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D\"><num value=\"D\">(D)</num><chapeau> the effectiveness of schools, local educational agencies, States, other recipients of assistance under this chapter, and the Secretary in achieving the purposes of this chapter by—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a07-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/i\"><num value=\"i\">(i)</num><content> improving the academic achievement of children with disabilities and their performance on regular statewide assessments as compared to nondisabled children, and the performance of children with disabilities on alternate assessments;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a08-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/ii\"><num value=\"ii\">(ii)</num><content> improving the participation of children with disabilities in the general education curriculum;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a09-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/iii\"><num value=\"iii\">(iii)</num><content> improving the transitions of children with disabilities at natural transition points;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/iv\"><num value=\"iv\">(iv)</num><content> placing and serving children with disabilities, including minority children, in the least restrictive environment appropriate;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/v\"><num value=\"v\">(v)</num><content> preventing children with disabilities, especially children with emotional disturbances and specific learning disabilities, from dropping out of school;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/vi\"><num value=\"vi\">(vi)</num><content> addressing the reading and literacy needs of children with disabilities;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/vii\"><num value=\"vii\">(vii)</num><content> reducing the inappropriate overidentification of children, especially minority and limited English proficient children, as having a disability;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/viii\"><num value=\"viii\">(viii)</num><content> improving the participation of parents of children with disabilities in the education of their children; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a0f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/2/D/ix\"><num value=\"ix\">(ix)</num><content> resolving disagreements between education personnel and parents through alternate dispute resolution activities, including mediation.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a36a10-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Interim and final reports</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall submit to the President and Congress—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a11-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/3/A\"><num value=\"A\">(A)</num><content> an interim report that summarizes the preliminary findings of the assessment not later than 3 years after <date date=\"2004-12-03\">December 3, 2004</date>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a12-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/b/3/B\"><num value=\"B\">(B)</num><content> a final report of the findings of the assessment not later than 5 years after <date date=\"2004-12-03\">December 3, 2004</date>.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a36a13-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Study on ensuring accountability for students who are held to alternative achievement standards</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall carry out a national study or studies to examine—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a14-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/1\"><num value=\"1\">(1)</num><chapeau> the criteria that States use to determine—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a15-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/1/A\"><num value=\"A\">(A)</num><content> eligibility for alternate assessments; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a16-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/1/B\"><num value=\"B\">(B)</num><content> the number and type of children who take those assessments and are held accountable to alternative achievement standards;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a17-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/2\"><num value=\"2\">(2)</num><content> the validity and reliability of alternate assessment instruments and procedures;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a18-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/3\"><num value=\"3\">(3)</num><content> the alignment of alternate assessments and alternative achievement standards to State academic content standards in reading, mathematics, and science; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a19-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/c/4\"><num value=\"4\">(4)</num><content> the use and effectiveness of alternate assessments in appropriately measuring student progress and outcomes specific to individualized instructional need.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a36a1a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Annual report</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide an annual report to Congress that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a1b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d/1\"><num value=\"1\">(1)</num><content> summarizes the research conducted under part E of the Education Sciences Reform Act of 2002 [<ref href=\"/us/usc/t20/s9567\">20 U.S.C. 9567</ref> et seq.];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a1c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d/2\"><num value=\"2\">(2)</num><content> analyzes and summarizes the data reported by the States and the Secretary of the Interior under <ref href=\"/us/usc/t20/s1418\">section 1418 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a1d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d/3\"><num value=\"3\">(3)</num><content> summarizes the studies and evaluations conducted under this section and the timeline for their completion;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a1e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d/4\"><num value=\"4\">(4)</num><content> describes the extent and progress of the assessment of national activities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a1f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/d/5\"><num value=\"5\">(5)</num><content> describes the findings and determinations resulting from reviews of State implementation of this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a36a20-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Authorized activities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out this section, the Secretary may support objective studies, evaluations, and assessments, including studies that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a21-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/1\"><num value=\"1\">(1)</num><content> analyze measurable impact, outcomes, and results achieved by State educational agencies and local educational agencies through their activities to reform policies, procedures, and practices designed to improve educational and transitional services and results for children with disabilities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a22-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/2\"><num value=\"2\">(2)</num><content> analyze State and local needs for professional development, parent training, and other appropriate activities that can reduce the need for disciplinary actions involving children with disabilities;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a23-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3\"><num value=\"3\">(3)</num><chapeau> assess educational and transitional services and results for children with disabilities from minority backgrounds, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a24-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/A\"><num value=\"A\">(A)</num><chapeau> data on—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a25-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/A/i\"><num value=\"i\">(i)</num><content> the number of minority children who are referred for special education evaluation;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a26-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/A/ii\"><num value=\"ii\">(ii)</num><content> the number of minority children who are receiving special education and related services and their educational or other service placement;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a27-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/A/iii\"><num value=\"iii\">(iii)</num><content> the number of minority children who graduated from secondary programs with a regular diploma in the standard number of years; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82a36a28-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/A/iv\"><num value=\"iv\">(iv)</num><content> the number of minority children who drop out of the educational system; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a29-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/3/B\"><num value=\"B\">(B)</num><content> the performance of children with disabilities from minority backgrounds on State assessments and other performance indicators established for all students;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a2a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/4\"><num value=\"4\">(4)</num><chapeau> measure educational and transitional services and results for children with disabilities served under this chapter, including longitudinal studies that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a2b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/4/A\"><num value=\"A\">(A)</num><content> examine educational and transitional services and results for children with disabilities who are 3 through 17 years of age and are receiving special education and related services under this chapter, using a national, representative sample of distinct age cohorts and disability categories; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a36a2c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/4/B\"><num value=\"B\">(B)</num><content> examine educational results, transition services, postsecondary placement, and employment status for individuals with disabilities, 18 through 21 years of age, who are receiving or have received special education and related services under this chapter; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a36a2d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/e/5\"><num value=\"5\">(5)</num><content> identify and report on the placement of children with disabilities by disability category.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a36a2e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1464/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Study</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall study, and report to Congress regarding, the extent to which States adopt policies described in <ref href=\"/us/usc/t20/s1435/c/1\">section 1435(c)(1) of this title</ref> and on the effects of those policies.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id82a36a2f-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/91/230/tVI/s664\">Pub.
