<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b3b1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b"><num value="b" class="bold">(b)</num><heading class="bold"> Technology development, demonstration, and use</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3b2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out this section, the Secretary shall support activities to promote the development, demonstration, and use of technology.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3b3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Authorized activities</heading><chapeau style="-uslm-lc:I12" class="indent1">The following activities may be carried out under this subsection:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3b4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/2/A"><num value="A">(A)</num><content> Conducting research on and promoting the demonstration and use of innovative, emerging, and universally designed technologies for children with disabilities, by improving the transfer of technology from research and development to practice.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3b5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/2/B"><num value="B">(B)</num><content> Supporting research, development, and dissemination of technology with universal design features, so that the technology is accessible to the broadest range of individuals with disabilities without further modification or adaptation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3b6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/2/C"><num value="C">(C)</num><content> Demonstrating the use of systems to provide parents and teachers with information and training concerning early diagnosis of, intervention for, and effective teaching strategies for, young children with reading disabilities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3b7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/b/2/D"><num value="D">(D)</num><content> Supporting the use of Internet-based communications for students with cognitive disabilities in order to maximize their academic and functional skills.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b3b8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c"><num value="c" class="bold">(c)</num><heading class="bold"> Educational media services</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3b9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">In carrying out this section, the Secretary shall support—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3ba-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/A"><num value="A">(A)</num><content> educational media activities that are designed to be of educational value in the classroom setting to children with disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3bb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/B"><num value="B">(B)</num><chapeau> providing video description, open captioning, or closed captioning, that is appropriate for use in the classroom setting, of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id82a5b3bc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/B/i"><num value="i">(i)</num><content> television programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b3bd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/B/ii"><num value="ii">(ii)</num><content> videos;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b3be-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/B/iii"><num value="iii">(iii)</num><content> other materials, including programs and materials associated with new and emerging technologies, such as CDs, DVDs, video streaming, and other forms of multimedia; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b3bf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/B/iv"><num value="iv">(iv)</num><content> news (but only until <date date="2006-09-30">September 30, 2006</date>);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3c0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/C"><num value="C">(C)</num><content> distributing materials described in subparagraphs (A) and (B) through such mechanisms as a loan service; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3c1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/1/D"><num value="D">(D)</num><content> providing free educational materials, including textbooks, in accessible media for visually impaired and print disabled students in elementary schools and secondary schools, postsecondary schools, and graduate schools.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3c2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">The video description, open captioning, or closed captioning described in paragraph (1)(B) shall be provided only when the description or captioning has not been previously provided by the producer or distributor, or has not been fully funded by other sources.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b3c3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d"><num value="d" class="bold">(d)</num><heading class="bold"> Applications</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3c4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Any eligible entity that wishes to receive a grant, or enter into a contract or cooperative agreement, under subsection (b) or (c) shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3c5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Special rule</heading><chapeau style="-uslm-lc:I12" class="indent1">For the purpose of an application for an award to carry out activities described in subsection (c)(1)(D), such eligible entity shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3c6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d/2/A"><num value="A">(A)</num><content> be a national, nonprofit entity with a proven track record of meeting the needs of students with print disabilities through services described in subsection (c)(1)(D);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3c7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d/2/B"><num value="B">(B)</num><content> have the capacity to produce, maintain, and distribute in a timely fashion, up-to-date textbooks in digital audio formats to qualified students; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3c8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/d/2/C"><num value="C">(C)</num><content> have a demonstrated ability to significantly leverage Federal funds through other public and private contributions, as well as through the expansive use of volunteers.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b3c9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e"><num value="e" class="bold">(e)</num><heading class="bold"> National Instructional Materials Access Center</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3ca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish and support, through the American Printing House for the Blind, a center to be known as the “National Instructional Materials Access Center” not later than 1 year after <date date="2004-12-03">December 3, 2004</date>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3cb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I12" class="indent1">The duties of the National Instructional Materials Access Center are the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3cc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/2/A"><num value="A">(A)</num><content> To receive and maintain a catalog of print instructional materials prepared in the National Instructional Materials Accessibility Standard, as established by the Secretary, made available to such center by the textbook publishing industry, State educational agencies, and local educational agencies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3cd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/2/B"><num value="B">(B)</num><content> To provide access to print instructional materials, including textbooks, in accessible media, free of charge, to blind or other persons with print disabilities in elementary schools and secondary schools, in accordance with such terms and procedures as the National Instructional Materials Access Center may prescribe.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b3ce-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/2/C"><num value="C">(C)</num><content> To develop, adopt and publish procedures to protect against copyright infringement, with respect to the print instructional materials provided under sections 1412(a)(23) and 1413(a)(6) of this title.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3cf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b3d0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Blind or other persons with print disabilities</heading><content><p style="-uslm-lc:I13" class="indent2">The term “blind or other persons with print disabilities” means children served under this chapter and who may qualify in accordance with the Act entitled “An Act to provide books for the adult blind”, approved <date date="1931-03-03">March 3, 1931</date> (<ref href="/us/usc/t2/s135a">2 U.S.C. 135a</ref>; <ref href="/us/stat/46/1487">46 Stat. 1487</ref>) to receive books and other publications produced in specialized formats.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b3d1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> National Instructional Materials Accessibility Standard</heading><content><p style="-uslm-lc:I13" class="indent2">The term “National Instructional Materials Accessibility Standard” means the standard established by the Secretary to be used in the preparation of electronic files suitable and used solely for efficient conversion into specialized formats.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b3d2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Print instructional materials</heading><content><p style="-uslm-lc:I13" class="indent2">The term “print instructional materials” means printed textbooks and related printed core materials that are written and published primarily for use in elementary school and secondary school instruction and are required by a State educational agency or local educational agency for use by students in the classroom.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b3d3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Specialized formats</heading><content><p style="-uslm-lc:I13" class="indent2">The term “specialized formats” has the meaning given the term in <ref href="/us/usc/t17/s121/d/3">section 121(d)(3) of title 17</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3d4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I12" class="indent1">This subsection shall apply to print instructional materials published after the date on which the final rule establishing the National Instructional Materials Accessibility Standard was published in the Federal Register.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b3d5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1474/e/5"><num value="5" class="bold">(5)</num><heading class="bold"> Liability of the Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subsection shall be construed to establish a private right of action against the Secretary for failure to provide instructional materials directly, or for failure by the National Instructional Materials Access Center to perform the duties of such center, or to otherwise authorize a private right of action related to the performance by such center, including through the application of the rights of children and parents established under this chapter.</p>
